A temporary restraining order is an order from the court that tells someone to stop hurting or threatening to hurt you. In this video, you will learn how to apply for a restraining order.

If a restraining order has been filed against you and served on you, it’s very important
that you talk to an attorney as soon as possible so you know what your rights are and
what your obligations are. Chances are, on the restraining order paperwork, you will have
a date for a final restraining order hearing, which will be in a very short time frame,
maybe only a couple of days. It’s important that you take this matter very seriously
because it has very serious consequences.
First of all, it’s imperative that you read the domestic violence restraining order and you
understand what you’re precluded from doing. You may not contact the victim in any
way. You may not contact the victim through third parties in any way. You can’t post on
Facebook or social media, anything regarding the circumstances under which the
restraining order was obtained. You may also have some restrictions including contacting
the victim’s family, contacting the victim’s employer, being in certain places like her
place of employment or his place of employment.
It’s imperative that you comply with the restraining because a violation of a temporary
restraining order has some consequences as to whether or not a final restraining order will
be imposed. Violations of a final restraining order will be construed as contempt of court
and could result in some considerable jail time; 30 days jail time. It’s important that you
consult with an attorney. A domestic violence final restraining order hearing happens
very quickly. You do not have the benefit of discovery as you would in a normal family
trial or criminal trial. You must defend this case on the merits with the limited amount of
information that you will obtain on the day of your final restraining order trial.
I can’t stress enough how important it is to get counsel involved in the case as quickly as
possible. What you also need to know is this is not considered a criminal offense, even
though the imposition of a final restraining order can have some dire consequences in
terms of your ability to be employed or your ability to travel. You’re not entitled to the
benefit, for instance, of a public defender in this type of case. It’s considered civil in
nature, even though it has some quasi-criminal ramifications. It’s important that you get
your own attorney involved in the case. You can’t rely on the court to appoint somebody
for you. I cannot stress it enough. It has to be determined and evaluated on a case-by-case
basis, so you need to contact someone as quickly as possible.

A temporary restraining order (TRO) is as it sounds, meaning that temporarily the person who is the defendant is restrained from contacting the alleged victim of domestic violence. If you are a victim of domestic violence, whether you'll be a man or whether you'll be a woman, the courts of North Carolina afford you protection. You can obtain what is called a 50B, which is a domestic violence restraining order. That's an order here in North Carolina that's meant to protect you from an abusive family member or spouse. The way that you do that is you contact the clerk of court. They will help you file the paper work necessary to obtain a temporary restraining order.
Now, these are not for getting someone kicked out of the house or "I want to get custody of the children." These are if you have been assaulted. These are if you have been threatened to put in immediate, serious bodily harm, if you have been stalked by a family member or spouse. They're here to protect you. The court, if they make a finding that you are in need of support, will enter a temporary order granting you protection for up to 10 days. After that 10 days, you will have a hearing. All parties will be present. You will be put on the stand to testify as to what the abuse was. The accused will have a chance to counter that.
The judge at that time will make a decision on whether the order is entered for one day, two days, or up to a year. The court, in that order, can also establish what the temporary or living arrangements of the children will be. They can also order some temporary child support. So if you feel that you are in danger, the first step is to the court, and the second step is to an attorney to get you out of that situation.

Restraining order
A restraining order or protective order is an order used by a court to protect a person or entity, and the general public, in a situation involving alleged domestic violence, harassment, stalking or sexual assault. In the United States, every state has some form of domestic violence restraining order law, and many states also have specific restraining order laws for stalking and sexual assault.
Restraining and personal protection order laws vary from one jurisdiction to another but all establish who can file for an order, what protection or relief a person can get from such an order, and how the order will be enforced. The court will ask the adverse party to refrain from doing certain actions and require certain tasks to be done. Failure to comply is a violation of the order, in which the victim can request that the police and/or the court to enforce the order more closely depending on the severity of the violation.
Restraining order provisions
All protective order statutes permit the court to instruct the abuser to stay a certain distance away from someone, their home, their workplace or their school ("stay away" provisions) and to not contact them. Victims generally may also request the court to order that all contact, whether it be by telephone, notes, mail, fax, email or delivery of flowers or gifts, be prohibited ("no contact" provisions). Courts can also instruct the abuser to not hurt or threaten someone ("cease abuse" provisions).

You can obtain what is called a 50B, which is a domestic violence restraining order. That's an order here in North Carolina that's meant to protect you from an abusive family member or spouse. The way that you do that is you contact the clerk of court. They will help you file the paper work necessary to obtain a temporary restraining order. Now, these are not for getting someone kicked out of the house or "I want to get custody of the children." These are if you have been assaulted. These are if you have been threatened to put in immediate, serious bodily harm, if you have been stalked by a family member or spouse. They're here to protect you. The court, if they make a finding that you are in need of support, will enter a temporary order granting you protection for up to 10 days. After that 10 days, you will have a hearing. All parties will be present. You will be put on the stand to testify as to what the abuse was. The accused will have a chance to counter that. The judge at that time will make a decision on whether the order is entered for one day, two days, or up to a year. The court, in that order, can also establish what the temporary or living arrangements of the children will be. They can also order some temporary child support. So if you feel that you are in danger, the first step is to the court, and the second step is to an attorney to get you out of that situation. If you are a victim of domestic violence, whether you'll be a man or whether you'll be a woman, the courts of North Carolina afford you protection. You can obtain what is called a 50B, which is a domestic violence restraining order. That's an order here in North Carolina that's meant to protect you from an abusive family member or spouse. The way that you do that is you contact the clerk of court. They will help you file the paper work necessary to obtain a temporary restraining order.
Now, these are not for getting someone kicked out of the house or "I want to get custody of the children." These are if you have been assaulted. These are if you have been threatened to put in immediate, serious bodily harm, if you have been stalked by a family member or spouse. They're here to protect you. The court, if they make a finding that you are in need of support, will enter a temporary order granting you protection for up to 10 days. After that 10 days, you will have a hearing. All parties will be present. You will be put on the stand to testify as to what the abuse was. The accused will have a chance to counter that.
The judge at that time will make a decision on whether the order is entered for one day, two days, or up to a year. The court, in that order, can also establish what the temporary or living arrangements of the children will be. They can also order some temporary child support. So if you feel that you are in danger, the first step is to the court, and the second step is to an attorney to get you out of that situation.
