We have and continue to handle many trademark infringement cases. To determine if it is a trademark infringement, the courts look at the following factors: 1. the strength of the mark; 2. the degree of similarity between the two marks; 3. the proximity of the products; 4. the likelihood that the prior owner will bridge the gap; 5. actual confusion; 6. defendant's good faith in adopting its own mark; 7. the quality of defendant's product; and, 8. the sophistication of the buyers. This is not intended to be an exhaustive list, but is merely a starting point. Furthermore, when evaluating the similarity of the marks, the sound, meaning and commercial impression of the marks are evaluated (see factor #2). The ultimate test is whether or not consumers are going to be confused. There are also additional provisions in the law to remedy § 43(a) Unfair Competition (15 USC § 1125(a)) - Under the Lanham act, unregistered marks are protected as well. And trade dress, etc. This provision has far reaching implications and has provided protection for restaurant formats, colors of products, sounds and smells. The snake man is Raymond Hoser. He also owns Snakebusters, Australia's BEST reptiles shows, displays and educational parties for kids and adults. Based in Melbourne, Victoria imitators across Australia have been trading on the snake man and his company's reputation to bootleg and infringe his trademarks in order to steal customers. This trademark infringement has included the highly illegal activity of taking out Google "adwords" to divert Snakeman's clients to their own inexperienced reptile handling enterprises. The adwords are triggered when the computer uses does a search for the trademark, like "snake man" or "snake buster" and instead finds themselves diverted to the bootlegger's trademark breach website. It is the equivalent of doing a search for "Rolls Royce" and being sent to "beaten up car wreck". Just this week, a serial trademark bootlegger had over 800 webpages removed from the web, all of which carried "backlinks" to his own bootlegger webpage, all of which had been erected for the sole purpose of usurping the (real) Snakeman's top position using SEO on search engine results from "Google" and the like. The message is clear, business and trademark owners need to be vigilant in protecting their IP, because there is no shortage of thieves who will unlawfully attempt to steal their clients.

The latest is a set of trademark lawsuits, brought over the iPad by a rival tablet computer company. The Shanghai trademark infringement lawsuit was brought by Shenzhen-based computer company Proview Technology. The firm alleges that it owns the iPad trademark in China, having registered rights to the name before Apple came out with its globally popular product. For its part, Apple does not dispute that Proview got to the "iPad" name first, but claims to have already purchased full rights to the use of the trademark in China. A similar case in Proview's home city of Shenzhen was decided in the firm's favor last December, and Apple is appealing to the Intermediate Court level. A Shanghai victory, though, would mean that Apple might have to stop selling—or at least face reduced profits—in one of its biggest Chinese markets. Following the Shenzhen case, Proview has launched a number of similar lawsuits in different regions, all seeking to get the iPad taken off of store shelves. One of Proview's lawyers, Xie Xianghui, said that the purpose of this, and the several similar suits pursued by the company, is just to stop the alleged infringements. Roc Nation initially only used their logo in association with the words Roc Nation but when they started promoting products with just the logo Volcom claims that created marketplace confusion.
