New Delhi, October 09(ANI): A lower court in New Delhi on Thursday extended the police remand of Kobad Ghandy, a top Maoist leader till October 15 on the contention it would enable the investigating agency to gather more evidence. Vishal Gosain, advocate of Ghandy told reporters that he had opposed the extension of the remand, as the investigating agencies till now haven't submitted any charges of substance against him.

A USDA agency ruled on the most popular variety of Roundup Ready sugar beets. The agency said the genetically engineered sugar beets do not harm the environment or increase threats by pests. The Monsanto Company makes Roundup Ready crops. The genetic change in the sugar beets makes them resist the herbicide or weed killer known as Roundup. The action lets growers plant the genetically changed sugar beets if they obey certain rules. The USDA agency expects to finish its full environmental study of the sugar beets by May of next year. Then it will decide if it will permit unlimited planting of the crops. Sugar beets provide about half of America's sugar supply.The government agency had unconditionally approved the genetically engineered sugar beets in two thousand five. But after legal action, the United States District Court for the Northern District of California cancelled the agency's approval last year. The court said the Agriculture Department needed to perform a complete study of the environmental effects of the sugar beets. Jim Greenwood leads the Biotechnology Industry Organization. I take particular interest in this because I was the organizer of the original Thomas Jefferson Dance Party where Brooke Oberwetter aka the Jefferson 1, was arrested. We didn't intend for the event to be an act of civil disobedience, but just a fun and silent tribute to a man who's admired by many in the freedom movement. SHUBHA MURDER CASE
A division bench hearing the case of Shubha, who was sentenced to life imprisonment by a lower court for the murder of her fiancee BV Girish, pulled up the investigating officer for not seizing the mobile phones of the accused Dinesh and Venkatesh. The bench comprising Justice K Shreedhar Rao and Justice BV Pinto, pointed out that the investigating officer should have taken more care and by seizing the mobile phones of only Arun Verma and Shubha, had rendered the investigation incomplete. Counsel for the petitioner CV Nagesh, who related the eye witness account of a person, who had stopped to help her on the night of the murder, stated that Shubha made every effort to get medical help for injured Girish. She also lodged a complaint at the police station and signed as witness. He also produced the statement of Girish's father, who had stated that they knew Shubha for a long time and the marriage was arranged after taking the consent of Shubha and Girish. Shubha has filed an appeal in the High Court seeking bail. In her appeal, she has sought to quash the sentence. Shubha, her boyfriend Arun Verma, Dinesh alias Dinakar and Venkatesh, were held guilty by a City court on July 14, for the murder of BV Girish on Domlur-Koramangala Ring Road. The lower court had sentenced the four to life imprisonment and also slapped a fine of Rs 50000 on each of them. The money was to be handed over to Girish's family. The matter will be heard on Thursday.

Bob McDonnell marks the unfortunate one year anniversary of the passage of Democrats' unpopular health care bill and discusses the burdens it places on states. Gov. McDonnell says, "Unlike states, families, and businesses, the federal government doesn't have to balance its budget. And that unfortunate reality leads to policies like the federal health care bill that push expensive, unfunded, and unsustainable programs onto the rest of us. Washington passes the law, and then expects us to balance the books." He explains, "The law shifts billions in unfunded mandates onto state governments, and rigid new requirements restrict the governors' abilities to manage our state programs. The result: higher costs, less innovation and freedom. That's a prescription for serious problems at the state level, where much of this plan must be implemented. Most notably, the federal health care bill dramatically expands Medicaid, which was already growing at unsustainable rates." And, Gov. McDonnell adds, "The federal health care bill is not only a budget buster, it's also unconstitutional. Virginia, like the majority of states, is challenging this legislation in court. Already a federal District Court judge has ruled in our favor, concluding that the provision that a Virginia citizen must purchase insurance or face a penalty is unconstitutional.... Yahoo News says the US supreme court issued a 'landmark decision'. What are they trying to do? Make it sound like it's a GOOD thing to suspend the constitution? I saw this in the news recently and it made me think of another case, back in 2003, where an appeals court ruled in favor of a corporation in a lawsuit, declaring that the corporation, FOX News had, under the 1st ammendment, a right to lie in its news reports and could sue employees who refuse to lie. And now just a few years later, by denying the case of Mr Windsor and appeal, the US Supreme court has given carte blanche to lower courts who disrespect constitutional rights. Yesterday's video dealt with the groundbreaking US Supreme Court ruling that reaffirmed state and individual sovereignty. This was a reversal, not only of lower court rulings, but also of the direction and tone of the Federal Government going back a good while. The case itself (the individual) was not nearly as important as the fact that it ruled against legislated codes, calling them "null and void" when in opposition to Constitutional rights of states and the people. paul.house.gov http Last week I was both surprised and pleased when the Supreme Court upheld lower court decisions requiring the Federal Reserve Bank to comply with requests for information made by Bloomberg under the Freedom of Information Act ("FOIA"). Bloomberg simply wanted to know who received loans from the Fed's discount window in the aftermath of the 2008 financial market crisis, and how much each entity received. Surely this is basic information that should be available to every American taxpayer. But the Fed fought tooth and nail all the way to the Supreme Court to preserve their privileged secrecy. However, transparency and openness won the day. There are some 29000 pages to decipher, but a few points stand out initially. The Fed lent huge sums of our money to foreign banks. This in itself was not surprising, but the actual amount is staggering! In one week at the height of the crisis, about 70% of the money doled out went to foreign banks. We were told that bailing out banks was going to stave off a massive depression. Depression for whom? We now know that the Fed's bailout had nothing to do with helping the American people, who have gotten their depression anyway with continued job losses and foreclosures. But now we learn that a good deal of the money did not even help American banks! In light of recent world events, perhaps the most staggering revelation is that quite a bit of money went to the Arab Banking Corp., in which the Libyan Central Bank owned <b>...</b>

This video is a little sad and a little confronting. You'll see evidence of cases where juries don't get told all the facts, and people are getting away with horrible crimes. We have judges who are known to be duds, and juries are just expected to be happy with it all. If it is true, and relates to the case, juries should hear it. If you want truth to be a focus of courts, take a stand and turn up for jury duty with this letter. If you are "disengaged" you simply can't perform jury duty. "Thanks for the opportunity of performing jury duty, but having done my research, I must say I am disinterested. The accused is entitled to a fair trial, and a fair trial is not a disengaged juror. A fair trial for the accused shouldn't mean an unfair trial for the victim. I now know judges are not accountable and juries don't hear all the evidence. Without all the facts, my mind is closed. I know that police, the DPP and lower court magistrates have heard all the evidence and believe there is a case to answer. I would hate to have to fall back on their judgement. However, should judges become more accountable and there be a search for the truth, I would be more than happy to become involved in the future. The International Law Section Public International and Criminal Law Committee Litigation Section of the DC Bar in cooperation with the American Society of International Law presented a luncheon program. The US Supreme Court's 2008 decisions in Medellin v. Texas and the consolidated cases Boumediene v. Bush will have an extraordinarily significant impact on the rights of criminal defendants in the United States and detainees at the US Naval Base at Guantanamo Bay. At this program, which followed the release of the Court's final decisions of the current Term, counsel for several of the parties, including the United States, together with expert international law scholars and practitioners, discussed and debated the merits and potential ramifications of the rulings in these two key cases. The distinguished panel provided insights on the consequences of the Court's rulings on immediately affected parties, as well as predictions of the rulings longer term impact on, among other things, future US treaty and diplomatic relations, the status of international tribunal decisions as US law, and the interpretation and application of the Military Commissions Act of 2006 by the lower courts.

A lower court is a court from which an appeal may be taken. In relation to an appeal from one court to another, the lower court is the court whose decision is being reviewed, which may be the original trial court or an appellate court lower in rank than the superior court which is hearing the appeal.
In an absolute sense, a lower court is always the trial court; where an appellate court is describing the actions under review from the lower court, it is referring to the court that examined the evidence and testimony directly and made rulings upon it, rather than any intermediate appellate courts. However, a court that functions as a trial court in some instances may still be above another court. Relative to other trial courts, a lower court is a court of limited jurisdiction, especially one that is limited to hearing minor offenses, or civil actions involving a limited amount, as distinct from a superior court.
In the United States, most states have two levels of trial courts, and two levels of appellate courts. The jurisdiction of the lower trial court in such jurisdictions is typically restricted to hearing minor claims and trying minor offenses, while the higher court may hear claims without an upper limit on the amount in controversy, and may try all crimes. The higher trial court may also have some power of appellate review over the lower. In Virginia, for example, the lowest level of court is the Virginia General District Court, which can hear claims of up to US$15,000, and can try misdemeanors. Above that court is a second level of trial courts, the Virginia Circuit Court, which may hear claims in excess of US$5,000 and may try certain types of felony cases. The General District Courts do not have jury trials at all, but appeals may be taken from a General District Court to the Circuit Court of that jurisdiction, and the appellant may receive a new trial with a jury.
