Real News @ RevolutionNews.US — (SAN FRANCISCO) Only Federal agencies can block cell phone use and with that, only under specific circumstances. BART is not a Federal agency.) According to a citation issued January 26, 2011, by the Federal Communications Commission against Comtrex Communications for illegal cell phone jamming, Section 333 of the Communications Act of 1934 states, "[n]o person shall willfully or maliciously interfere with or cause interference to any radio communications of any station licensed or authorized by or under this Act or operated by the United States Government." and Section 302(b) of the Communications Act provides that "[n]o person shall manufacture, import, sell, offer for sale, or ship devices or home electronic equipment and systems, or use devices, which fail to comply with regulations promulgated pursuant to this section." There's no evidence provided by any BART representative that such legal issues were considered before initiating the cell phone blocking action - BART seems to have just plain went ahead and done it.... BART officials acknowledged this afternoon that they shut down cell phone and wireless data service in its downtown San Francisco stations to disrupt a planned protest. Instead, the bill puts limits on the powers the president already has to cause "the closing of any facility or stations for wire communication" in a time of war, as described in the Communications Act of 1934, they said in a breakdown of the bill published on the Senate Homeland Security and Governmental Affairs Committee website. Other federal statutes give the FBI the authority and responsibility to investigate specific crimes. J. Edgar Hoover began using wiretapping in the 1920s during Prohibition to arrest bootleggers. A 1927 case in which a bootlegger was caught through telephone tapping went to the United States Supreme Court, which ruled that the FBI could use wiretaps in its investigations and did not violate the Fourth Amendment as unlawful search and seizure as long as the FBI did not break in to a person's home to complete the tapping. After Prohibition's repeal, Congress passed the 1934 Communications Act, which outlawed non-consensual phone tapping, but allowed bugging. In another Supreme Court case, the court ruled in 1939 that due to the 1934 law, evidence the FBI obtained by phone tapping was inadmissible in court. A 1967 Supreme Court decision overturned the 1927 case allowing bugging, after which Congress passed the Omnibus Crime Control and Safe Streets Act, allowing public authorities to tap telephones during investigations, as long as they obtain a warrant beforehand. The ad must simultaneously provide a clearly readable printed statement identifying the candidate and stating that the candidate approved the ad and that his or her authorized committee paid for its broadcast.
