EPA Caught Illegaly Experimenting on Human Subjects
Alex also interviews director of the American Tradition Institute's Environmental Law Center Dr. David Schnare who has blown the whistle on an illegal EPA human medical experiment. The US Environmental Protection Agency and its Administrator Lisa Jackson are on the defendant's end of a federal lawsuit claiming the Agency conducted illegal human experimentation on unsuspecting study volunteers. The American Tradition Institute Environmental Law Center (ATI) issued a complaint against the Agency last Friday, stating it "failed to comply with laws controlling human experimentation" in studies that were apparently testing the effect of "fine particles" on human subjects who were "more susceptible to the effects of air pollutants," in other words, participants who were already ill. The EPA, and Jackson in her official capacity, are targeted in the lawsuit for knowingly "conducting experiments on humans that involved exposing those persons to toxic substances the Agency believes will cause death and which the Agency therefore regulates under the auspices of the Clean Air Act, 42 USC Chapter 85." A statement regarding ATI's complaint reveals toxic particulate matter, known as PM2.5, was pumped into a gas chamber-like enclosure via an intake pipe located outside the building where diesel exhaust from a parked, idled truck was channeled into the building where the experiments took place. The city of Portsmouth revised its comprehensive plan and undertook a broad review of its development and land use regulations. As a result, Destination Portsmouth prepared a package of new plans, zoning ordinances, and other development policies in collaboration with community stakeholders. The overhaul of the city's codes encourages development in targeted growth areas and helps businesses to locate in the city while also protecting the character of Portsmouth's historic neighborhoods. EPA created the National Award for Smart Growth Achievement in 2002 to recognize exceptional approaches to development that protect the environment, encourage economic vitality, and enhance quality of life. In the past 11 years, 54 winners from 26 states have shown a variety of approaches that states, regions, cities, suburbs, and rural communities can use to create economically strong, environmentally responsible development. Ron Paul Exposes EPA Landgrab! No Rule of Law
Last week the Supreme Court heard arguments in Sackett v. EPA, a case of blatant federal agency overreach and abuse of private property rights. Without any proof or reason, and no chance for appeal, the Environmental Protection Agency determined that a small single home lot was a "protected wetland." The owners, Mike and Chantell Sackett, were ordered to halt construction already underway, to remove all of the work already done, and plant trees and shrubs consistent with a wetlands environment. After making these costly changes, the Sackets then would have to wait several years for the EPA to decide if they would be allowed the use of their own property. Refusal to comply with these outrageous and arbitrary commandments would result in daily fines greater than the value of the property! Outraged, the Sacketts sought relief through the courts, but court after court determined that they had no standing. The actions of the EPA were not subject to judicial review until a mountain of fees had already been assessed. This is just another example not only of how federal agencies wield enormous power over average citizens, but also how little practical protection our court system provides when such citizens are harmed by those agencies. Constitutionally, when the government determines private property is needed for public use, it is taken through eminent domain. EPA's Giant Power Grab Under 'Sustainable Developmemt'
The US Environmental Protection Agency wants to change how it analyzes problems and makes decisions, in a way that would give it vastly expanded power to regulate businesses, communities and ecosystems in the name of "sustainable development," the centerpiece of a global United Nations conference slated for Rio de Janeiro next June. The major focus of the EPA thinking is a weighty study the agency commissioned last year from the National Academies of Science. Published in August, the study, entitled "Sustainability and the US EPA," cost nearly $700000 and involved a team of a dozen outside experts and about half as many National Academies staff. Its aim: how to integrate sustainability "as one of the key drivers within the regulatory responsibilities of EPA." The panel who wrote the study declares part of its job to be "providing guidance to EPA on how it might implement its existing statutory authority to contribute more fully to a more sustainable-development trajectory for the United States." Or, in other words, how to use existing laws to new ends. According to the Academies, the sustainability study "both incorporates and goes beyond an approach based on assessing and managing the risks posed by pollutants that has largely shaped environmental policy since the 1980s." Sackett v. EPA: How One Couple's Battle Against the Feds Might Protect Your Land
The decision in the Supreme Court case Sackett v. EPA, due later this spring, could very well affect the meaning of property rights and due process in the United States. So how did a small-town couple from Northern Idaho ever become the center of such a momentous case? Reason.tv talked with the Sacketts and their attorney to find out. Mike Sackett dreamed of building a home on Idaho's Priest Lake ever since he camped there with friends in high school. "I remember coming home, told my mom and dad that I was going to move to Priest Lake, and they just said, 'Oh, no you're not.' And I said, 'Oh yeah. Yeah I am,'" Sackett said. Years later, Sackett realized that dream when he and his wife, Chantelle Sackett, bought a plot of land near Priest Lake and started to build. After securing the necessary permits from local authorities, the Sacketts were only three days into the process of clearing the land when officials from the EPA showed up and put their dreams on hold. The EPA informed the Sacketts that they suspected they were building on wetlands and had to cease work immediately. The Sacketts were stunned because their property was a completely landlocked lot within an existing subdivision. When Chantelle Sackett asked for evidence, the EPA pointed her to the National Fish and Wildlife Wetlands Inventory, which showed them that their lot... was not on an existing wetland. Mike and Chantell Sackett are being treated as criminals by EPA regulators who contend their vacant lot in northern Idaho is a "jurisdictional wetland," and the gravel fill they placed on the lot to prepare for construction of a new home is a violation of the Clean Water Act. There's no standing water on the property, or anything that resembles a wetland. "In this final week before the election, Mitt Romney's campaign has launched a new anti-Obama ad on Spanish language television stations and on its website. The ad targets an important segment of the Florida Hispanic vote -- Cubans. The latest Florida International University/Miami Herald/El Nueva Herald poll shows President Obama leading Hispanic voters in Florida by a narrow 51 to 47 percent over Mitt Romney. The same poll found that without Cuban-Americans, Obama wins Hispanic voters 65 to 32 percent. The ad attempts to link President Obama with Venezuelan President Hugo Chávez, Fidel Castro's niece, and Che Guevara. The ad features Chavez and Mariela Castro saying they would vote for Obama. It also cites an e-mail sent by the Environmental Protection Agency during Hispanic Heritage month, featuring a photo of Che Guevara. The EPA says a staffer sent out the e-mail without getting it approved by a supervisor. However, the Miami Herald, which was the first media outlet to obtain a copy of the ad, spoke with Latino voters who say the ad is having a negative effect. The Miami Herald says Cuban-American Rosa Hombredela identifies with the Republican party, but took advantage of early voting, and cast her ballot for President Obama.
