Marbury v. Madison (Con Law: Judicial Review)
The Year is 1803, and Justice John Marshall authors the landmark opinion in Marbury v. Madison, which solidified the judicial branch's authority to interpret and decide the law. Though Justice Marshall's justification for the power of judicial review has received some criticism for being unclear, unnecessary to decide in this case, or not properly substantiated, this power has become one of the defining tools of the judicial branch. After John Adams lost a reelection bid to Thomas Jefferson in 1800, Adams appointed several Federalist judges and justices of the peace before Jefferson took office along with an incoming congress that would be controlled by Democratic-Republicans. Not all of these appointees, however, received their commissions before Thomas Jefferson was sworn in as president. As a result, President Jefferson asked his Secretary of State not to deliver any remaining commissions. William Marbury, who had been appointed as a justice of the peace in Washington DC but had not received his commission, decided to sue James Madison (then-Secretary of State) directly and originally in the Supreme Court to have his commission delivered. Marbury argued that the Judiciary Act of 1789, gave the Supreme Court the original jurisdiction to issue writs of mandamus to compel public officials to act. The District of Columbia Act of 1871 Initial review of the District of Columbia Organic Act of 1871 seems like it only sets up a local government (like Chicago or Seattle); how do you get that they formed a private corporation? If you take the Act out of its historical context and, from the present looking to the past, imagine who the parties involved are, we might agree. However, we cannot do that; to best understand what really happened we follow our: Standard for Review Rule 1: To understand any relationship you must: 1. First understand who the parties are; a. Always know yourself first b. Discover the true nature of all other parties second 2. Then you must understand the environmental nature of the relationship; and, 3. Only then do the actual terms of the relationship begin to have meaning and bearing on the relationship. Rule 2: To have any hope of understanding any particular situation in any relationship you must have first applied Rule 1, only then do the details of the situation in question have any meaning; therefore, review such details in accord with Rule 1 as well. "Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction." --13th Amendment, 1865. An 18000-acre former slave plantation in rural Louisiana, the infamous Louisiana State Penitentiary at Angola is the largest prison in the US Today, with African Americans composing over 75% of Angola's 5108 prisoners, prison guards known as "free men," a forced 40-hour workweek, and four cents an hour as minimum wage, the resemblance to antebellum US slavery is striking. In the early 1970s, it was even worse, as prisoners were forced to work 96-hour weeks (16 hours a day/six days a week) with two cents an hour as minimum wage. Officially considered (according to its own website) the "Bloodiest Prison in the South" at this time, violence from guards and between prisoners was endemic. Prison authorities sanctioned prisoner rape, and according to former Prison Warden Murray Henderson, the prison guards actually helped facilitate a brutal system of sexual slavery where the younger and physically weaker prisoners were bought and sold into submission. As part of the notorious "inmate trusty guard" system, responsible for killing 40 prisoners and seriously maiming 350 between 1972-75, some prisoners were given state-issued weapons and ordered to enforce this sexual slavery, as well as the prison's many other injustices. William Ramsey Clark was born in Dallas, Texas, on 18th December, 1927. His father, Tom C. Clark, was a civil district attorney. Ramsey Clark served in the United States Marine Corps during the Second World War. He earned a BA degree from the University of Texas at Austin in 1949, and an MA and a JD from the University of Chicago in 1950. Harry S. Truman appointed Tom C. Clark as the Attorney General of the United States (1945-1949) and as an associate justice of the Supreme Court (1949-1967). Ramsey Clark was admitted to the State Bar of Texas in 1950 and the following year he became an associate and partner in the law firm of Clark, Reed and Clark. In 1961 Clark was appointed as the Assistant Attorney General of the Lands Division. After the assassination of John F. Kennedy he worked in a liaison capacity with the Warren Commission. In 1965 Lyndon B. Johnson appointed him as his Deputy Attorney General. Ramsey Clark played an important role in the history of the American Civil Rights movement. During his years at the Justice Department, he supervised the drafting and executive role in passage of the Voting Rights Act of 1965 and supervised federal enforcement of the court order protecting the march from Selma to Montgomery. In 1967, President Lyndon B. Johnson nominated him to be Attorney General of the United States, he was confirmed by congress and took the oath of office on 2nd March.
