Mumbai formerly known as Bombay in English, is the capital of the Indian state of Maharashtra. It is the most populous city in India, and the fourth most populous city in the world, with a total metropolitan area population of approximately 20.5 million. Along with the neighbouring urban areas, including the cities of Navi Mumbai and Thane, it is one of the most populous urban regions in the world. Mumbai lies on the west coast of India and has a deep natural harbour. In 2009, Mumbai was named an Alpha world city. Mumbai is also the richest city in India, and has the highest GDP of any city in South, West or Central Asia.
The seven islands that came to constitute Mumbai were home to communities of fishing colonies. For centuries, the islands were under the control of successive indigenous empires before being ceded to the Portuguese and subsequently to the British East India Company. During the mid-18th century, Mumbai was reshaped by the Hornby Vellard project, which undertook the reclamation of the area between the seven constituent islands from the sea. Completed by 1845, the project along with construction of major roads and railways transformed Bombay into a major seaport on the Arabian Sea. Economic and educational development characterised the city during the 19th century. It became a strong base for the Indian independence movement during the early 20th century. When India became independent in 1947, the city was incorporated into Bombay State. In 1960, following the Samyukta Maharashtra movement, a new state of Maharashtra was created with Bombay as capital. The city was renamed Mumbai in 1996.

Salman Khan Asked To Approach High Court For Appeal Against Culpable Homicide
A Mumbai Sessions court today adjourned hearing over actor Salman Khan's plea, which challenges a lower court's order of invoking the charge of culpable homicide not amounting to murder against him in the 2002 hit-and-run case.
The sessions court deliberated whether it had the jurisdiction to examine the matter. "The matter is interlocutory in nature and therefore you should approach the Bombay High court as I don't have the jurisdiction to hear the same," the judge observed before adjourning the hearing.
The court will now decide on the matter on Friday, March 8. In his petition yesterday, the actor had said that the lower court's order was "bad in law" and "erroneous".

Let me die, sex change applicant tells Bombay high court
Tired of the long wait for a sex change operation, continuous interference from parents and depleting finances, 21-year-old Bidhan Barua has asked for immediate relief from court. A restraining order against his parents or a nod for suicide is what he wants.

Student's fight for sex change in Bombay High Court
A college student from Guwahati has taken his parents to court alleging that they are trying to prevent him from a sex-change operation. His father says the surgery cannot be treated as "a personal decision" and that the 21-year-old must get the consent of his entire family, including his grand-parents and his uncles. "I gave birth to a son, not a eunuch," said his father to NDTV.

"Bombay High Court direction to govt to decide policy on foreign law firms is misplaced."
Lalit Bhasin, the President of the Society of Indian Law Firms said that best-friend relationships are not wrong as long as they are simple referral arrangements. He also said that the observation of the Bombay High Court in the Lawyers Collective judgment that the government should decide on its policy on foreign lawyers is not a direction. Jyoti Sagar, the founding partner of J. Sagar Associates said that the observation was completely misplaced because the process of opening up a sector was subject to GATS negotiations.
Lalit Bhasin and Jyoti Sagar were part of a panel that discussed the implications of the judgment of the Bombay High Court at the 6th Annual Asian ITECHLAW Conference, held at Hotel Taj West End in Bangalore on the 4th and 5th of February, 2010. The discussion which was moderated by Nikhil Chandra from Rainmaker, also featured Shweta Bharti from Hammurabi & Solomon.
"I believe that you cannot do directly what you can never do indirectly. You may call them mutual best friend relationships, or any surrogate law practice which is also being resorted to, or has been resorted to in the immediate past. That is not permissible, but I am not against any referral arrangements which may exist. Referral arrangements have been there for so many decades. If we need certain inputs for our clients pertaining to US law, European law, Swiss law or Japanese law, we always consult our counterparts in those jurisdictions and like wise they also do that. So this is a sort of a informal referral arrangement based on the specialisations of the law firms - if it is a tax issue we will consult some law firm and if it is some issue pertaining to capital markets we will consult another law firm if our clients in India want to go for some IPOs outside."
"There is nothing wrong in having referrals arrangements, but for these best-friend relationships I dont know what the terms and conditions are. If these are pure and simple referral arrangements on an exclusive basis, there is nothing wrong." He added however that it would not be so if there were any financial arrangement or any financial implications. "I have been assured by very eminent law firms in India who have such relationships that there is nothing more than what meets the eye, and that the transactions are simple referral arrangements, so there is nothing wrong."
"If some lawyers from the US or the UK come to India with a view to advice their clients with regards to some implications or with a view to advice some Indian clients which they have, there is nothing wrong in it. We also accompany our clients if they are negotiating with any US business organisation or UK business organisation. We go with them, we advice our clients but that is not law practice. Practice means a law practice which is consistently systematically taken in a particular jurisdiction."
He also added that the observation of the Bombay High Court that the government should decide on its policy on the foreign lawyers is not a direction. It is only an observation and it is per incuriam. "As a matter of fact and law, the High Court is wrong in making this observation. In any case the government cannot, despite the observation of the High Court, evolve any policy which is contrary to law."
"Whether or nat there should be an amendment to the law is for our Parliament to decide and not for the government to decide. The Bar Council of India is a statutory body and the government has no supervisory role over the Bar Council of India. Therefore, the final decision will be of the Bar Council of India and the Indian Government cannot prevail over the Bar Council of India that you better toe our line."
Mr Jyoti Sagar added that the one point which is completely missed related to the the WTO and the General Agreement on Trade and Services. He said that GATS negotiations have been pending for a very long time and the entire regime of opening up a service is subject to GATS agreement. "The process there is quite simple, the process says that a country will actually schedule the industries in which it wants to negotiate on services and then you make offers and you make requests to other countries and that is how the multilateral negotiations proceed. Now, the interesting thing is the legal services are not even listed. For the Bombay High Court to be telling the Indian government to do something about it is actually completely misplaced in a way.

Bombay High Court marks 150 years in judicial service
Prime Minister Dr Manmohan Singh will be the chief guest at the closing ceremony of the sesquicentennial celebrations of the Bombay High Court on Saturday.
To mark 150 years of judicial service, the function at the National Centre of Performing Arts will be attended by the Chief Justice of India, Justice Sarosh Kapadia, Chief Ministers of Maharashtra and Goa, Prithviraj Chavan and Manohar Parikkar respectively, Governor of Maharashtra K Sankaranarayanan and other dignitaries. Ahead of the concluding ceremony, a special postal cover and stamps were released on Tuesday.

After the outrage that poured in over the arrest of Aseem Trivedi, the Maharashtra government is trying to soothe frayed tempers by diluting the charges against the cartoonist. Bombay High Court has granted bail to Aseem Trivedi. Maharashtra Home Minister R R Patil said the decision on withdrawing charges against cartoonist Aseem Trivedi would be taken after the investigation was over. Patil said that he had asked Mumbai police commissioner to find out what action could be taken against the cartoonist, who was arrested for allegedly objectionable cartoons of the national emblem and the Parliament. "Action will be taken in accordance with the existing laws. There will be no discrimination," he said.
