News : Safaricom sued by Faulu Kenya over 'M-Shwari'
Listed mobile operator Safaricom has filed preliminary legal objections to a case in which it has been sued for stealing the mobile credit scheme popular as M-shwari. The firm through its lawyers noted that the high court did not have the jurisdiction to hear such a case. According to its lawyers, Faulu, a micro-finance institution had raised issues of intellectual property therefore the case should be referred to the industrial property tribunal. Faulu had last week moved to court to stop Safaricom and its partner Commercial Bank of Africa from carrying out any transaction on the platform claiming the two had stolen their idea. The high court is now expected to give directions on the matter this Thursday. M-shwari according to data from CBA has in the last three weeks registered over 650 thousand subscribers and some 150 million shillings already saved on the platform. Ohio Basketball Star Collapses After Receiving Prison Sentence
CLEVELAND, Ohio -- Tony Farmer, one of the most highly-recruited high school basketball players in Ohio, collapsed in court Tuesday after receiving a three-year prison sentence. The 18-year-old, who was set to be a senior at Garfield Heights High School, stands 6'7" tall and weighs 220 lbs. He was named Second Team All-Ohio for the 2011-12 season by the Associated Press. He is widely considered one of the top 100 basketball players in the class of 2013. According to Yahoo! Sports Rivals.com, he was being recruited by several major college programs including Michigan State, Illinois and Xavier. Farmer plead guilty to charges of robbery, assault, kidnapping and intimidation of the victim related to an April incident in which he confronted his ex-girlfriend, Andrea Lane, at her home near Rockside Road. Farmer collapsed in court as Cuyahoga County Common Pleas Judge Pamela Barker announced his sentence. Farmer remained on the ground for a short time before being pulled to his feet by Cuyahoga County sheriff's deputies. According to Cuyahoga County Prosecutor Bill Mason, Farmer can file for judicial release after spending 180 days in prison. In an odd twist, the victim provided an impact statement on Farmer's behalf prior to his sentencing. Despite Lane's plea to keep Farmer from going to prison, Barker handed down the sentence.

High Court confirms Labor's border protection policy failure & incompetence: Scott Morrison
www.liberal.org.au www.liberal.org.au Today's High Court ruling preventing the Government from implementing their Malaysian people swap is a devastating blow for an incompetent government that simply can't get anything right. This is a Government that lurches from one self-made crisis to the next, whether it is pink batts, the NBN, live cattle or border protection, it is just one bungle after another. This is a Government mired in incompetence. Julia Gillard's Malaysian non-solution, now joins her East Timor non-solution and Labor's failed asylum freeze policies as yet another example of Labor's inability to get anything right in this area. Having abandoned the Coalition's successful policies, Labor have unleashed a wave of policy failure that has brought more than 12000 people on 240 boats. The decision shows once again how the Government failed to think their policy through.

"THE HEART & SOUL OF NEW YORK CITY"
A K1X film by Kevin Couliau
Yes, it's about that time. Rain, sleet and snow have made way for the sun, long evenings and fresh sneakers. Early may, when Europe's hardwood champions have been crowned and the NBA playoffs shift into full gear, marks the inofficial start of the real basketball season: the streetball season! That's when reputations are made, nicknames are born and every ballplayer naturally gravitates towards that "thump", "thump" sound of his or her home court. Playground basketball is where it all started. Playground basketball is where talent is honed and friendships are made. It's where neighborhoods gather and where skills and sweat are a currency. That's especially true for the mecca of basketball, New York City. Nowhere else do streetball tournaments, players and games attract a quasi-religious following. Dollars, pride and bragging rights are on the line. Believe the hype!
The idea for a visual love letter to NY basketball was born when Red Cafe's unreleased track "Heart & Soul" established itself as an instant office-favorite at K1X headquarters in Munich (Germany) last spring. Niels Jager (K1X Go-To Guy): "The tune was on replay 24/7. And one day it hit us: let's build a statue for NYC streetball!" Red Cafe's ode to the city that never sleeps is a Pete Rock production that boasts all the makings of a hip hop classic. K1X, who has been active in the outfitting of several high profile NYC streetball tournaments for several years, was all the more surprised to find out that this beast of a tune was not yet a prime focus of Red Cafe's record label. Shake Down quickly agreed to let K1X shoot a poetic clip for the song, whose lyrics are a glowing personification of K1X's appreciation for street basketball: The Heart & Soul of New York City.
French streetball documentarist Kevin Couliau (Asphalt Chronicles), who spent the summer of 2009 in the five boroughs hunting down supreme blacktop action, was a natural choice to capture the raw essence of NYC and its rich streetball culture. As was the Canon 5D Mark II as Couliau's weapon of choice. Art director / director / producer Thibaut de Longeville (director of the acclaimed "Just For Kicks" sneaker culture documentary) and motion graphic designer Vincent Dumond of 360 Creative in Paris added their visual expertise to the project and took care of elegant motion graphics and bona fide post production.
The outcome of this work will celebrate its world premiere on May 1st 2010 on k1x.com. The clip features action from K1X affiliated tournaments in Harlem ("Together We Chill" and "Kingdome Classic") and the Lower East Side ("Lower Manhattan Classic") as well as a variety of other city courts and an impressive array of cameos by iconic players, opinion leading heads and a bunch of regular dudes. Bobbito Garcia, who got an early preview of the clip last winter had this to say: "It's so beautiful, man. It's snowing tonight but it made me look forward to the coming summer months again."
World Premiere: Witness "The Heart & Soul of New York City" on May 1st 2010 on k1x.com!

WINNER FOR BEST DOC, NEW JERSEY INT'L FILM FESTIVAL 2012
DOIN' IT IN THE PARK: PICK-UP BASKETBALL, NYC explores the definition, history, culture and social impact of New York's summer b-ball scene, widely recognized as the worldwide "Mecca" of the sport.
In New York City, pick-up basketball is not just a sport. It is a way of life. There are 700+ outdoor courts, and an estimated 500,000 players, the most loyal of which approach the game as a religion, and the playground as their church.
"You can play high school or college for four years. You can play Pro for a decade. You can play pick-up ... for life."
DOIN' IT IN THE PARK: PICK-UP BASKETBALL, NYC lovingly uncovers this movement through the voices of playground legends, NBA athletes, and most importantly the common ballplayer who all day looks forward to calling "next" game at their local schoolyard.
Co-directors Bobbito Garcia and Kevin Couliau visited 180 courts throughout NYC's five boroughs to create their debut documentary. They traveled to a majority of the locations by bicycle, carrying camera equipment and a ball in their backpacks. The film's title refers as much to the subject matter as it does to the method of filmmaking, providing an unprecedented perspective on urban America's most popular, and accessible, free recreation.
Main film characters: Julius "Dr. J" Erving, Kenny Smith, "Pee Wee" Kirkland, "Fly" Williams, God Shammgod, Tim "Headache" Gittens, Corey "Homicide" Williams, Kenny Anderson, Jack Ryan, Richard "Crazy Legs" Colon, Niki Avery, Milani Malik, and the Park Pick-Up Players of NYC.

Toledo, Spain
From Wikipedia, the free encyclopedia
Founded 7th century
Toledo (Latin: Toletum) is a municipality located in central Spain, 70 km south of Madrid. It is the capital of the province of Toledo and of the autonomous community of Castile-La Mancha. It was declared a World Heritage Site by UNESCO in 1986 for its extensive cultural and monumental heritage as one of the former capitals of the Spanish Empire and place of coexistence of Christian, Jewish and Moorish cultures. Many famous people and artists were born or lived in Toledo, including Al-Zarqali, Garcilaso de la Vega, Alfonso X and El Greco. It was also the place of important historic events such as the Visigothic Councils of Toledo. As of 2007, the city has a population of 78,618 and an area of 232.1 km² (89.59 square miles).
Toledo once served as the capital city of Visigothic Spain, beginning with Liuvigild (Leovigild), and was the capital until the Moors conquered Iberia in the 8th century. Under the Caliphate of Cordoba, Toledo enjoyed a golden age. This extensive period is known as La Convivencia, i.e. the co-existence of Jews, Christians, and Muslims. Under Arab rule, Toledo was called Tulaytulah (Arabic طليطلة, academically transliterated Ṭulayṭulah).
On May 25, 1085 Alfonso VI of Castile took Toledo and established direct personal control over the Moorish city from which he had been exacting tribute, and ending the mediaeval Taifa's Kingdom of Toledo . This was the first concrete step taken by the combined kingdom of Leon-Castile in the Reconquista by Christian forces.
Toledo was famed for its production of iron and especially of swords and the city is still a center for the manufacture of knives and other steel implements. When Philip II moved the royal court from Toledo to Madrid in 1561, the old city went into a slow decline from which it never recovered.
Toledo's Alcázar became renowned in the 19th and 20th centuries as a military academy. At the outbreak of the Spanish Civil War in 1936 its garrison was famously besieged by Republican forces.
Arts and culture
Toledo reached its zenith in the era of Islamic Caliphate. Historian P. de Gayangos writes:
The Muslim scientists of this age were not rivaled in the world. Perhaps among their greatest feats were the famous waterlocks of Toledo.[1]
The old city is located on a mountaintop with a 150 degrees view, surrounded on three sides by a bend in the Tagus River, and contains many historical sites, including the Alcázar, the cathedral (the primate church of Spain), and the Zocodover, a central market place.
From the 4th century to the 16th century about thirty synods were held at Toledo. The earliest, directed against Priscillian, assembled in 400. At the synod of 589 the Visigothic King Reccared declared his conversion from Arianism; the synod of 633 decreed uniformity of liturgy throughout the Visigothic kingdom and took stringent measures against baptized Jews who had relapsed into their former faith. The council of 681 assured to the archbishop of Toledo the primacy of Spain.
As nearly one hundred early canons of Toledo found a place in the Decretum Gratiani, they exerted an important influence on the development of ecclesiastical law. The synod of 1565–1566 concerned itself with the execution of the decrees of the Council of Trent; and the last council held at Toledo, 1582–1583, was guided in detail by Philip II.
Toledo was famed for religious tolerance and had large communities of Muslims and Jews until they were expelled from Spain in 1492 (Jews) and 1502 (Muslims). Today's city contains the religious monuments the Synagogue of Santa María la Blanca, the Synagogue of El Transito, Mosque of Cristo de la Luz and the church of San Sebastián dating from before the expulsion, still maintained in good condition. Among Ladino-speaking Sephardi Jews, in their various diasporas, the family name Toledano is still prevalent - indicating an ancestry traced back to this city (the name is also attested among non-Jews in various Spanish-speaking countries).
In the 13th century, Toledo was a major cultural center under the guidance of Alfonso X, called "El Sabio" ("the Wise") for his love of learning. The program of translations, begun under Archbishop Raymond of Toledo, continued to bring vast stores of knowledge to Europe by rendering great academic and philosophical works in Arabic into Latin. The Palacio de Galiana, built in the Mudéjar style, is one of the monuments that remain from that period.
The Cathedral of Toledo (Catedral de Toledo) was built between 1226-1493 and modeled after the Bourges Cathedral, though it

Can an Undocumented Immigrant Become a US Lawyer? California High Court Will Decide
Sergio Garcia, 35, has wanted to become an attorney since he was 10 years old. In 2009, his dream was about to become a reality. The longtime California resident had graduated from law school, passed the state bar, and received the approval of the State Bar Board of Examiners. There was just one problem: Garcia didn't have documentation to work legally in the United States. Born in Mexico, he was brought to the United States by his family when he was a little more than a year old. He lived in California until he was nine years old, then went back to Mexico before returning to the Golden State to finish high school and attend college and law school. His father says he applied for a green card for his son 18 years ago, but the application is still pending. Once the California Supreme Court, which has to sign off on all new bar members, found out about Garcia's status, it stopped short of letting him practice law. The court asked the Obama Justice Department to weigh in on the case instead; Justice said Garcia should not receive a license, reasoning that an illegal alien - albeit one who has spent decades in the US - doesn't have the right to work in the Land of the Free. "Independently of my status, I have to fulfill my dreams. I have to believe that all the work I've put into it is not going to be in vain," says Garcia. "The knowledge you gain [...] is not dependent on a piece of paper." "The fact that we can give a license to practice law to someone who cannot lawfully ...
