LSE Research: The Moral Structure of Legal Systems, pt. 1
After the fall of the Nazis, the connections between law (which calibrates obedience against rule-adherence) and morality (which calibrates obedience against a normative good) acquired a renewed importance: the Nazis claimed to be operating under a legal system that differed in content but not in kind.
Some legal theorists agreed: the systemic integrity of a legal code said nothing about its content -- the law was simply whatever was posited by lawgivers. They were known as "positivists" for this reason. Meanwhile, those who took the so-called "natural law" position insisted that morality was not separable from the law in this fashion.
It was into this climate that the debate between positivist H L A Hart and natural lawyer Lon Fuller emerged. More than a half-century later, Dr Rundle explains why their debate has never really gone away.

The judicial branch comprises the courts and the judges who preside over them. The roles of courts broadly cover dispute resolution and the interpretation, development and application of the law. In order for a court to have validity it must have the jurisdiction or authority to hear and determine a matter. Most courts operate on an adversarial basis and are independent from the other branches of government. Juries ensure citizen involvement and are seen as a cornerstone of the legal system, although recent reforms have attempted to balance justice with greater efficiency.

Part II of The Moral Structure of Legal Systems concerns a peculiar correlation: tyrannical regimes nearly always possess chaotic legal systems. Dr Kristen Rundle asks: Why?
One of the characteristic features of tyrannical regimes is their chaotic legal system. For Dr Rundle, this isn't just a case of poor legal housekeeping. The systemic disorder typically exhibited by the legal systems of despotic and transitional states occurs precisely because tyrants require forms of power that are incompatible with law.
Chaos works in the tyrant's favour. Impose a legal code that is transparent, consistent, and which does not permit retroactivity -- impose, in other words, a legal system recognisably distinct from arbitrary commands -- and the tyrant finds his urge to wield absolute power has been tied up.
Hence the so-called "rule-of-law" is the idea that we owe our obedience to the law, not the lawgiver. Such a system doesn't prescribe perfect justice, of course. But it does, crucially, impose constraints on the ambitions of the would-be tyrannical dictator.

If you are a student of law at whatever level, Slapper & Kellys new edition of The English Legal System is an essential work of reference, which can only make your studies easier.
The Tenth Edition in 15 chapters and about 650 pages, the authors create a clear and accessible work aimed at imparting a good understanding of the law, its institutions and processes. They point out what many of us only dimly realize, that our law permeates into every cell of social life, governing everything from food and drink and the air we breathe, to travel, family relationships, sexuality and virtually everything else: science, employment, business, education, health and of course, conflicts, from neighbour disputes to wars. The list is by no means exhaustive as students will well know.
Since the first edition we reviewed in 1994, The English Legal System has successfully cut through the complexities of the subject, setting the law and system in a social context. Each new edition published since then has been thoroughly updated to take into account new developments within the English legal system of common law reasoning.
The 2009-2010 title incorporates material on important changes to: the criminal justice system; statutory interpretation; judges; changes in the legal professions, and in the funding of legal services. The new courts are described very well here, and the rules of civil procedure with revised chapters on criminal procedure underpin recent reforms to our system.
Also incorporated are proposals for changes to human rights law, and major common law decisions from 2008 in the Court of Appeal, the House of Lords and from the European Court of Human Rights. Of particular relevance at present is the chapter on arbitration, tribunal adjudication and alternative dispute resolution so popular with the current senior judiciary.
Much thought has gone into creating a structure for the book that makes it convenient to refer to and easy to use one of the most easily accessible legal texts we have yet encountered.
