This video: www.mediafire.com So I sent this video to YT. Their reply was swift, and apathetically indifferent. Paraphrasing, 'if you think the dmca is false, file a counter notice'. And sure they are under no obligation to do anything, although they have just demonstrated by their actions that 10 dmcas evidently filed in bad faith with no consideration for fair use (see Lenz v. Universal Music Corp., 572 F.Supp.2d 1150, 1154-55 (ND Cal. 2008)) is not considered a pattern of abuse worthy of the sanctions youtube states that it would implement in the case of abuse. In essence youtube has just demonstrated that they are unwilling to take action against even flagrant abuse of the DMCA and the sanction they threaten, of termination of the account, is one that youtube is either too apathetic or too unwilling to enact.

UPDATE: THERE IS A VIEW BOT ON THIS VIDEO THAT IS ARTIFICIALLY INCREASING THE VIEWS. I DON'T KNOW WHO IS DOING IT (ALTHOUGH I HAVE MY GUESSES) BUT I DO NOT KNOW HOW TO STOP IT. IF THIS VIDEO MAKES IT TO THE TOP PAGE I APOLOGIZE TO THE PEOPLE WHO RIGHTLY DESERVE THAT SPOT BUT I DON'T KNOW HOW TO STOP THE VIEW BOT. THE ISSUE HAS BEEN REPORTED TO YOUTUBE AND I WILL TRY TO HAVE THE VIEWS REMOVED FROM MY VIDEO. I SUSPECT THE VIEWS ARE COMING FROM MOBILE VIEWS SO I TRIED DISABLING THE MOBILE VIEWS BUT IT DIDN'T WORK. IT CONTINUED TO CLIMB. SO MOBILE VIEWS WERE RE-ENABLED. Machinima I no longer wish to be associated with people who censor the internet Here is proof that they did it twitpic.com www.youtube.com made by www.youtube.com Let me explain the glitch. It is confirmed that Machinima DID file a DMCA based solely on the use of Megan's image in the thumbnail, something Machinima DOES NOT OWN THE COPYRIGHT TO. This is clear abuse of the DMCA. Ric Mendoza has wised up and has retracted the claim which for some reason caused the video to revert to Fullscreen which is the network this guy belongs to. He then contacting his network to get the glitch fixed but it is confirmed by Ric Mendoza of Machinima that they did file a DMCA to censor criticism on the internet. The video has since been restored. Ric Mendoza did not consider that the person he was issuing a bogus DMCA against was also in a Network who could help him get his video back real quick.

Hitler, as "Downfall producer" orders a DMCA takedown
Full details at http://ideas.4brad.com/hitler-tries-dmca-takedown - There are hundreds of parodies of this "Downfall" clip. The studio, Constantin Films, has ordered takedowns of some of them, and eventually even had this parody removed from YouTube. In this clip, Hitler is the producer, and his lawyers tell him why he can't do a DMCA takedown and how the EFF could stop him. He desperately searches for other ways to protect the movie.
Made by Brad Templeton, an EFF board member (but releasing the video on his own.) This video educates about intellectual property issues and parodies the actions of the studio using the very clip they are censoring.

MPAA shows how to videorecord a TV set
At the DMCA 1201 hearings at the Copyright Office at the Library of Congress, representatives from the MPAA showed a video demonstrating how users can videorecord a TV set. They argue this is an acceptable analog alternative to breaking copy protection on a DVD.
The hearings occur every three years to determine whether the Librarian at the Library of Congress (through direction of the Copyright Office) should create exemptions to the anti-circumvention provisions in the Digital Millennium Copyright Act.
In 2006, film and media professors were granted an exemption in order to break copy protection on DVDs so that they could utilize high quality video clips in classroom teaching. Up for consideration during the 2009 exemption hearings is whether this exemption should be extended to apply to faculty teaching in all disciplines, and whether the exemption should apply to students.
