A senate is a deliberative assembly, often the upper house or chamber of a legislature or parliament. There have been many such bodies in history, since senate means the assembly of the eldest and wiser members of the society and ruling class. Two of the first official senates were the Spartan Gerousia (Γερουσία) and the Roman Senate.

Many countries currently have an assembly named a senate, composed of senators who may be elected, appointed, have inherited the title, or gained membership by other methods, depending on the country. Modern senates typically serve to provide a chamber of "sober second thought" to consider legislation passed by a lower house, whose members are usually elected.

Overview[link]

The modern word senate is derived from the Latin word senātus (senate), which comes from senex, "old man".^[1] The members or legislators of a senate are called senators. The Latin word senator was adopted into English with no change in spelling. Its meaning is derived from a very ancient form of simple social organization in which decision-making powers are reserved for the eldest men. For the same reason, the word senate is correctly used when referring to any powerful authority characteristically composed by the eldest members of a community, as a deliberative body of a faculty in an institution of higher learning is often called a senate. The original senate was the Roman Senate, which lasted until 580 (various efforts to revive it were made in Medieval Rome). In the Eastern Roman Empire, the Byzantine Senate continued until the Fourth Crusade, circa 1202–1204.

Modern democratic states with bicameral parliamentary systems are sometimes equipped with a senate, often distinguished from an ordinary parallel lower house, known variously as the "House of Representatives", "House of Commons", "Chamber of Deputies", "National Assembly", "Legislative Assembly", or "House of Assembly", by electoral rules. This may include minimum age required for voters and candidates, proportional or majoritarian or plurality system, and an electoral basis or collegium. Typically, the senate is referred to as the upper house and has a smaller membership than the lower house. In some federal states senates also exist at the subnational level. In the United States all states with the arguable exception of Nebraska (whose legislature is a unicameral body called the "Legislature" but whose members refer to themselves as "senators") have a state senate. There is also the national-level US Senate. In Australia all states other than Queensland have an upper house known as a legislative council. Several Canadian provinces also once had legislative councils, but these have all been abolished, the last being Quebec's Legislative Council, in 1968. In Germany, all States are now unicameral, with the last upper house (Bavaria) being abolished in 1999.

Senate membership can be determined either through elections or appointments. For example, elections are held every three years for half the membership of the Australian Senate, the term of a senator being six years. In contrast, members of the Canadian Senate are appointed by the Governor General upon the recommendation of the Prime Minister of Canada, holding the office until they resign, are removed, or retire at the mandatory age of 75. In larger countries, the senate often serves a balancing effect by giving a larger share of power to regions or groups which would otherwise be overwhelmed under strictly popular apportionment.

Alternative meanings[link]

The terms Senate and Senator, however, do not necessarily refer to a second chamber of a legislature:

• The Senate of Finland was, until 1919, the executive branch and the supreme court.
• In German politics: In the city state Bundesländer of Berlin, Bremen and Hamburg, the Senates (Senat in German) are the executive branch, with Senator (Senator) being the holders of ministerial portfolios.^[2] In a number of cities, such as Greifswald, Lübeck, Rostock, Stralsund, or Wismar, the city government is also called a Senate. However, in Bavaria, the Senate was a second legislative chamber until its abolition in 1999.
• In German jurisdiction: The term Senat (senate) in higher courts of appeal refers to the "bench" in its broader metonymy meaning, describing members of the judiciary collectively (usually five judges), often occupied with of a particular subject-matter jurisdiction. However, the judges are not called "senators". The German term Strafsenat in a German court translates to Bench of penal-law jurisdiction and Zivilsenat to Bench of private-law jurisdiction. The Federal Constitutional Court of Germany consists of two senates of eight judges each. In its case the division is mostly of an organizational nature, as a matter of dividing the work load; both senates handle the same kind of constitutional cases. At some points in the past, one senate was considered more conservative and the other more liberal, but that is not the case as of 2011.
• In Scotland, judges of the High Court of Justiciary are called Senators of the College of Justice.
• In some, mostly federal countries with a unicameral legislature, some of the legislators are elected differently from the others and are called Senators. In federal countries, such Senators represent the territories, while the other members represent the people at large (this device is used to allow a federal representation without having to establish a bicameral legislature); this is the case with St. Kitts and Nevis, Comoros and Micronesia. In other, non-federal countries, the use of the term Senator marks some other difference between such members and the rest of the legislators (such as the method of selection); this is the case with the States of Jersey, Dominica's House of Assembly and the Saint Vincent House of Assembly.
• In Wales, the National Assembly for Wales debating chamber is called the Senedd, pronounced 'Seneth'.
• A Senate can also be the ruling body of a university.

Sylvia Mathews Burwell (born 1965) is president of the Walmart Foundation and was previously the president of the Global Development Program of the Bill and Melinda Gates Foundation. While at the Bill and Melinda Gates Foundation her program focused on combating world poverty through agricultural development, financial services for the poor, and global libraries. She was Chief Operating Officer and Executive Director of the Foundation prior to its reorganization in 2006. She came to the Foundation in 2001, after serving as Deputy Director of the Office of Management and Budget in Washington, D.C., from 1998.

Born and raised in Hinton, West Virginia, into a Greek-American family[1] Mathews is the daughter of Dr. William Mathews, a retired optometrist and Hinton Mayor Cleo Mathews. She began her career while still in college, serving as an intern for West Virginia Congressman Nick Rahall, as governor's aide to Massachusetts Gov. Michael Dukakis, and working on the Dukakis/Bentsen and the Clinton/Gore campaigns. Ms. Mathews served as Deputy Chief of Staff to President Bill Clinton from 1997 to 1998, and was Chief of Staff to Treasury Secretary Robert Rubin from 1995 to 1997. She also served as Staff Director for the National Economic Council from 1993 to 1995. Prior to that, she was an Associate at McKinsey & Company from 1990 through 1992. She is a Member of the University of Washington Medicine Board, the Pacific Council on International Policy, the Aspen Strategy Group and the Nike Foundation Advisory Group.

In addition, Ms. Mathews is a Governing Council Member of the Miller Center of Public Affairs at the University of Virginia. Ms. Mathews received a bachelor’s degree in government, cum laude, from Harvard University in 1987 and a bachelor’s degree in philosophy, politics and economics from Oxford University, where she was a Rhodes Scholar. Ms. Mathews has been a Director of MetLife and Metropolitan Life Insurance Company since January 2004. She often returns to the Mountain State and to WVU to speak, and recently a scholarship was established in her honor to support aspiring WVU political science students. In 2005 Mathews was chosen by the Wall Street Journal as one of The 50 Women to Watch -- 2005 world wide.[2] She was mentioned as a possible candidate to replace Patty Stonesifer, who had announced plans to step down as CEO of the Gates Foundation in 2008. [3] However, on May 12, 2008, the foundation announced that Microsoft executive Jeff Raikes would assume the CEO position. Reportedly, Mathews and the foundation's other presidents approved of Raikes' appointment. [4] Mathews was named Obama-Biden Transition Agency Review Lead for the Federal Deposit Insurance Corporation. [5]

Rafael Edward Cruz, known as Ted Cruz (born December 22, 1970), is the former Solicitor General of the U.S. state of Texas, a position which he held from 2003 to May 2008. Cruz was appointed by Texas Attorney General Greg Abbott. He was the first Hispanic Solicitor General in Texas, the youngest Solicitor General in the United States, and had the longest tenure in the post thus far in Texas history. He is currently a partner at the law firm Morgan, Lewis & Bockius, where he leads the firm’s U.S. Supreme Court and national appellate litigation practice.^[3]

Cruz is a candidate for the 2012 Republican nomination for the United States Senate seat being vacated by Kay Bailey Hutchison.^[4]

Cruz previously served as the director of the Office of Policy Planning at the Federal Trade Commission, an Associate Deputy Attorney General at the United States Department of Justice, and as Domestic Policy Advisor to U.S. President George W. Bush on the 2000 Bush-Cheney campaign. In addition, from 2004-2009 Cruz was an Adjunct Professor of Law at the University of Texas School of Law in Austin, where he taught U.S. Supreme Court litigation.

Early life and education[link]

Cruz was born to a Cuban-American father and an American mother in Calgary, Alberta, Canada, where his parents were working in the petroleum business.^[1] His father was imprisoned and tortured in Cuba until he escaped to freedom in Texas in 1957.^[5]

Cruz attended high school at Faith West Academy in Katy, Texas,^[6] and then graduated from Second Baptist High School in Houston.

Cruz earned his Bachelor of Arts from Princeton University and his J.D., magna cum laude, from Harvard Law School in Cambridge, Massachusetts. While at Princeton, he competed for the American Whig-Cliosophic Society's Debate Panel as one of North America's top-ranked parliamentary debaters, winning the top speaker award at both the 1992 U.S. National Debating Championship and the 1992 North American Debating Championship.^[7] In 1992, he was named Speaker of the Year and Team of the Year (with his debate partner, David Panton) by the American Parliamentary Debate Association.^[7] Cruz was also a semi-finalist at the 1995 World Universities Debating Championship.^[8]

Cruz graduated magna cum laude from Harvard Law School. He was a primary editor of the Harvard Law Review, an executive editor of the Harvard Journal of Law & Public Policy, and a founding editor of the Harvard Latino Law Review.^[9]

Legal career[link]

Cruz also served as a law clerk to William Rehnquist, then-Chief Justice of the United States Supreme Court, and J. Michael Luttig of the United States Court of Appeals for the Fourth Circuit.^[10] Cruz was the first Hispanic ever to clerk for a Chief Justice of the United States.^[11]

Cruz has authored more than eighty briefs before the United States Supreme Court and presented forty-three oral arguments, including nine before the United States Supreme Court.

In the landmark case of District of Columbia v. Heller, Cruz assembled a coalition of thirty-one states in defense of the principle that the Second Amendment to the United States Constitution guarantees an individual right to keep and bear arms.^[12] Cruz also presented oral argument for the amici states in the companion case to Heller before the United States Court of Appeals for the District of Columbia Circuit.

In addition to his victory in Heller, Cruz has successfully defended the Ten Commandments monument on the Texas State Capitol grounds, the recitation of the Pledge of Allegiance in public schools and the 2003 Texas redistricting plan.^[13]

Cruz also successfully defended, in Medellin v. Texas, the State of Texas against an attempt by the International Court of Justice to re-open the criminal convictions of 51 murderers on death row throughout the United States.^[14]

2012 U.S. Senate election[link]

On January 19, 2011, following an announcement that U.S. Senator Hutchison would not seek reelection, Cruz announced via blogger conference call his candidacy for the position.^[4]

Cruz has been endorsed by David Barton, founder and president of WallBuilders,^[15] the Club for Growth, a conservative political action committee,^[16] Erick Erickson, editor of prominent conservative blog RedState,^[17] the FreedomWorks for America super PAC,^[18] Princeton University professor Robert P. George,^[19] nationally syndicated radio host Mark Levin,^[20] Former Attorney General Edwin Meese,^[21] Tea Party Express,^[22] Young Conservatives of Texas,^[23] U.S. Senators Jim DeMint,^[24] Mike Lee,^[25] Rand Paul,^[26] and Pat Toomey.^[27] He has also been endorsed by former Alaska Governor Sarah Palin, Texas Congressman Ron Paul,^[28] as well as former United States Senator from Pennsylvania Rick Santorum.^[29] Cruz faces opposition from sitting Lieutenant Governor David Dewhurst in the Republican senatorial primary.

Personal life[link]

Cruz was born and spent the first four years of his life in Calgary before his parents returned to Houston. His father was jailed and tortured by the Batista regime and fought for Fidel Castro in the Cuban Revolution ^[30] but "didn't know Castro was a Communist" and later became a staunch critic of Castro when "the rebel leader took control and began seizing private property and suppressing dissent".^[31] He moved to Austin, Texas, in 1957 to study at the University of Texas. He spoke no English and had $100 sewn into his underwear.^[32] The elder Cruz worked his way through school as a dishwasher making 50 cents an hour. Cruz’s mother, who was from Houston, was the first person in her family ever to go to college. She earned a math degree at Rice University in the 1950s, working summers at Foley’s and Shell. "I'm Cuban, Irish, and Italian, and yet somehow I ended up Southern Baptist."^[2]

Cruz and his wife, Heidi Suzanne Cruz, have two daughters, Caroline Camille and Catherine Christiane.
