Wilma Ricker, IG Metall: "Also wir stellen fest bei fast allen Abrechnungen, die wir überprüfen, dass einsatzfreie Zeiten mit dem Zeitkonto verrechnet werden. Das ist eindeutig gesetzeswidrig, weil es eindeutig im Arbeitnehmer-Überlassungsgesetz anders steht." Gesetzeswidrig? Ein schwerer Vorwurf. Randstad bestreitet das. Man habe eine Vereinbarung mit dem Gesamtbetriebsrat. Gegenüber den Mitarbeitern verweist man außerdem auf den Arbeitsvertrag. MONITOR liegen solche Arbeitsverträge vor. In § 3 heißt es dort jeweils: Zitat: "Der Ausgleich von Zeitkonto-Plusstunden erfolgt in einsatzfreien Zeiten durch Freizeit; sofern keine Plusstunden vorliegen, bauen sich Minusstunden auf." Das sei auch vom Tarifvertrag gedeckt, sagt Randstad. Wir zeigen den Vertrag Prof. Schüren, Direktor des Instituts für Arbeitsrecht der Uni Münster. Für ihn ist die Klausel ein Trick, um das Betriebsrisiko abzuwälzen, weg von Randstad auf die Leiharbeiter. Prof. Peter Schüren, Uni Münster: "Randstad muss die Zeiten zwischen einzelnen Arbeitseinsätzen ebenfalls bezahlen. Und mit diesem Konto wird genau das vermieden. Man gibt den Leuten das, was sie bereits vorher verdient haben und deklariert das als Arbeitseinkommen der Zwischenzeit. Das ist nicht in Ordnung, das ist mit dem Gesetz so nicht vereinbar und steht auch im Tarifvertrag nicht drin. Das hat Randstad sich in einer Betriebsvereinbarung und im Arbeitsvertrag selbst gebastelt." Quelle: WDR
