What Happens if Judge in NY Gives Wrong Legal Instructions at End of Case to Jury?

At the end of a trial involving medical malpractice, an accident or wrongful death here in New York, the judge must give the jury instructions on the law.
What happens if the judge gives the jury wrong instructions?
Before closing arguments are given, the judge has a conference with the attorneys in his chambers. This is known as a "charge conference."
What happens is the judge makes decisions about which sections of the law he is going to instruct the jury on. This gives the attorneys an opportunity to request specific instructions as well as object to certain instructions that the judge intends on giving.
There is a very important reason for this conference.
If the losing side appeals, and it turns out that one of the instructions given was incorrect, the appeals court has a number of options on what to do because of the error.
There are instances where a judge will make a mistake and the appellate court will deem that to be "harmless error." That means they will acknowledge that a mistake has been made, but conclude that it had no difference on the outcome.
On the other hand, there are instances where a judge will give an instruction to the jury and an appellate court may determine that was inappropriate in light of specific facts. In that instance, the court can throw out the verdict and direct a new trial to be held among other alternatives.

The Judge
Hickok45 plays and experiments with the popular Taurus Judge revolver. It's a lengthy shooting session with a variety of ammunition types and target distances. I demonstrate patterns and penetration at various distances. Nothing scientific, as usual, but maybe enough to give 410 gauge revolver owners and potential buyers a rough ideas of what to expect.
At various distances I shoot birdshot, 6 shot, 4shot, 00 Buck, 000Buck, and the exotic Winchester PDX defense shells.
I don't really have a big dog in the fight over whether these are great defensive guns or not, or whether the 410 is useless in this regard. I do know I would not want one shot at me after having experimented with it. It might not kill me, but it certainly would make me change my mind about further action and probably consider where I'd be finding a "see-and-eye" dog for the rest of my life. :-)

Judge Andrew Napolitano joined Megyn Kelly on America Live this afternoon to discuss the recent revelation by former White House press secretary Robert Gibbs that he was told to never admit to the existence of the CIA drone program.
"When I went through the process of becoming press secretary, one of the first things they told me was, you're not even to acknowledge the drone program. You're not even to discuss that it exists," Gibbs said Sunday on MSNBC.
That admission has raised questions again over the use of the top-secret strikes against terror suspects abroad.
Kelly asked the judge just how transparent the government is supposed to be when it comes to targeting terror suspects and potentially revealing secrets "that could get troops killed or Americans killed."
Napolitano responded by saying we "shouldn't be in the business of killing."
Kelly then emphasized that she only meant killing terrorists.
"He shouldn't be in the business killing people in friendly territories," said Napolitano. "These are people that could easily be arrested or people who could be taken care of by the government of the country in which they're located. But when the president thinks he can willy-nilly use drones however, whenever, and against whomever he wishes and then lie about it, we have a problem."

Judge Napolitano: Obama Administration Doesn't Understand Economics 101
Judge Napolitano argues that the government makes an economic mistake when it raises taxes too high "because people that are able to control their income will defer it or receive the income in other ways, end up earning less and paying the government less."

Judge Napolitano: Will States' Nullification Of Federal Gun Control Laws Hold Up In Court?
This afternoon on America Live, Judge Andrew Napolitano weighed in on the push by nine states to pass laws to block the federal government from restricting gun ownership. State lawmakers are anticipating some sort of gun control legislation to be passed at the federal level, possibly an assault weapons ban. The proposals argue that guns made and kept within a state's borders should not be federally regulated.

"There's a lot of momentum," Montana activist Gary Marbut told FoxNews.com on Monday.
Marbut was behind the original Firearms Freedom Act, which says the Commerce Clause allowing Congress to regulate inter-state commerce does not apply to the in-state manufacturing, selling and ownership of firearms. Montana passed the bill in 2009.
Since then, a host of other states have tried to pass copycat legislation. Alabama, Georgia, Indiana, Michigan, Mississippi, Nebraska, Oklahoma, Pennsylvania and Washington have proposed such legislation since January — following the Dec. 14, 2012, shooting in which 20 first-graders and six adults were killed inside a Newtown, Conn., elementary school.
However, Montana's legislation is hardly settled law. Shortly after the law passed in his state, the federal Bureau of Alcohol, Tobacco, Firearms and Explosives wrote Marbut to say federal law still supersedes.
Marbut acknowledges he wrote the legislation to set up a legal challenge and "roll back a half a century of bad precedent."
The bill is scheduled to finally get its day in court when the Ninth Circuit begins oral arguments March 4. Marbut expects to lose in the liberal-leaning court, which includes San Francisco, Seattle and Portland, Ore. But he thinks such a decision will put him in a better position to appeal to the country's highest court.
"The mood of the country is right for the Supreme Court to consider what I think is a great mistake," said Marbut.
Megyn Kelly asked Judge Napolitano about the chances for this type of law to survive a challenge by the federal government. He said "as much as he loves" the proposals, he does not see how they will stand up against 60 years of precedent that has expanded Congress' power to regulate interstate commerce.
The judge argued the Constitution's interstate commerce clause has now been "so blown out of proportion ... that Congress can regulate almost anything it wants."

In 1996 I dated Tawnya for a period of a few months and for convenient reasons that we both needed a fast place to live we decided to co-habitat since we were dating already. We had separate bedrooms as well but continued to date. We were not compatable with each other and I had just signed a 6 month lease that I felt she should be obligated to fulfill but she did not fulfill it. As collateral I took her nice watch and we didn't talk for about two years. I gave the watch to my mother for safe keeping in case you came to the apartment to look for it. My grandfather died in 1998 and I was emotional and wanted to do the right thing and give her the watch. I wrote her a letter and agreed to meet to give her the watch. Unfortunately when I went to get the watch from my mother she told me she broke it by vacuuming over it awhile back. So now my ex thought I was just antagonizing her and never had intentions to give the watch back so she sued me two years after we broke up. The producers called us in 1998 and we both agreed to settle via arbitration in Judge Judy. I received compensation for the appearance, for controversial comments I made (deleted scenes) and they paid my guilty judgement. I am still a facebook friend with Tawnya and I wish her the best but we rarely have communication. Immediately after the show she called me and came over and we "sparked" another few months of relations but that soon ended as well. Immature times but it's part of my past..

Shep Smith And Judge Napolitano Eviscerate Obama's 'Reprehensible' Drone Strike Policy
Less than 24 hours after Senator Rand Paul's filibuster of John Brennan's appointment to the CIA over to White House's policy on droning American citizens, Judge Napolitano and Fox News anchor Shepard Smith railed against the controversial policy saying that even the discussion of its legality was "the craziest thing in the world."
Shortly after speaking with a Fox News reporter on Capitol Hill, Smith brought Napolitano, a Fox News libertarian contributor, onto his show to get his take on the president's drone policy. Napolitano explained to Smith that this fight began when the Bob Mueller, the head of the FBI couldn't explain if an American could be killed by a drone on American soil. Mueller said that they should "ask the White House" according to Napolitano.
Napolitano proceeded to walk Smith through the mixed messages administration officials provided on the question of whether or not the president has the authority to kill Americans on American soil without trial, specifically with a drone.
"There's many a slip between the cup and the lip," the judge said explaining the confusing response on this.
Smith suggested that all the confusion on what the actual official drone policy is has created a ripe breeding ground for conspiracy theorists to charge the administration with all kinds of things. He then went on to trash the growing surveillance culture in America.
"It's bad enough that they're putting the things up watching us. It's bad enough they have cameras on every corner, and stopping us, you know, if your car runs a redlight. Now all we're sure of is if I'm engaged in combat -- unless I am -- they can't kill me while I am sitting at the cafe down the street. I'm not sure they can't look in my window," Smith said.
The judge then explained the case of Anwar al-Awlaki and his 16 year-old that were both American citizens and killed by drones without any trial. Smith expressed outrage over an incident where former Obama press secretary Robert Gibbs was pressed on this at the 2012 presidential debates he said that al-Awlaki should have had a more responsible father.
"It's reprehensible," said Napolitano.
Now you understand why this question came about. If a government thinks it can do this and speak glibly about it and they can do it because he was in Yemen, can they do it he is in Greenwich Village.
Smith noted it's a slippery slope and said "If we have to ask this question even then we've gone so far beyond what that document has to say then we really need some mirror work."
