Should Rajat Gupta Take The Stand?
May 31 (Bloomberg Law) -- Richard Holwell, founding partner at Holwell Shuster & Goldberg LLP, talks with Bloomberg Law's Lee Pacchia about whether Goldman Sachs board member Rajat Gupta should take the witness stand in his own defense at his trial for insider trading. Prior to leaving the bench, Richard presided in Manhattan federal court over the insider trading trial of Galleon Group co-founder Raj Rajaratnam. Richard notes that the decision on whether or not clients should take the stand is one of the most difficult choices facing criminal defense attorneys and that he has rarely seen defendants doing so help their case. Richard also comments on whether Rajaratnam could have avoided conviction if he took the stand in his own trial.

8:38 - GUPTA/Reed Albergotti -- 052112hubamgupta In pursuing the conviction of insider trader Raj Rajaratnam, Reed Brodsky's tenacious style led jurors to nickname the 5-feet-9-inch prosecutor "Napoleon." Now, the 42-year-old lawyer, who left private practice eight years ago to join the US Attorney's office, is hoping the high-profile trial of Rajat Gupta, an ex-director at Goldman Sachs accused of insider trading, doesn't become his Waterloo. Mr. Gupta has pleaded not guilty to charges of conspiracy and securities fraud. The 63-year-old Mr. Gupta, the onetime head of consulting firm McKinsey & Co. and a board member of several top corporations, is by far the biggest name to face trial on insider--trading charges in a recent government sweep that has spanned several years.

A federal jury on Friday convicted Rajat Gupta, the Indian-American business icon who strode the US corporate world and moved with the country's high and mighty, of insider trading in a case that illustrated greed, guts, and glory in America's most successful immigrant community. Government Set To Rest in Rajat Gupta Trial
Prosecutors in the insider-trading trial of Rajat Gupta sought to tie together their case for jurors Thursday by condensing a hodgepodge of phone records, trading documents and witness testimony into a concise pattern of events. Mr. Gupta is accused of passing inside information to Galleon Group hedge-fund founder Raj Rajaratnam, who was convicted of insider trading last year and sentenced to 11 years in prison. After the prosecution rests Friday, defense attorneys are expected to promptly begin telling their side of the story. They have argued that the case against Mr. Gupta is almost entirely circumstantial and that the government is prosecuting the wrong man.

The defense lawyer for a former Goldman Sachs board member accused of insider trading notified the judge on Sunday that his client will not testify at his trial. Attorney Gary Naftalis sent a letter to Manhattan federal court judge Jed Rakoff saying that Rajat Gupta "will not be a witness on his own behalf in the defense case."

Ex-Goldman Director, Rajat Gupta, Faces US Jury in Insider Case
The insider-trading trial of former Goldman Sachs board member Rajat Gupta, who is accused of spilling secrets about the investment bank, began on Monday with the government saying it would call a former top Goldman banker and a current board member as two of its first witnesses. Gupta is accused of leaking stock secrets to Galleon Group hedge fund founder Raj Rajaratnam, his friend and business associate. Rajaratnam was convicted of insider trading last year and is now in prison. Jury selection started Monday morning in a Manhattan federal court before a US District, who expects the trial to last about three weeks. Goldman could play a key role at the trial. One of the government's core allegations is that Gupta tipped Rajaratnam to a $5 billion investment by Warren Buffett's Berkshire Hathaway in Goldman Sachs Group during the 2008 financial crisis and Goldman's surprise fourth-quarter loss that year. The bank hasn't been charged with any wrongdoing in connection with the case. Gupta joined Goldman's board in 2006 and left in May 2010, seven months after Rajaratnam's arrest. His lawyer has touted Gupta's charity, particularly his work to combat AIDS, malaria and tuberculosis, to rebut any possible government argument that he was motivated by money. Gupta's lawyer fought unsuccessfully to exclude three wiretaps between Rajaratnam and two traders that could implicate Gupta, but the judge said his ruling wasn't final.

The US regulator's civil proceedings against former McKinsey & Co managing partner Rajat K Gupta has no direct impact on the daily operations at New Silk Route Partners, the $1.4 billion private equity firm he had co-founded, a senior official of the PE firm told VCCircle in an interview. "It was very clear from the beginning that Rajat is the chairman of the fund. As far as the day-to-day analyses of the companies are concerned, Rajat was not involved.
