Which specific prostitution offense prosecutors have charged you with will determine what facts (otherwise known as "elements of the crime") the prosecution must prove. Engaging in an act of prostitution In order to convict you of engaging in an act of prostitution, the prosecutor must prove that you 1.engaged in an act of prostitution, and 2.that you did so willfully. "Prostitution" means engaging in sexual intercourse or any lewd act with another person in exchange for money or other consideration. A "lewd" act is defined as any act that involves touching the genitals, buttocks, or female breast of either person by another person that is done with the specific intent to arouse or gratify sexually. "Willfully" means deliberately or on purpose. It does not require an intent to break the law. Soliciting prostitution In order to convict you of soliciting prostitution, the prosecutor must prove that you 1.solicited another person to engage in an act of prostitution, and 2.that you did so with the specific intent of engaging in an act of prostitution. Depending on the nature of the exchange...and on who initiated the interaction...prosecutors could charge this offense against the prostitute or the customer. Review to integrate Islamic laws into existing civil legislation Friday, October 14, 2011 BRUNEI Darussalam will soon see the creation of a unique hybrid legal system where Islamic laws are integrated into existing civil legislation, making them Syariah-compliant. All existing legislation in Brunei will be reviewed to ensure they are Syariah-compliant and amendments will be made to any sections that contradict Islamic law, said the Head of the Research and Law Review Division at the Attorney General's Chambers yesterday. "Instead of having a separate Act or set of laws to apply to Muslims, Syariah laws will be integrated into the existing Penal Code and other offences that are punishable under Hudud," said Senior Counsel Zuraini Hj Sharbawi. Hudud crimes are offences where punishment has been set by Allah (SWT). Hudud laws cover six areas: theft, illicit sexual relations, making unproven accusations of illicit sex, drinking intoxicants, apostasy and robbery. Zuraini explained that the reforms committee will be creating a new hybrid system that has not been seen anywhere in the world. "It would be unique and very special to Brunei... We're not using a model from another country this is His Majesty's vision." However, there are crimes which are not punishable under Hudud. These offences, called Takzir, will still be dealt with through the civil courts. California law defines burglary under Penal Code 459 PC as "entering a structure with the intent to commit a felony (or a petty theft) once inside".1 Although burglary is often referred to as "breaking and entering," prosecutors can charge you with this offense even if there is no forced entry of the structure. Penal Code 459 deleted the "breaking" language...as well as the requirement that the offense be committed during "nighttime" hours...in the late 1800s.2 All that is currently required is that you enter a building (or other specified enclosure) with the intent to commit a theft or felony once inside. Burglary is a "wobbler" which means that, depending on (1) the circumstances of the case, and (2) your criminal history, it may be charged as a misdemeanor or a felony.3 If you are convicted of burglary as a felony, you face up to six years in the California State Prison. Although the penalties for burglary are harsh, it's often possible to get the charges reduced or dismissed. Because of legal technicalities and difficulties of proof, prosecutors frequently agree to settle cases for lesser charges. And burglary cases that go to jury trial, with an effective defense, can result in a "not guilty" verdict.

Carrying a concealed weapon is now a separate offense, punishable under California Penal Code 12025 PC. PC 12021 is commonly referred to as California's "felon with a firearm" law. But it's actually a much more comprehensive California gun law. The prohibition on firearms extends to a variety of people and applies to a variety of prior convictions, even to some misdemeanors. California Penal Code 12021 PC creates a prohibition on gun possession for three classes of individuals: 1.people who have been convicted of a felony offense, regardless of where the conviction took place, 2.people who have been convicted of specific misdemeanors, and 3.people who are addicted to any narcotic drug. If you are "addicted" to a narcotic drug, it means that you are both emotionally and physically dependent on the drug and have an increased tolerance to its effects. A "felon" is anyone who has been convicted of a felony offense in any state, under United States federal law, or by any other government or country. In order for the prosecutor to convict you of violating California's "felon with a firearm" law, he/she must prove that you 1.fall into one of the above categories, 2.owned, purchased, received, or possessed a gun, and 3.knew of the presence of the gun.

Penal Code 186.22 PC is part of the California Street Terrorism Enforcement and Prevention Act, more commonly referred to as California's street gang enhancement law. In its simplest terms, this law states that anyone who commits a felony for the benefit of a gang will receive a mandatory prison sentence in addition and consecutive to the penalty he/she receives for the underlying felony. And...depending on the circumstances of the offense...this could mean an additional 5, 10, 15, or even 25-years-to-life in prison...even if you're not a gang member and even if you aren't the individual who is actively and directly responsible for committing the underlying felony.
