Menzies Cambpell QC MP (LibDem) answers questions on the fundamental errors of Mr Salmond's argument against the Supreme Court intervening in Scottish cases on Human Rights grounds.. A team headed by Lord John McCluskey has now been announced to study the issue and report back on what if any changes may be needed to the current system where criminal appeals can go to the Supreme Court in London on Human Rights grounds (ECHR) Scots should engage in this debate as the right to take an appeal to the Supreme Court in London v taking the several years long route to Europe is a legal write which should not be lost to Scots. The SNP are very much out of step in this debate where Human Rights issues in Scots Law, particularly where there are known to be miscarriages of justice and significant injustice.

Those of you in insurance, or practitioners with insurance clients will welcome this latest edition of MacGillivray on Insurance Law. Not for nothing has this classic work, so frequently cited in court, become known as the insurance law bible, having been around since the turn of the century—thats the nineteenth, not the twentieth and shortly coming up to its centenary in the Olympian year of 2012. This apparently, is the last edition of this mighty and worthy work until that momentous date arrives. It would be an interesting exercise to compare the content of, say the 1912 edition with this latest 11th edition in which naturally, there are chapters devoted to reinsurance, Lloyds and of course aviation insurance. (Thought: was the Wright Brothers flight on 17th December 1903 at Kitty Hawk insured?). Certainly the evolution of MacGillivray reflects the progress, or lack of it, of our times. Since the publication of the 10th edition in 2002, a number of important decisions have emerged in insurance law, which, as indicated in the books sub-title, relates to all risks except marine. As stated in the Preface, new material in this edition includes: areas of insurable interest, policy terms, good faith, waiver of the assureds breaches of duty, contribution, liability insurance, reinsurance and the liabilities of agents. A less than stellar Alex Salmond, Scotland's First Minister is interviewed on the issue of Scottish criminal cases going to the UK's Supreme Court in London. Mr Salmond is challenged several times over whether he supported comments from Justice Secretary Kenny MacAskill who claimed last week he would withdraw Scottish funding for the Supreme Court, and accused its judges of gaining knowledge of Scots Law only by visiting the Edinburgh Festival. Mr Salmond notably fails to answer in what must be one of his worst performances in an interview on the justice system ever. Menzies Cambpell QC MP also answers questions on the fundamental errors of Mr Salmond's argument against the Supreme Court intervening in Scottish cases. The castle was founded in the 12th century by the Scottish King David 1. In 1296-8, the English King Edward 1 had the castle rebuuilt and the town fortified, before it was returned to Scotland. In 1330 "Domino Roberto de Lawedre" of the Bass described as Custodian or Keeper of the Marches and the Castle of Berwick-upon-Tweed, received, apparently upon the termination of his employment there, £33. 6s.8p, plus a similar amount, from the Scottish Exchequer. The town and castle changed hands several times during the English-Scottish conflicts. In 1464 The exchequer Rolls of Scotland record that Robert Lauder of Edrington was paid £20 for repairs made to Berwick Castle. In the 16 th century, during the reign of Elizabeth 1, the walls were strengthened with the addition of two semi-circular artillery flanking towers, one at the river's edge and the other on the angle of the curtain wall. The English - Scottish border is the official border and mark of entry between Scotland and England. For centuries until the Union of the Crowns, the region on either side of the boundary was a lawless territory suffering from the repeated raids in each direction of the Border Reivers. Following the Treaty of Union 1707 which united Scotland and England to form the Kingdom of Great Britain, the Border continues to form the boundary of two distinct legal jurisdictions as the treaty between the two countries guaranteed the continued separation of English law and Scots law.
