Fijian soldier ordered to leave UK 23.07.12

A Fijian who served in the British Army for 13 years has been told he cannot settle in the UK and must leave the country by 9 August. Lance Corporal Isimeli Baleiwai, who is married to a British woman and has two British children, applied for British citizenship in March this year as he was leaving the Army in June. Foreign and Commonwealth soldiers can apply for Indefinite Leave to Remain after four years service and citizenship after five years service. But the UK Borders Agency rejected his application as the 32-year-old had faced disciplinary action for fighting with a colleague in 2010. LCpl Baleiwai was assessed to have a criminal record as a result of the ten-minute military hearing, even though he did not ask for legal advice, did not see the evidence and was not aware that five of his colleagues were prepared to testify that he had acted in self-defence. The former soldier has served five operational tours, including to Afghanistan and Iraq, and was able to provide a character testimony from his CO who described him as 'a natural leader, trusted and thought very highly of' but refusal was automatic due to his disciplinary history. LCpl Baleiwai and his family are fighting the decision with the help of the charity Veteran's Aid.

The Brazilian, however, would not back down, claiming an 8.60 to put himself back in the hunt. Cloudbreak greeted The Volcom Fiji Pro with some excellent waves this morning and the second day of competition was on. The slightly smaller swell lined up perfectly on the reef providing wide open barrels and some high scores right off the bat. The day started off with Kelly Slater matched up against local Fijian wildcard Isei Tokovou. Tokovou slid into one of the biggest tubes of the day but was unable to exit and Slater got the nod into round three with a 15.90 heat total. Julian Wilson posted the event's highest heat total with two amazing 9 point plus rides against Patrick Gudauskas in the first ten minutes of heat number four. "The conditions are pretty perfect today, Wilson commented, "I had a tough time out there in my heat yesterday so I really wanted to get this heat going today. It felt good to get that first wave at the start and I was glad that I could back it up with another one." There had been plenty of swell activity around the island in the days leading up to the event and after last night's traditional Fijian opening ceremony, there was an energy of excitement in the air between the surfers and event directors expecting a day one start. The morning started off with Jordy Smith getting the opening wave of the Volcom Fiji Pro scoring a 4.67 and then backed it up with massive 9 point tube ride on his second wave. Smith would eventually win the heat advancing to round 3, sending Fred Pattachia and Brett Simpson to round 2. Today's biggest story was wildcard Mitch Coleborn upsetting 11 time world champion Kelly Slater with the highest heat total of round 1. Mitch paddled into one of the best tubes of the day halfway through the heat earning a 9.27 wave score. Afterwards, the ocean went quiet for several minutes leaving Coleborn in need of a mid range score. As the timer counted down towards the end of the heat, it looked as though Mitch would not get another scoring opportunity. Then, with only 7 seconds left, Mitch dropped into a wave and threaded through a fantastic tube scoring an 8.10 as the horn sounded.
