Impeachment

Impeachment is a formal process in which an official is accused of unlawful activity, the outcome of which, depending on the country, may include the removal of that official from office as well as criminal or civil punishment.

Etymology and history

The word "impeachment" derives from Latin roots expressing the idea of becoming caught or entrapped, and has analogues in the modern French verb empêcher (to prevent) and the modern English impede. Medieval popular etymology also associated it (wrongly) with derivations from the Latin impetere (to attack). (In its more frequent and more technical usage, impeachment of a witness means challenging the honesty or credibility of that person.)

The impeachment process should not be confused with a recall election, which is usually initiated by voters and can be based on "political charges", for example mismanagement. Impeachment is initiated by a constitutional body (usually legislative) and usually—but not always—stems from an indictable offense. The steps that remove the official from office are also different.

Impeachment (Norway)

In Norway, impeachment, also known as the Constitutional Court of the Realm (Norwegian: Riksrett), is a judicial process with the power to convict Members of Parliament, Members of the Council of State and Supreme Court Justices for criminal acts performed in line of duty. Impeachment is based on the Constitution of Norway §§ 86 and 87. Parliament authorizes the impeachment process, which establishes a tribunal consisting of five members of the Supreme Court and six lay members appointed by the Parliament of Norway. Impeachment has been used eight times, the last case being held in 1927.

History

Impeachment has been performed eight times in the history of the kingdom, and each time it has been aimed at members of the government. Six of the cases were in the period 1814–45. During the constitutional struggle in the last half of the 19th century impeachment became vital following the case against Selmer's Cabinet in 1883 and 1884, concerning the veto rights of the King in matters of the constitution. Prior to this case, impeachment was the only way for parliament to dismiss a member of the cabinet; after 1884 Norway got a system of parliamentarism, and parliament could dismiss a member of cabinet through a majority vote.

Impeachment in the United States

Impeachment in the United States is an expressed power of the legislature that allows for formal charges against a civil officer of government for crimes committed in office. The actual trial on those charges, and subsequent removal of an official on conviction on those charges, is separate from the act of impeachment itself. Impeachment proceedings have been initiated against the President of the United States on several occasions. Andrew Johnson and Bill Clinton are the only two presidents to have been successfully impeached by the House of Representatives, though both were later acquitted by the Senate. The impeachment process of Richard Nixon was technically unsuccessful, as Nixon resigned from office prior to the full-House vote for impeachment. To date, no U.S. President has been removed from office via impeachment and conviction.

Impeachment is analogous to indictment in regular court proceedings, while trial by the other house is analogous to the trial before judge and jury in regular courts. Typically, the lower house of the legislature will impeach the official and the upper house will conduct the trial.
