Lobby şirketlerini harekete geçiren bu reform, mentollü ve ince sigaraları da yasaklamayı öngörüyor. Basına sızan bilgilere göre, tütün devi Philipp Morris projenin önüne geçmek için yoğun lobicilik çalışması yürüttü. Son bir yıl içinde 161 lobici 230 Avrupa milletvekili ile görüştü. Bunların birçoğu Karl-Heinz Florenz gibi Merkez-Sağ Avrupa milletvekilleri. Durumu değerlendiren Florenz "Uzun yıllardır Avrupa Parlamentosu'ndayım ancak hiç bir zaman buna benzer bir baskı görmedim. Kullanılan yöntemler kafa karıştırıcı." dedi. Birçok Avrupa milletvekiline posta aracılığı ile hediyeler gönderildi. Yeşiller Grubu Avrupa Parlamentosu Başkanı'na bir mektup yazarak uygun olmayan davranışların gözden geçirilmesini istedi. Avrupa milletvekili Carl Schlyter görüşmelerin şeffaf olmasına önem verilmesi gerektiğini söyledi: "Kurallara uyulduğundan emin olmak için Avrupa Parlamentosu başkanına bir mektup yazdık. Kurallar gereği ihtiyaç olmadığı sürece tütün endüstrisi yetkilileri ile görüşülmemesi gerekiyor. Bunun gerçekleşmesi halinde şeffaflık gerekiyor." Adı yolsuzluğa karışan eski AB Komisyonu'nun tüketici ve sağlıktan sorumlu üyesi John Dalli geçtiğimiz yıl istifa etmek zorunda kalmıştı. Kimi Sivil toplum örgütleri haksızlığa uğradığını belirtti: "Suçlaramaların tek amacı direktifi 2014 seçimlerinden sonraya geciktirmekti.
