Supreme Court hearing hits snag
www.ntv.co.ke The hearing of an appeal case involving the dissolution of Madhupaper International Limited -- a company belonging to Samuel Kamau Macharia of Royal Media Services and the Kenya Commercial Bank hit a snag at the supreme court as the five judge panel led by Chief Justice Willy Mutunga did not make a ruling on the case after receiving submissions from the lawyers handling the case. George Oraro the lawyer representing Kenya Commercial Bank had challenged the court's jurisdiction to make a determination on the case. However, Gibson Kamau Kuria representing Madhupaper International submitted that the court had appellate jurisdiction to hear the case and make a ruling. The judges adjourned without issuing a ruling stating that they would make a determination as to whether the court had jurisdiction to hear and rule on the matter on the 17th of October 2012.

The Judges, both of the supreme and inferior Courts, shall hold their Offices during good Behavior, and shall, at stated Times, receive for their Services a Compensation which shall not be diminished during their Continuance in Office. Section 2 The judicial Power shall extend to all Cases, in Law and Equity, arising under this Constitution, the Laws of the United States, and Treaties made, or which shall be made, under their Authority; to all Cases affecting Ambassadors, other public Ministers and Consuls; to all Cases of admiralty and maritime Jurisdiction; to Controversies to which the United States shall be a Party; to Controversies between two or more States; between a State and Citizens of another State; between Citizens of different States; between Citizens of the same State claiming Lands under Grants of different States, and between a State, or the Citizens thereof, and foreign States, Citizens or Subjects. ' Peter urges Congressman LoBiondo to co-sponsor HR 217, Title X Abortion Provider Prohibition Act and HR 358, The Protect Life Act . All three of these bills respect and promote the life and health of unborn Americans while preventing the federal government from funding or promoting abortions with taxpayer money. HR 358 also restores the conscience clause for health care providers, a much needed safeguard to end forced abortion training and participation. Peter also urged Congressman LoBiondo to co-sponsor HR 1096 Sanctity of Life Act of 2011, introduced by Rep. Ron Paul. This is a life-saving "check-and-balance" which would protect un-born Americans - one Congress has not used, but should have - in a 100 years. It's based on Article 3, Sect. 2 - In all the other cases before mentioned, the Supreme Court shall have appellate jurisdiction, both as to law and fact, with such exceptions, and under such regulations as the Congress shall make.

Arrest And Release Of Ali Musa Gillani in Efidrene Case In Islamabad The Supreme Court granted interim-bail to Ali Musa Gilani, who was earlier arrested in ephedrine case by ANF from outside the SC gate. The three-member bench headed by Justice Nasir ul Mulk, while resuming the hearing of the ephedrine case Friday here, took serious view of Ali Musa Gilani's arrest outside the SC gate and ordered that he be presented in the apex court within half an hour. ANF complying with court orders presented Ali Musa Gilani shortly. The court reprimanding the ANF officials granted interim-bail to Musa Gilani on surety of Rs500,000. Ali Musa Gilani's lawyers informed the court that a notice was already served to him and his arrest outside the SC gate was tantamount to contempt of court. Following the footsteps of Federal Minister Makhdoom Shahbuddin, Ali Musa Gilani had moved SC on Thursday to seek interim relief against a Lahore High Court (LHC) order in the Ephedrine quota case. Ali Musa invoked the appellate jurisdiction of the Supreme Court against the LHC verdict which denied him a pre-arrest bail in the Ephedrine case on September 3. He is accused of pressurizing officials of the health ministry in 2010 to allocate a quota of controlled chemical ephedrine to two different pharmaceutical companies. Recently, the SC has granted pre-arrest bail in the same case to Federal Minister for Textile Industry Makhdoom Shahabuddin till September 25.
