Ratification is a principal's approval of an act of its agent where the agent lacked authority to legally bind the principal. The term applies to private contract law, international treaties, and constitutionals in federations such as the United States and Canada.

Private law

In contract law, the need for ratification can arise in two ways: Where the agent attempts to bind the principal despite lacking the authority to do so, and where the principal authorizes the agent to make an agreement, but reserves the right to approve it. An example of the first situation is where an employee not normally responsible for procuring supplies contracts to do so on the employer's behalf. The employer's choice on discovering the contract is to ratify it or to repudiate it.

The other situation is common in trade union collective bargaining agreements. The Union authorizes one or more people to negotiate and sign an agreement with management, but the agreement does not become legally binding until the union members ratify the agreement. If they do not approve it, the agreement is of no effect, and negotiations resume.

Ratification of an international treaty

The ratification of international treaties is accomplished by filing instruments of ratification as provided for in the treaty. In most democracies, the legislature authorizes the government to ratify treaties through standard legislative procedures (i.e., passing a bill).

In the UK, treaty ratification is a Royal Prerogative, exercised by Her Majesty's Government; however, by convention called the Ponsonby Rule, treaties are usually placed before parliament for 21 days before ratification.

In the US, the treaty power is a coordinated effort between the Executive branch and the Senate. The President may form and negotiate a treaty, but the treaty must be advised and consented to by a two-thirds vote in the Senate. Only after the Senate approves the treaty can the President ratify it. Once a treaty is ratified, it becomes binding on all the states under the Supremacy Clause. While the United States House of Representatives does not vote on it at all, the requirement for Senate advice and consent to ratification makes it considerably more difficult in the US than in other democratic republics to rally enough political support for international treaties. Also, if implementation of the treaty requires the expenditure of funds, the House of Representatives may be able to block, or at least impede, such implementation by refusing to vote for the appropriation of the necessary funds.

In the US, the President usually submits a treaty to the Senate Foreign Relations Committee (SFRC) along with an accompanying resolution of ratification or accession. If the treaty and resolution receive favorable committee consideration (a committee vote in favor of ratification or accession) the treaty is then forwarded to the floor of the full U.S. Senate for such a vote. The treaty or legislation does not apply until it has been ratified. A multilateral agreement may provide that it will take effect upon its ratification by less than all of the signatories. Even though such a treaty takes effect, it does not apply to signatories that have not ratified it. Accession has the same legal effect as ratification. Accession is a synonym for ratification for treaties already negotiated and signed by other states. An example of a treaty to which the U.S. Senate did not advise and consent to ratification is the Treaty of Versailles, which was part of the resolution of the First World War.

Ratification of the European Constitution

The process for ratifying the Treaty establishing a Constitution for Europe—a proposed constitutional document for the European Union (EU)—varied from country to country; seven countries were intending to hold binding referendums to determine the outcome, sixteen would decide by parliamentary vote and two countries opted for parliamentary approval advised by an advisory referendum. To take full effect, the constitution should have been ratified by all the member states of the EU as well as the European Parliament. The constitution was ratified by the European Parliament and sixteen member states (based on the parliaments of fourteen member states, and referendums in two others, Spain and Luxembourg). However, referendums first in France (on 29 May 2005) and then in the Netherlands (on 1 June 2005) rejected the constitution. After some minor modifications, such as dropping the label 'constitution' and references to the flag, the text was adopted as the Treaty of Lisbon.

Ratification of the Treaty of Lisbon took place on November 3, 2009 with the signature of the Czech republic. This happened after the constitutional court of the Czech republic found the Lisbon treaty to be compatible with the Czech constitution.

Ratification of a constitution

Federations usually require the support of both the federal government and some given percentage of the constituent governments for amendments to the federal constitution to take effect.

Ratification of the United States Constitution

Article Seven of the constitution of the United States describes the process by which the entire document was to become effective. It required that conventions of nine of the thirteen original States ratify the constitution. Once word was received that the ninth state had ratified the constitution—New Hampshire, June 21, 1788 - a timetable was set for the start of operations under the Constitution, and on March 4, 1789, the government under the Constitution began operations.

Percy Romeo Miller, Jr. (born August 19, 1989), better known by his stage name Romeo (previously Lil' Romeo), is an American rapper, actor, basketball player, entrepreneur, and model. As a rap musician, Miller has released three studio albums and two compilation albums.

Early life

Romeo Miller was born in New Orleans, Louisiana. He is the son of rapper and entrepreneur Master P and former rapper Sonya C. He is the nephew of rappers C-Murder and Silkk the Shocker and the brother of singer Cymphonique. Romeo was signed to No Limit at the age of 5 after he wrote a rap to his dad.

Music career

''Lil' Romeo'' (2001)

He then released his debut album 7 years later titled after his original alias ''Lil' Romeo''. This offering contained the hit single "My Baby" that charted No. 1 on the Hot R&B;/Hip-hop Singles. The album peaked at No. 6 on the Billboard 200 and No. 5 on the Top R&B;/Hip-Hop Albums,selling more than 500,000 copies the first week out making it certified Gold. The album is now certified certified Platinum by the RIAA for the sales of 1,300,000. Also in 2001 he was featured on his uncle Silkk the Shocker's remix single of "That's Kool", which was also featured on his own album.

''Game Time'' (2002–2003)

In 2002, a year later after his debut album, Miller put out his second studio album, ''Game Time''. It peaked at No. 33 on the Billboard 200 and No. 10 on the Top R&B;/Hip-Hop Albums selling close to a 110,000 copies the first week . It spawned the billboard charting single "2-Way" that charted to No. 66 Hot R&B;/Hip-Hop Songs. It also spawned the album second single "True Love" which charted at No. 16 under the Hot 100 Singles. Though not as successful on the charts as Miller's debut album It still was successful in sales certified 2x Platinum, selling 2,430,785 copies making this Miller's highest selling album.

''Romeoland'' (2004–2007)

In 2004, miller released his third studio album ''Romeoland,'' which was not as successful as his last two albums selling 50,000 the first week, but still managed to be certified Gold selling over 459,000 copies in the United States. It was also the last studio album to feature Miller billed as Lil' Romeo. In 2005 Romeo along with his brother Valentino Miller who was known as Young V at that time and their three cousins C-Los, Lil' D & Willie J formed the group Rich Boyz & released their debut album ''Young Ballers: The Hood Been Good to Us''. In 2006 Miller released a compilation album entitled ''Greatest Hits'' the album featured all of his hit songs when Miller was billed as Lil' Romeo. In 2006 Romeo released the two albums ''Lottery'' & ''God's Gift'' on the new label owned by himself and his father Master P, entitled Guttar Music. ''Lottery'' served as Millers first independent release while ''God's Gift'' served as a soundtrack to a movie with the same name. ''God's Gift'' was also Miller's first album to use the name Romeo and to have explicit language. The two albums were also known for containing Miller's single "U Can't Shine Like Me" which was a direct response to Bow Wow, who fans thought dissed Miller in his song "Fresh Azimiz". In 2007 Miller released a collaboration album with his father Master P titled ''Hip Hop History'' it sold 32,000 records worldwide.

''Intelligent Hoodlum'' (2008–present)

In 2008 Miller stated he was working on his fourth studio album entitled ''Gumbo Station''. On June 17, 2008 Miller released the first single from the album which was "Get Low wit It" which featured Akon & his brother Valentino Miller it failed to gain success on the Billboard charts.

On March 3, 2009 Romeo released a compilation entitled ''Get Low LP'' that contained songs that were supposed to be on ''Gumbo Station''. It debuted at No. 149 on the Billboard 200 and as of May 5, 2009 it has sold over 20,000 copies. In 2010 Romeo confirmed that he was still working on his fourth studio album but he changed the name of the album to ''The College Boy''. Romeo then announced that the title of the album was going to be ''I Am No Limit''.

On January 19, 2010 Romeo released the first promotional single for the album entitled "Tell Me A Million Times" that featured Tempo. Then on January 26, 2010 Romeo released the second promotional single for the album entitled "Ice Cream Man Jr." which was a tribute to his dad Master P. On February 16, 2010 Miller released his debut mixtape ''Patience Is A Virtue'' to promote the album. Then on March 2, 2010 Romeo released two EPs to promote the album which were the ''Famous Girl'' & ''Monster/Practice''. Also In 2010 Miller debuted his newly founded record label The Next Generation Entertainment with his new group the College Boyys. They released a collaboration album on May 25, 2010 entitled ''Spring Break'' which sold over 200,000 copies worldwide. Miller also on this day released three singles which were "You" that featured D'Anna & Lil Twist, "She Bad" that featured Millers cousins Lil' D & Black Don & "They Dont Know" but all of the singles failed to reach the charts. Romeo also performed at the 2010 Hip Hop Honors along with his brother Valentino Miller, his cousins Lil' D & Black Don, & his uncle Silkk The Shocker, along with Trina, Gucci Mane & Mystikal to honor his dad Master P & No Limit Records. In late 2010 Romeo relaunched No Limit as No Limit Forever Romeo also confirmed that he has changed the name of the album from ''I Am No Limit'' to ''Intelligent Hoodlum''.

In 2011 It was confirmed that Romeo is going on a new tour with his dad Master P & his uncle Silkk the Shocker the tour is entitled ”No Limit Forever International". On January 11, 2011 Romeo released his EP ''Dont Push Me''. On May 3, 2011 Romeo released the first official single from ''Intelligent Hoodlum'' which is "Famous Girl (Remix)" which is really the mastered version of the original it still features appearances from Sean Kingston & Miller's cousin Black Don. On August 19, 2011 Romeo released his ''I Am No Limit'' mixtape which was originally supposed to be his fourth studio album before it got changed but Miller just decided it would be best to just release it as a mixtape for his fans.

In 2012 Romeo formed a new group called RESQ3 they released their first single "The Only One" & supposed to be releasing a album in some time. Even though Romeo has created his new group he is still working & planning on releasing his fourth studio album ''Intelligent Hoodlum''. On April 12, 2012 he released his first single from the album entitled "Hug Me Forever" which features his brother Valentino & his artist Kyros & has already shot the official music video for it.

Other ventures

Acting career

Miller started his acting career with a cameo appearance in the 2001 film ''Max Keeble's Big Move'', as himself. He later co-starred with Jessica Alba, Mekhi Phifer and Zachary Isaiah Williams in the film ''Honey'' (2003). In ''Honey'', his character was Benny, a young boy looking for a break. Also in 2003, he voiced himself on an episode of the animated series, ''Static Shock'', to which he had performed the theme song. He co-starred with his dad in a movie called ''Uncle P'' in 2005. He also starred in another movie with Zachary Isaiah Williams, ''God's Gift'', which came out in 2006. Recently, he made a cameo appearance, as himself, in ''Ned's Declassified School Survival Guide'' as a rapping coach for the teachers. Then in 2007 he starred in film ''ASL'' as himself, Rome, alongside Forrest Lipton and Zachary Isaiah Williams who played the young Romeo; Lil Romey and had also previously starred with Romeo in ''Honey'' and Nickelodeon's ''Romeo!''. He guest-starred as a rapper accused of murder in the 2010 CBS series, ''The Defenders'' and acted in the highly successful film, ''Jumping the Broom'', released in May 2011. In 2011, he also starred in TV commercials for McDonald's & ICDC Colleges.

Fashion designer

Romeo was invited, in the summer of 2006, to the Reebok-sponsored ABCD Camp, which is considered the premier basketball camp in the United States. The Teaneck, New Jersey-based ABCD Camp is an invitation-only basketball showcase previously attended by high-profile players including Kobe Bryant, Stephon Marbury, Tracy McGrady, LeBron James and Carmelo Anthony. Surrounded by future NBA players such as O. J. Mayo, Derrick Rose, and Kevin Love, Miller looked out of place and averaged less than 2 points a game throughout the camp. ''The Wall Street Journal'' made an article on March 8, entitled "A Hot Prospect," cites Sonny Vaccaro, the longtime director of the ABCD Camp, as explaining, "he invited Romeo Miller to the 2006 camp, primarily as a favor to Percy Miller, whom he knew from the club basketball circuit." In the article, Vaccaro indicated, "If you're looking for the profile of an athlete who plays basketball at USC, he's not it."

On April 13, 2007, Miller verbally committed to the University of Southern California (USC) and signed a letter of intent on November 19, 2007.

Miller, a 5'11" point guard, was a four year starter at Beverly Hills High School. As a junior during the 2005–2006 high school season he averaged 13.9 points and 5.6 assists per game. As a senior during the 2006–2007 high school season he averaged 8.6 points and 9.0 assists per game.

According to ''The Wall Street Journal'', it appears the decision to grant Miller a full scholarship at USC was largely driven by his relationship with friend and teammate Demar DeRozan, the 6-foot-6 All-American forward who was rated as the number five prospect in the country on Scout.com. ''The Wall Street Journal'' reported Coach Tim Floyd as saying, "Last April...Percy Miller called while driving both players from a tournament in Fayetteville, Ark...Percy Miller said 'Demar and Romeo are ready to make their decision, and would you like to have them both on scholarship?'...'I said absolutely.'" Miller and DeRozan began playing in the 2008–2009 season.

Miller had an atrocious career at USC. In his two seasons as a Trojan, he played a total of 19 minutes in 9 games and scored a total of 5 points.

Modeling career

On December 27 Romeo modeled for a new 2011 calendar. On April 10, 2011 Miller modeled for the April issue of ''TROIX'' magazine. On April 12, 2011 Miller modeled again for some new pictures. He also modeled with the singer-songwriter Chynna Terrell.

Dancing with the Stars

After originally withdrawing from season two of ''Dancing with the Stars'' due to an injury, Romeo competed in season 12. He was partnered with professional dancer, Chelsie Hightower. They were eliminated from the show on May 10, 2011 and finished in the Top 5, one week before the semi-final.

Personal life

Miller attended Beverly Hills High School in Beverly Hills, California. Romeo sponsors "Loco Tonic", an energy drink he mentions in his newer songs. In 2008, Romeo was ranked No. 18 in the most fit men in the world. Miller was born on Aug. 19, 1989 in New Orleans, La. He is the oldest of seven children from parents Percy, Sr. and Sonya Miller. His father is a business entrepreneur and musician. His father also shares a passion for the game of basketball and signed contracts with the Charlotte Hornets and Toronto Raptors. Percy wears the No. 15 because that is the number his father wore in high school. Miller also believes in giving back to the community and is involved in a variety for charity endeavors and in 2008 along with his father received the key to the city in Memphis in recognition of their "Let the Kids Grow" educational program.

:''For other persons with similar names, see Samuel Davis (disambiguation) and Sammy Davis (disambiguation). Sam Davis (1842–1863) is called the ''Boy Hero of the Confederacy''. He was born in Rutherford County, Tennessee. He served in various combat roles in the Confederate army in 1861 through 1863 during the American Civil War. As a Confederate courier, he was captured on November 19, 1863, and upon suspicion of espionage was executed by the Union Army after a captivity of only seven days.

Youth and Confederate service

Davis was educated at the Western Military Institute, now Montgomery Bell Academy, which he attended from 1860–1861. While there, he came under the influence of headmaster and future Confederate General Bushrod Johnson.

He was recruited by Confederate scout forces early in the Civil War. He signed up as a private in the First Tennessee Volunteer Infantry in 1861 and his regiment marched off to war first at Cheat Mountain, next in the Shenandoah Valley, then at Shiloh and Perryville.

Wounded slightly at Shiloh, Davis suffered a more severe wound at Perryville; after recovering from the latter casualty he took on very active service as a courier for Coleman's Scouts.

Capture and execution

He was captured near Minor Hill, Tennessee, on November 20, 1863, wearing a makeshift Confederate uniform and in possession of Union battle plans. He would not give the name of who gave him the items. For this reason, he was arrested as a spy, and was seen as ineligible for the privileges of a prisoner of war. Instead, he was sentenced by a drumhead military court to die by hanging unless he was willing to divulge the name of his contact. He is purported to have said, "I would rather die a thousand deaths than betray a friend." Another famous quote, reminiscent of Nathan Hale, was, ''"If I had a thousand lives to live, I would give them all rather than betray a friend or the confidence of my informer.''

Davis wrote a letter to his mother before the execution. "''Dear mother. O how painful it is to write you! I have got to die to-morrow --- to be hanged by the Federals. Mother, do not grieve for me. I must bid you good-bye forevermore. Mother, I do not fear to die. Give my love to all.''" There was a postscript for his father, too. ''"Father, you can send after my remains if you want to do so. They will be at Pulaski, Tenn. I will leave some things with the hotel keeper for you."

He was hanged by Union forces in Pulaski, Tennessee, on November 27, 1863 on his 21st birthday. As he was trundled along to the hanging site atop his own coffin, Union soldiers alongside the bumpy wagon road shouted out their entreaties for his cooperation, lest they have to watch the grim execution. Supposedly the officer in charge of the execution was discomfited by Davis' youth and calm demeanor and had trouble carrying out his orders. Davis is alleged to have said to him, "Officer, I did my duty. Now, you do yours."

Legacy

Davis' story, and its obvious parallel to that of Nathan Hale during the American Revolution, became a rallying point for the Southern cause in the waning days of the Confederacy.

Postbellum, he was commonly spoken of by clergy as well as laity as a Christ figure.

His boyhood home is preserved in Smyrna as a museum, and the spot of his hanging in Pulaski is likewise marked by a monument and a small museum which, , was open by appointment and request only. A statue of Sam Davis was erected on the grounds of the Tennessee state capitol at Nashville

Jan Pieter "Jan Peter" Balkenende () (born 7 May 1956) is a Dutch politician of the party Christian Democratic Appeal (CDA).

He was the Prime Minister of the Netherlands from 22 July 2002 until 14 October 2010, having led four coalition governments, cabinets Balkenende I, II, III and IV, none of which served a full four-year term.

On 9 June 2010, Balkenende resigned his position as party leader of the CDA as well as his seat in the newly elected Netherlands parliament, taking political responsibility for the CDA's disappointing election results in the June 2010 Dutch general election.

He is now a Partner at professional services firm Ernst & Young.

Personal life

Jan Peter Balkenende, legally Jan Pieter Balkenende, was born in the village of Biezelinge near the town Kapelle in the Netherlands. His father, Jan Pieter Balkenende, was a cereal grains merchant and his mother, Thona Johanna Sandee, was a teacher.

Balkenende went to a Protestant primary school in Kapelle. He attended secondary school at the "Christian Lyceum for Zeeland" in Goes, graduating in 1974. He studied at the Vrije Universiteit in Amsterdam, where he received an M.A. degree in history in 1980, an LL.M. degree in Dutch Law in 1982, and finally a PhD degree in Law in 1992. Balkenende resides with his wife, Bianca Hoogendijk, and his daughter, Amelie, in Capelle aan den IJssel, a suburb of Rotterdam. During his tenure as Prime Minister, he rented an apartment in The Hague, rather than live in the Catshuis, the formal residency of the Prime Minister.

He is a devout member of the Calvinist Protestant Church in the Netherlands.

In 2004, during his second cabinet, Balkenende was diagnosed with necrotizing fasciitis. He was treated through surgical debridement and made a full recovery after several weeks in hospital.

Political career

Early political career

He began his career on the staff of the research institute of the CDA and as a city councilman in Amstelveen. In that period he received his PhD with a thesis on "Administrative regulation and social organisations" (Overheidsregelgeving en maatschappelijke organisaties), a work strongly inspired by the Communitarian ideas of Amitai Etzioni. He later became an extraordinary professor of Christian-Social Thought at the Free University of Amsterdam.

Balkenende first entered the House of Representatives on 19 May 1998 while the CDA was in opposition. He became the CDA's financial spokesman and was also involved with social affairs, justice, and domestic affairs. In this role he advocated a substantial reduction of the national debt and sound public finances.

He was elected Chairman of the CDA parliamentary fraction on 1 October 2001, succeeding Jaap de Hoop Scheffer. On 3 November 2001, he was appointed lijsttrekker for the CDA in the tumultuous May 2002 parliamentary elections. These elections restored the CDA's former position as the largest political party in the Dutch parliament.

Prime Minister

Balkenende has been prime minister of four successive cabinets.

Balkenende I

On 4 July 2002 Queen Beatrix asked Balkenende to form a new government after the general elections following the resignation of Prime Minister Wim Kok. This cabinet is known as Balkenende I. The coalition cabinet included the Pim Fortuyn List (LPF) party, whose leader (Pim Fortuyn) was assassinated just days before the election. It collapsed after just 86 days in office because of internal conflicts within the LPF that destabilised the government.

Balkenende II

After early elections in 2003 Balkenende formed his second government with: Christian Democratic Appeal (CDA), the liberal People's Party for Freedom and Democracy (VVD) and the progressive liberal D66. Once again leader of a centre-right coalition, Balkenende's policies centred around reform of the Dutch public services, reducing crime, a tough immigration policy and historically large cuts in public spending. The measures gave rise to large public anger and bad results in opinion polls for his CDA party. While his party remained the largest Dutch delegation in the European Parliament after the European Elections, beating the general expectation of a huge loss in parliamentary seats, the party suffered strong losses during Dutch municipal elections of 2006, losing their position as the largest party in many municipalities. Despite his unpopularity among Dutch voters (polls in 2006 showed that only 26–33% of the voters had confidence in him as prime minister), his position as leader of the CDA remained stable. In the beginning of 2006, some CDA members tried to replace Balkenende as leader with minister Cees Veerman. Veerman did not accept this and offered his support to Balkenende. Balkenende's popularity recovered since then, surpassing that of his main competitor Wouter Bos in the autumn of 2006. By then, 53% preferred Balkenende as Prime Minister while 40% preferred Bos. This switch in public opinion is sometimes explained by the steady recovery of the Dutch economy during the last year of his administration, combined with declining confidence in Bos as a good alternative for the position of prime-minister.

On 1 July 2004 Balkenende took up the rotating presidency of the European Union.

Balkenende III

On 30 June 2006 D66, the smallest coalition party, withdrew its support of the government over the way immigration minister Rita Verdonk had handled the crisis around the naturalization of Dutch MP Ayaan Hirsi Ali. Balkenende resigned for the second time as Prime Minister, announced early elections and presented his third government a week later. This cabinet, formed of a minority coalition of CDA and VVD, stayed in office until the elections of 22 November 2006.

Balkenende IV

Though his old coalition partners VVD and D66 fared badly in the parliamentary elections of 2006, Balkenende managed to defend the dominant position of his CDA. Needing alternative coalition partners to form a new majority government, he formed a social-Christian coalition with the Dutch Labour Party (PVDA) and the orthodox-Protestant ChristianUnion. This Fourth Balkenende cabinet is the current coalition cabinet of the Netherlands, formed by Balkenende, who was appointed ''formateur'' by Queen Beatrix on 9 February 2007. His cabinet was announced on 13 February and was scheduled to be in office until 2011, but it fell in the early morning of 20 February 2010 as the result of disagreement between the majority of the parliament and the coalition partners CDA and PvdA over the extension of the Dutch ISAF-mission in Afghanistan. In contrast to the formation of a new caretaker cabinet with full responsibility (Balkenende III after the fall of Balkenende II), Balkenende IV continued as a demissionary cabinet, a caretaker cabinet with limited responsibility.

2010 Election and resignation

Despite serious criticism by former prime ministers from the CDA, Balkenende was the Christian Democratic Appeal ''Lijsttrekker'' for the Dutch general election of 2010. Balkenende raised mild controversy during his campaign for the 2010 Dutch elections. While appearing in a television show, Balkenende was asked by a female presenter what parties he would most likely form a coalition with. Balkenende first gave evasive answers, then when asked again by the presenter, responded saying "U kijkt zo lief" (English: You have such a sweet look in your eyes). The comment was regarded as sexist and criticized by several people, including Opzij chief-editor Margriet van der Linden and GroenLinks leader Femke Halsema (who stated that "[the prime minister] deserves a knee to the groin" (in Dutch: "een knietje verdient")). Balkenende apologized for the comment later.

Other issues

On 4 June 2005, the Belgian Minister of Foreign Affairs Karel De Gucht said in the Flemish newspaper ''Het Laatste Nieuws'' (The Latest News) that "Balkenende is a mix of Harry Potter and a petty rigid bourgeois mentality". This comparison caused a small diplomatic controversy, and the Belgian ambassador had to apologise to Ben Bot, the Dutch Minister of Foreign Affairs. Retired Deputy Prime Minister Hans Wiegel commented he preferred Harry Potter to the Manneken Pis.

Balkenende has a close relationship with the Dutch people from Suriname and the Netherlands Antilles. He has visited several Keti Koti celebrations in recent years.

Balkenende has also been accused of breaching International Law by allowing asylum seekers to be placed on barges in Rotterdam Harbour and he has also been accused by Dutch and Dutch-born citizens in Australia and Canada of disregarding their Dutch heritage through a process, illegal in International law, of no longer regarding Dutch emigrants to places such as Australia and New Zealand as being Dutch.
