Forum: Law and Accountability in the Age of WikiLeaks
For several years WikiLeaks was an award-winning site exposing corruption around the world. In 2010, it began revealing sensitive US acts and communications culminating in the release of 250000 State Department cables to major news organizations. These actions caused a great deal of anxiety worldwide. Nine NYU faculty and alumni --experts in the First Amendment, national security, Internet law, and journalism --will discuss what worries them most about WikiLeaks and the responses to it. Our discussion will be an examination of past cases including the Pentagon Papers, to enrich our understanding of the present and future of law in the Internet age. Questions for discussion: Will international diplomacy be hampered by the threat of disclosure? Is WikiLeaks and its ilk journalism? What can the private sector do to protect itself from WikiLeaks? And how should the law regard private sector efforts to hobble WikiLeaks? Panelists: Simon Chesterman, Global Professor of Law, Director, New York University School of Law Singapore Program Norman Dorsen, Frederick I. and Grace A. Stokes Professor of Law, Co-Director, Arthur Garfield Hays Civil Liberties Program Brian Markley, Partner, Cahill Gordon & Reindel Burt Neuborne, Inez Milholland Professor of Civil Liberties, Legal Director, Brennan Center for Justice Samuel Rascoff, Assistant Professor of Law Jay Rosen, Associate Professor of Journalism, New York University, Author, PressThink Katherine Strandburg, Professor of Law Diane ...

Daniel Straus's Anti-Union Thugs Threaten to Assault NYU Student at Rally for Justice
This is a video of anti-union thugs threatening to beat up NYU students during a demonstration on the NYU campus yesterday. These goons were hired by a company owned by Daniel Straus, a member of the Executive Committee of the Board of Trustees at NYU Law School, to intimidate students and nursing home workers who organized a demonstration outside of the Straus Institute for the Advanced Study of Law and Justice yesterday. Straus funds the Institute with over $1 million in annual contributions, yet his company, Healthbridge, is forcing nursing home workers in Connecticut to pay up to $6000 more per year for family health insurance and taking away sick days, vacation time, pension contributions, and paid lunch breaks from these workers. The National Labor Relations Board has issued numerous complaints about Straus's illegal actions, and is seeking an injunction in court to force him to bring 600 workers who have been on strike for the past 2 months back to work on the terms of their old contract. Yet it appears that Straus's company will stop at nothing in his efforts to defeat these workers, members of SEIU 1199, and their supporters. In the video, you will hear these goons repeatedly threaten to assault an NYU student as he attempts to peacefully leaflet people as they enter the opening reception at the Straus Institute. We believe that it is the height of irresponsibility for a member of the Executive Committee of NYU Law School to hire people to come to our campus and ...

Felix Frankfurter's Revenge? A Democracy Built by Judges
Beginning with its landmark decision in Baker v. Carr (1962), the Supreme Court has been actively involved in shaping American democracy for almost 50 years. In his dissent, Justice Felix Frankfurter warned we would rue the day we allowed judges, acting as amateur political scientists, to have the final word on the functioning of American democracy. Enough time has passed to test Justice Frankfurter's hypothesis. Do cases like Bush v. Gore (2000), where five Justices prevented the counting of Florida's votes in the 2000 presidential election, and Citizens United v. Federal Election Commission (2010), where five justices turned American democracy over to corporate lobbyists, mean that Frankfurter was right? Professor Burt Neuborne is the Inez Milholland Professor of Civil Liberties at New York University School of Law and the Legal Director of the Brennan Center for Justice at NYU School of Law. He focuses his research on the operation of the democratic process.

Living Under Drones
www.warcosts.com Since 2004, up to 884 innocent civilians, including at least 176 children, have died from US drone strikes in the North Waziristan region of Pakistan. A new report from the Stanford and New York University law schools finds drone use has caused widespread post-tramatic stress disorder and an overall breakdown of functional society in North Waziristan. In addition, the report finds the use of a "double tap" procedure, in which a drone strikes once and strikes again not long after, has led to deaths of rescuers and medical professionals. Many interviewees told the researchers they didn't know what America was before drones. Now what they know of America is drones, death and terror. Follow the conversation @WarCosts #UnderDrones

LAA Fall Lecture: "College Athletics: Is Anyone in Charge?"
The Law Alumni Association (LAA) Annual Fall Lecture was held on November 14, 2012, and brought together several leading sports, business, law and media experts to debate issues and questions of regulation currently facing the world of college athletics. The panel, moderated by Professor Arthur R. Miller, examined the various oversight roles played by the NCAA, the university, athletic departments, the media, alumni-boosters, and the law and why we should care about who actually is in charge. The panelists included LaVar Arrington, former Penn State University football player and former Washington Redskins and New York Giants professional football player; Dana Jacobson, former sports anchorwoman for ESPN; David Jones, sports columnist for The Patriot-News; Joseph Nocera, business columnist for The New York Times; Leonard Wilf (LL.M. '77), owner and vice chairman of the Minnesota Vikings; Fred Wilpon, chairman and CEO of the New York Mets; Dr. Connee Zotos, clinical associate professor of sports management at the Preston Robert Tisch Center for Hospitality, Tourism and Sports Management at New York University.

RAW Footage New York's Columbus Circle KILLER Released by NYPD The hunt for New York's Columbus Circle killer took on a new impetus today as police released surveillance video showing the killer moments before he calmly walked up to Brandon Lincoln Woodard and put one bullet from a silver colored handgun into the back of the Los Angeles man's head in full view of holiday shoppers. The video confirms the details of the hit man's calculated wait for his victim as first reported on ABCNews.com on Monday. "In the video, the gunman wanted in the shooting death yesterday of Brandon Lincoln Woodard, 31, of Los Angeles, is seen 10 minutes before the shooting," Deputy Commissioner for Public Information Paul Browne said in a statement today. Woodard, who is described by police as linked to the hip hop part of the Los Angeles entertainment industry, was strolling down 58th Street near the southern end of Central Park when he was gunned down. "The shooter, who appears to be bald and may have a beard, exited a late model Lincoln sedan, initially bare-headed, but soon pulled the hood of his jacket over his head. Ten minutes later, at approximately 2 pm, the shooter walked up behind Woodard and fired," Browne said. In a grainy still image also released, the gunman is seen behind Woodard a moment before the shooting, pulling the weapon from his jacket. Just before he was shot, Woodard turned "instinctively almost," then turned back to his portable electronic device, police told ABC News ...

Year Zero - OFFF Barcelona 2011 Main Titles
Following in the footsteps of Prologue Films and The Mill, PostPanic have created this year’s prestigious opening titles 'Year Zero' for OFFF Festival 2011 in Barcelona http://offf.ws/bcn2011/
Written by Mischa Rozema and British graphic designer, Si Scott, the opening titles reflect their dark thoughts on a possible future. Directed by Mischa and shot on location in Prague, the film guides the viewer through a grim scenario embedded with the names of artists appearing at this year’s OFFF festival. The live action was brought back to Amsterdam for post, primarily carried out by PostPanic’s in-house team of artists but also with the additional help of freelancers and partner companies that we have enjoyed strong creative relationships with over the years. It’s really fair to say that this was a labour of love by a passionate crew of people.
DIRECTOR'S NOTES (By Mischa Rozema)
This project started out as a collaboration between myself and Si Scott. Right from the start, we decided that it should be the darkest thing we could make. I think it just felt natural to the both of us; if we had to nail the future, it would not be a nice place.
This idea evolved into a clash of times. Inspired by an idea from the late Arthur C. Clarke. He wrote about different historical civilizations meeting in a single point in time. So what happens when civilizations meet? The 'weaker' one gets eaten by the 'stronger'. You only have to look at history to see the destructive power of civilizations.
So the main underlying idea is: what would happen if the future lands on our doorstep today? Let's take mankind, add perhaps 100 years and then let them show up on our doorstep today. The future would pretty much devour the present. Probably in a matter of, let's say, 7 days… So that's what we're looking at. But every ending also means a new beginning, hence Year Zero.
There's all kinds of hidden messages in there. Like the virus eating away at reality, buildings and people, even at the viewers brain. It's behaving off course much like a computer virus. And the network of wires represents the future of social networking. I just made it physical and let it 'catch' the city and it's people like a net. All these ideas just serve as inspiration for us to create a future that worked for this concept. They're not meant to be deciphered by the audience. It's still meant to be just a title sequence and not an actual movie.
Now what makes a good title sequence? Personally, I think it's something that gets you in the mood, warms you up for what you're about to experience, be it a film, tv series or in our case, the OFFF festival. We decided to treat the OFFF festival as a feature film experience. So all we had to do was get the viewer into the right state of mind. Without, of course, being too narrative led. The best title sequences out there are nothing but a random collection of images/scenes that don't tell a lot if you watch them on their own. But edit them together and a new context is created. A context that matters, a feeling that gets the viewer ready for the main event, in our case, the festival.
To get started, the next thing we did was make a collection of ideas that would scare me and Si. So, anything drawn from our youth, right through to stuff that's inspired us over the years as well as seemingly random compositions that trigger the imagination of the viewer. For example, when we show you the aesthetics of a car explosion, it's carefully constructed. Why a car and not something else? Because an exploding car brings extra content to an otherwise simple aesthetic display of violence. A car doesn't explode by itself so instantly the brain tries to formulate the background behind it. It adds an either political or criminal edge to the violence. To me it felt appropriate because of the sense of protest and rebellion the shot has. And maybe the biggest question; was there someone in the car and if so, who was it? For me, every idea should provoke these kind of questions; from a girl in a prom dress holding a rocket launcher to a riot cop standing in the kitchen. All scenes have a pre and post story to them. In no time you're actually trying to connect these seemingly random scenes and boom; you've just created your own strange context. You now have a feeling, a taste and lots of questions probably. Questions that normally would be answered by watching the actual movie. But since there's no actual movie here we'll leave stranded with, hopefully, an uncomfortable feeling and lots of questions - some might feel unsatisfied and wondering why. Just like a nightmare.
We also wanted the actual titles to be different this time. Most of the time festival titles are driven by the idea on how to show titles. A mechanism that displays titles in a creative way. We actually thought to bring the festival theme to the foreground and have the titles play a part in it. Incorporate them so they become the actual fiber/texture of the

INSPIRATION:
The Imaginary Foundation says "To Understand Is To Perceive Patterns"...
Albert-László Barabási, author of LINKED, wants you to think about NETWORKS:
“Networks are everywhere. The brain is a network of nerve cells connected by axons, and cells themselves are networks of molecules connected by biochemical reactions. Societies, too, are networks of people linked by friendships, familial relationships and professional ties. On a larger scale, food webs and ecosystems can be represented as networks of species. And networks pervade technology: the Internet, power grids and transportation systems are but a few examples. Even the language we are using to convey these thoughts to you is a network, made up of words connected by syntactic relationships.”
'For decades, we assumed that the components of such complex systems as the cell, the society, or the Internet are randomly wired together. In the past decade, an avalanche of research has shown that many real networks, independent of their age, function, and scope, converge to similar architectures, a universality that allowed researchers from different disciplines to embrace network theory as a common paradigm.'
Steven Johnson, author of Where Good Ideas Come From, writes about recurring patterns and liquid networks:
“Coral reefs are sometimes called “the cities of the sea”, and part of the argument is that we need to take the metaphor seriously: the reef ecosystem is so innovative because it shares some defining characteristics with actual cities. These patterns of innovation and creativity are fractal: they reappear in recognizable form as you zoom in and out, from molecule to neuron to pixel to sidewalk. Whether you’re looking at original innovations of carbon-based life, or the explosion of news tools on the web, the same shapes keep turning up... when life gets creative, it has a tendency to gravitate toward certain recurring patterns, whether those patterns are self-organizing, or whether they are deliberately crafted by human agents”
Patrick Pittman from Dumbo Feather adds:
“Put simply: cities are like ant colonies are like software is like slime molds are like evolution is like disease is like sewage systems are like poetry is like the neural pathways in our brain. Everything is connected.
"...Johnson uses ‘The Long Zoom’ to define the way he looks at the world—if you concentrate on any one level, there are patterns that you miss. When you step back and simultaneously consider, say, the sentience of a slime mold, the cultural life of downtown Manhattan and the behavior of artificially intelligent computer code, new patterns emerge.”
James Gleick, author of THE INFORMATION, has written how the cells of an organism are nodes in a richly interwoven communications network, transmitting and receiving, coding and decoding and how Evolution itself embodies an ongoing exchange of information between organism and environment.. (Its an ECO-SYSTEM, an EVOLVING NETWORK)
“If you want to understand life,” Wrote Richard Dawkins, “don’t think about vibrant, throbbing gels and oozes, think about information technology." (AND THINK ABOUT NETWORKS!!
Geoffrey West, from The Santa Fe Institute, also believes in the pivotal role of NETWORKS:
"...Network systems can sustain life at all scales, whether intracellularly or within you and me or in ecosystems or within a city.... If you have a million citizens in a city or if you have 1014 cells in your body, they have to be networked together in some optimal way for that system to function, to adapt, to grow, to mitigate, and to be long term resilient."
Author Paul Stammetts writes about The Mycelial Archetype: He compares the mushroom mycelium with the overlapping information-sharing systems that comprise the Internet, with the networked neurons in the brain, and with a computer model of dark matter in the universe. All share this densely intertwingled filamental structure.
An article in Reality Sandwich called Google a psychedelically informed superpowered network, a manifestation of the mycelial archetype:
“Recognizing this super-connectivity and conductivity is often accompanied by blissful mindbody states and the cognitive ecstasy of multiple "aha's!" when the patterns in the mycelium are revealed. That Googling that has become a prime noetic technology (How can we recognize a pattern and connect more and more, faster and faster?: superconnectivity and superconductivity) mirrors the increased speed of connection of thought-forms from cannabis highs on up. The whole process is driven by desire not only for these blissful states in and of themselves, but also as the cognitive resource they represent. The devices of

The text used for the narration of “Passing Through” is part of a speech Serbian scientist and inventor
Nicola Tesla delivered in 1893 at the Franklin Institute in Philadelphia. Though today less known than
figures like Edison and Einstein, Tesla was more or less the father of much of our modern technology, since
he among other things developed the foundations of the European electrical system based on alternating
currents and the principles of wireless radio communication.
At the time he was deeply influenced by the Austrian physicist and philosopher Ernst Mach, believing
that the world should be conceived as a whole where everything is interconnected influencing each
other. And that energy is a force that runs through everything be it inorganic matter, organisms or human
consciousness. According to this line of thought every single action has universal consequences, not unlike
what the father of modern chaos theory Edward Lorenz in the 1960’s termed ‘the butterfly effect’.

“Passing Through” is made at Kolding School of Design in connection to the Danish iPower-project.

"Like a wave in the physical world, in the infinite ocean of the medium which pervades all, so in the world of organisms, in life, an impulse started proceeds onward, at times, may be, with the speed of light, at times, again, so slowly that for ages and ages it seems to stay, passing through processes of a complexity inconceivable to men, but in all its forms, in all its stages, its energy ever and ever integrally present.
A single ray of light from a distant star falling upon the eye of a tyrant in bygone times may have altered the course of his life, may have changed the destiny of nations, may have transformed the surface of the globe, so intricate, so inconceivably complex are the processes in Nature. In no way can we get such an overwhelming idea of the grandeur of Nature than when we consider, that in accordance with the law of the conservation of energy, throughout the Infinite, the forces are in a perfect balance, and hence the energy of a single thought may determine the motion of a universe.”

New York's Columbus Circle Killer Revealed on Video by NYPD - 12/11/12

The Forum: The Debate over Health Care Reform
Without question, the top domestic policy issue this fall is President Obama's call for health care reform. The battle is heated, but many people are unclear about the issues. This inaugural NYU Law Forum brings together two of the nations leading experts on health care and insurance reform. Professors Judy Feder and Richard Epstein provide background information regarding what is being considered in Congress, and debate whether these proposed plans should be adopted.

Joseph Stiglitz: The Price of Inequality | The New School
The New School, a university in New York City, offers distinguished degree, certificate, and continuing education programs in art and design, liberal arts, management and policy, and the performing arts. THE NEW SCHOOL | www.newschool.edu The impact of inequality on societies is now increasingly well understood - higher crime, health problems and mental illness, lower educational achievements, social cohesion and life expectancy. But what are the causes of inequality, why is it growing so rapidly, and how is it affecting the economy? These are the questions Nobel Prize-winning economist Joseph Stiglitz, professor at Columbia University, will discuss in a presentation of his latest book, The Price of Inequality How Today's Divided Society Endangers Our Future. In this talk, Stiglitz will discuss how, left to their own devices, markets are neither efficient nor stable, and will tend to accumulate money in the hands of the few. He will also demonstrate how government policies and political institutions, far from countering these trends, often enhance them, and that politics frequently shapes markets in ways that advantage the richest over the rest. This in turn weakens democracy and the rule of law by putting more and more political power in the hands of the wealthy. Beyond these social and political costs, however, inequality has grave consequences for the economy. Moving money from the middle and bottom of society to the top-as has increasingly been happening-stifles ...
