Facebook patent infringement trial Facebook fooled the jury with a doctored Interrogatory No. 9 that was the foundation of their only "win" in the trial regarding an esoteric law called "on sale bar." Facebook lost on 11 of 11 Leader claims for which they were judged to be "literally infringing," and they could prove no prior art. Facebook concealed over 60% of the interrogatory (questions put to a witness before a trial). Facebook concealed Leader's objections to the question and this concealment misled the jury--severely prejudicing the inventor's testimony. According to the district court, the on sale bar verdict turned on this attorney-altered interrogatory. New revelations have emerged that Facebook's attorneys practiced this jury deception on a focus group / mock trial of about 70 people at the Riverfront Center, Wilmington, Delaware on May 1-2, 2010.
