Law Prof: Why Discharging Student Debt in Bankruptcy is Good for Lenders
Aug. 22 (Bloomberg Law) -- If law school graduates were able to discharge in bankruptcy court their student loans from private lenders -- something Congress has prohibited since 2005 -- it might be good for the lenders and the profession, according to Steven J. Harper, an adjunct professor at Northwestern University School of Law. Banks would be less inclined to lend to students who aren't serious about becoming lawyers, and fewer people would go to law school without thinking through their career plans, he tells Bloomberg Law's Lee Pacchia.

Stockton, Calif., officially filed for Chapter 9 protection on Thursday, making it the largest--ever US city to file for bankruptcy. Stockton officials said late Thursday that the Northern California city had filed a petition for Chapter 9 bankruptcy with a Sacramento federal court. In a statement, Stockton Mayor Ann Johnston said, "We are extremely disappointed that we have been unable to avoid bankruptcy," but added the city had to enter bankruptcy "to get our fiscal house in order."

Default: The Student Loan Documentary is a 27 min. long documentary chronicling the stories of borrowers from different backgrounds affected by the student lending industry and their struggles to change the system.
No matter when their loans were taken, many borrowers now find themselves in a paralyzing predicament of repaying two, three or multiple times the original amount borrowed, with no bankruptcy protection, no cap on fees and penalties and no recourse under the law. The consequences are dire, with stories of borrowers in financial and emotional ruin.
While the media has focused on the disaster that sub-prime mortgages have turned out to be, only superficial attention has been given to financial giants which have been profiting by approving loans to low-income students with variable interest rates up to 25%.
As The National Consumer Law Center concluded in their March 2008 report titled “Paying The Price: The High Cost of Private Student Loans and the Dangers for Student Borrowers”, there are ominous signs that “the student loan market is headed for the same fate as the subprime mortgage industry .”

A glimpse of what we've been working on over the last few weeks.
The documentary is about the current global financial crisis and how it's effecting American people, loss of homes, jobs, businesses & pensions. Whilst in the States we spoke to many people, economists and everyday Americans alike and there's alot of disillusionment with the current economic instability and fears that the worst is yet to come. We also look at what's happening in the world... how the globalised world is so connected that one countries bankruptcy effects all. It's pretty political but the main thing is, people are beginning to demand change for a system that looks after the majority instead of an elite few.
