Senator Akaka reintroduces the Native Hawaiian Government Reorganization Act of 2011
US Senate Indian Affairs Committee Chairman Daniel K. Akaka (D-Hawaii) introduces the Native Hawaiian Government Reorganization Act of 2011. The bill would extend to Native Hawaiians the opportunity to build a government-to-government relationship with the United States, a right already enjoyed by 565 federally recognized tribes across the US mainland and in Alaska. The bill has the support of President Barack Obama and the US Departments of Justice and Interior, the American Bar Association, the National Congress of American Indians, the Alaska Federation of Natives, and groups throughout the Native Hawaiian community. 66 percent Hawaii residents support federal recognition for Native Hawaiians, including 82 percent of Native Hawaiians, according to a poll published by the Honolulu Advertiser in May 2010. Indian Self-Rule traces the history of white-Indian relations from nineteenth century treaties through the present, as tribal leaders, historians, teachers, and other Indians gather at a 1983 conference organized to reevaluate the significance of the Indian Reorganization Act of 1934. The experiences of the Flathead Nation of Montana, the Navajo Nation of the Southwest, and the Quinault people of the Olympic Peninsula illustrate some of the ways Indians have dealt with shifting demands imposed upon them, from allotment to reorganization to termination and relocation. The Miccosukee are a Native American tribe living in Florida. They are descendants of the Lower Chiaha, a Muskogee Creek tribe and have had centuries of relations with the Seminole but maintain a separate identity today, largely on linguistic grounds. Unlike the Creek-speaking Seminole, they speak the Mikasuki language, another of the Muskogean languages. Their original home was in the Tennessee Valley, where they were originally one with the Upper Chiaha, but they later migrated first to the Carolinas when the former migrated to northern Alabama, then to northern Florida during the 18th and 19th centuries, forming a major part of the Seminole tribe; they moved again to the Everglades after the Seminole Wars. During this period they mixed heavily with the Creek-speaking Seminoles, but many of them maintained their Mikasuki language. The tribe today occupies several reservations in southern Florida, principally the Miccosukee Indian Reservation. The tribe separated from the Seminole in the 1950s to become the Miccosukee Tribe of Indians of Florida; they were recognized by the state of Florida in 1957, and received federal recognition in 1962. Salazar and its effects on Indian tribes. In the decision, the Supreme Court held that the Indian Reorganization Act did not allow land to be placed into trust for a tribe that was not "now under Federal jurisdiction" referring to 1934, the date of enactment of the statute. While there are those who want to portray this decision and its ramifications solely as a "gaming" issue, let me assure everyone that it is much more than that. Land is an essential component of sovereignty for any government, including tribal governments. Not only does a land base help promote cultural preservation which is essential for the survival of a group of people, but it also affects the ability of a government to provide for its citizens.
