The "Copyright Clause" states that Congress shall have the power "To promote the Progress of Science and useful Arts, by securing for limited Times to Authors and Inventors the exclusive Right to their respective Writings and Discoveries." Does our current system live up to this? The world of Intellectual Property is very important; many of our greatest inventions, books, and media rely upon it. Both the copyright system and the patent system have fallen behind. There are over 700000 patent applications waiting to be approved. This means that there are many inventors waiting on the USPTO to release their product. Congress created the America Invents Act to fix these problems. Is its first-to-file provision Constitutional? Has it been good for the country? Meanwhile, copyright holders are behind in a very different way. As you likely know, piracy is everywhere on the internet. If it exists, it is probably uploaded somewhere. Under current law, pirates always seem one step ahead. The History and Politics of Policing Intellectual Property - Adrian Johns
This Cultural Policy Center workshop was recorded March 29, 2011. Presented by Adrian Johns, Professor in the Department of History, Chair of the Committee on Conceptual and Historical Studies of Science, and author of Piracy: The Intellectual Property Wars from Gutenberg to Gates. Intellectual property has become a fundamental bone of contention in today's information culture. But the arguments that have raged around the concept have been at least partly misdirected. They have focused on doctrines, principles, laws and treaties - and have failed to see IP as a matter of practical policing. In fact, over the last generation a global industry has developed, devoted precisely to the policing of this contentious property. Many of our fiercest debates are sparked by the practices of this industry and revolve around the politics of those practices. I want to show why this is so. I shall seek to place the intellectual-property police in a long-term historical context, indicating how it grew to its present prominence and what we should do about it today.
