RESİDENTS OF SHAMKİR REGİON CLAİM TO BE DEFRAUDED BY LOCAL OFFİCİALS
On Monday a group of residents of Shamkir region held press conference in the media center of Institute for Reporters Freedom and Safety, where they spoke about violation of their property rights.
Villagers complain that they are not compensated for their lands and other property taken from them in connection with the construction of Shamkir water reservoir.
Forty five of 53 landowners appealed to the Professional Lawyers public association. The head of the NGO, Tagi Huseynov, said that the process of alienation of their lands was conducted in violation of the law.
As such, formal notice with terms of redemption of property and land expropriation was not sent to citizens. In February 2009, the regional executive committee was formed to assess the property, but the people learned about repurchase of their land only in March and April, when construction began. Provision of compensation began only in summer 2010, with the rate of 50 AZN per 0.1 hectare, while, under the law, citizens should be provided with compensation in accordance with market prices, and an additional 10% surcharge.
Jeyhun Mamedov, resident of Seyfali village, said that for over 0.19 hectares, he received a total of 1,385 AZN, while he used to harvest 10.9 tons of potatoes and onions from this plot.
Other citizens also complained of unfair compensation.
Lawyer Huseynov said that the Professional Lawyers NGO will assist the defrauded landowners to bring a class action lawsuit against the Irrigation and Water Management JSC, which is in charge of building the water reservoir, with the demand for fair compensation.
Local residents believe that the state had allocated sufficient funds, but the money was misappropriated. In connection with this, the residents sent an appeal to President Ilham Aliyev to restore justice.
Being asked to comment on the allegations, a representative of the Irrigation and Water Management JSC, said the expropriation was carried out on the basis of the former law and the amount of compensation had been agreed and the money was transferred to the accounts noted by the owners. Amendments were subsequently made to the law, but the law is not retroactive, said the representative of the company, who wished to remain anonymous.
