What Is Litigation? Atlanta Personal Injury Attorney Greg Stokes Explains
www.stokesinjurylawyers.com When does an injury case turn into a lawsuit - in legal terms, "litigation"? A lawsuit is filed as a last resort, when the insurance company and the victim's injury attorney have negotiated at length, but can't agree how much the case should settle for. There are four stages 1. The victim's injury lawyer prepares and files a document (" complaint") at the courthouse to start the case, and the insurance company files an answer. 2. Discovery. Both sides exchange information, most importantly by depositions - formal, recorded testimony of the victim, witnesses, doctors, and other persons who know firsthand about the accident or injury. 3. Mediation. This usually takes a whole day, and the attorneys and their clients - the victim and the insurance company representative - discuss the case with the mediator, and the mediator tries to forge an agreement to settle the case. This usually works. 4. Trial. If a case doesn't settle, the attorneys present the evidence in front of a jury of 12 people, who will decide the case. Often, cases settle during the trial. Public outcry is growing in the US at emergency services' seeming policy of standing by while houses burn down and people drown, if services have not been previously paid for. A spate of real-life incidents has sparked concern over what kind of society America is becoming. The recent series of shocking accidents forced homeowners in one of the counties to watch as their houses and possessions burned to the ground. And the firefighters were right there watching, as well. All because the owners didn't pay the US$75 "fire subscription fee", known as the "pay for spray" charge. Also, tomorrow, the ECB council meets about possible bond purchases and how to react to the financial turmoil in Europe. We talk to Peter Tchir, founder of TF Market Advisors, about what to expect from the central banks. Also, the manufacturing scenario in Europe appears grim. Eurozone factory activity in July fell at its steepest rate in more than three years, according to Markit Economics' Purchasing Managers Index. German manufacturers suffered the largest fall in new export orders of any Euro-zone country. Could this mean trouble in Europe's economic powerhouse? We will talk to Peter Tchir about how this fits into the crisis calculus. And when Olympians from the US get the gold medal, they will have to cough up almost $9000 to settle with the IRS!
