After the Justice Department advised that the Guantanamo Bay Detention Camp could be considered outside U.S. legal jurisdiction, the first twenty captives arrived at Guantanamo on January 11, 2002. After the Bush administration asserted that detainees were not entitled to any of the protections of the Geneva Conventions, the U.S. Supreme Court ruled in ''Hamdan v. Rumsfeld'' on June 29, 2006, that they were entitled to the minimal protections listed under Common Article 3 of the Geneva Conventions. Following this, on July 7, 2006, the Department of Defense issued an internal memo stating that prisoners would in the future be entitled to protection under Common Article 3. The detainees held as of June 2008 have been classified by the United States as "enemy combatants."
On January 22, 2009, the White House announced that President Barack Obama had signed an order to suspend the proceedings of the Guantanamo military commission for 120 days and that the detention facility would be shut down within the year. On January 29, 2009, a military judge at Guantanamo rejected the White House request in the case of Abd al-Rahim al-Nashiri, creating an unexpected challenge for the administration as it reviews how America puts Guantanamo detainees on trial.
On May 20, 2009, the United States Senate passed an amendment to the Supplemental Appropriations Act of 2009 (H.R. 2346) by a 90-6 vote to block funds needed for the transfer or release of prisoners held at the Guantanamo Bay detention camp.
President Obama issued a Presidential memorandum dated December 15, 2009, ordering the preparation of the Thomson Correctional Center, Thomson, Illinois so as to enable the transfer of Guantanamo prisoners there.
The Final Report of the Guantanamo Review Task Force dated January 22, 2010 published the results for the 240 detainees subject to the Review: 36 were the subject of active cases or investigations; 30 detainees from Yemen were designated for 'conditional detention' due to the security environment in Yemen; 126 detainees were approved for transfer; 48 detainees were determined 'too dangerous to transfer but not feasible for prosecution'. The Federation of American Scientists published a report entitled 'Enemy Combatant Detainees: Habeas Corpus Challenges in Federal Court'.
On Jan 7, 2011, President Obama signed the 2011 Defense Authorization Bill which contains provisions preventing the transfer of Guantanamo prisoners to the mainland or to other foreign countries, and thus effectively stops the closure of the detention facility. However he strongly objected to the clauses and stated that he would work with Congress to oppose the measures. U.S. Secretary of Defense Gates said during a testimony before the US Senate Armed Services Committee on February 17, 2011: “The prospects for closing Guantanamo as best I can tell are very, very low given very broad opposition to doing that here in the Congress.”
After the United Nations called unsuccessfully for the Guantanamo Bay detention camp to be closed, one judge observed 'America's idea of what is torture ... does not appear to coincide with that of most civilised nations'.
In April 2011, Wikileaks began publishing 779 secret files relating to prisoners in the Guantanamo Bay detention camp.
From the 1970s onwards, the Guantanamo Bay Naval Base was used to house Cuban and Haitian refugees intercepted on the high seas. In the 1990s, it held refugees who fled Haiti in Camp Bulkeley until United States District Court Judge Sterling Johnson Jr. declared the camp unconstitutional on June 8, 1993, and the last Haitian migrants departed in late 1995. In June 2005, the United States Department of Defense announced that a unit of defense contractor Halliburton would build a new $1 billion detention facility and security perimeter around the base.
Since October 7, 2001, when the current war in Afghanistan began, 775 detainees have been brought to Guantanamo. Of these, most have been released without charge or transferred to facilities in their home countries. The Department of Defense often referred to these prisoners as the "worst of the worst", but a 2003 memo by then Secretary of Defense Donald Rumsfeld says, "We need to stop populating Guantanamo Bay (GTMO) with low-level enemy combatants ... GTMO needs to serve as an [redacted] not a prison for Afghanistan."
Three have been convicted by military court of various charges: David Hicks was found guilty under retrospective legislation introduced in 2006 of providing material support for terrorism in 2001. Salim Hamdan accepted a position on Osama bin Laden's personal staff as a chauffeur. Ali al-Bahlul made a video celebrating the attack on the .
On September 22, 2004, ten prisoners were brought from Afghanistan.
In July 2005, 242 detainees were moved out of Guantanamo, including 173 that were released without charge, and 69 transferred to the governments of other countries, according to the U.S. Department of Defense.
By November 2005, 358 of the then-505 detainees held at Guantanamo Bay had Administrative Review Board hearings. Of these, 3% were granted and were awaiting release, 20% were to be transferred, 37% were to be further detained at Guantanamo, and no decision had been made in 40% of the cases.
The Center for Constitutional Rights has prepared a biography of some of the prisoners currently being held in Guantanamo Prison.
On February 11, 2008, the U.S. Department of Defense charged Khalid Sheikh Mohammed, Ramzi bin al-Shibh, Mustafa Ahmad al-Hawsawi, Ali Abd al-Aziz Ali and Walid Bin Attash for the September 11 attacks under the military commission system, as established under the Military Commissions Act of 2006.
On February 5, 2009, charges against Abd al-Rahim al-Nashiri were dropped without prejudice following an order signed by U.S. President Barack Obama to suspend trials for 120 days. Abd al-Rahim al-Nashiri was accused of renting a small boat connected with the USS Cole bombing. He is one of the detainees known to have been interrogated with waterboarding prior to his transfer at Guantanamo.
Camp Iguana is a much smaller, low-security compound, located about a kilometer from the main compound. In 2002 and 2003, it housed three detainees who were under 16 and was closed when they were flown home in January 2004. It was reopened in mid-2005 to house some of the 38 detainees who were determined by the Combatant Status Review Tribunals as no longer being "enemy combatants."
Camp X-Ray was a temporary detention facility that was closed in April 2002. Its prisoners were transferred to Camp Delta.
An Associated Press report indicates that a seventh camp, named Camp 7, is also a separate facility on the naval base. It is considered the highest-security jail on the base, and its location is classified.
On July 2, 2008, the ''International Herald Tribune'' revealed in an article that the U.S. military trainers who came to Guantánamo Bay in December 2002 had based an entire interrogation class on a chart copied directly from a 1957 Air Force study of Chinese Communist torture techniques used during the Korean War to obtain confessions, many of them false. The chart showed the effects of "coercive management techniques" for possible use on prisoners, including "sleep deprivation," "prolonged constraint" (also known as "stress positions"), and "exposure", all of which are imposed on almost all U.S. military personnel as part of standard initial training (but not in isolation, except for the minority who go to advanced courses). The 1957 article from which the chart was copied, written by Alfred D. Biderman, a sociologist then working for the Air Force, was entitled "Communist Attempts to Elicit False Confessions From Air Force Prisoners of War." Other techniques used by the Chinese Communists that were listed on the chart include "Semi-Starvation," "Exploitation of Wounds," and "Filthy, Infested Surroundings," along with their effects: "Makes Victim Dependent on Interrogator," "Weakens Mental and Physical Ability to Resist," and "Reduces Prisoner to 'Animal Level' Concerns." The only change made to the chart used at Guantánamo was an altered title.
One of the allegations of abuse at the camp is the abuse of the religion of the detainees. The U.S. government has claimed that they respect all religious and cultural sensitivities. However, prisoners released from the camp have alleged that abuse of religion including flushing the Qur'an down the toilet, defacing the Qur'an, writing comments and remarks on the Qur'an, tearing pages out of the Qur'an and denying detainees a copy of the Qur'an. These allegations were highlighted by Pakistani politician Imran Khan. Some of these abuses have been seen as emblematic of the whole military leadership's approach toward treatment of the prisoners while others argue that many abuses are performed and directed on an individual level with severe disciplinary repercussions if discovered. One of the justifications offered for the continued detention of Mesut Sen, during his Administrative Review Board hearing, was:
:"Emerging as a leader, the detainee has been leading the detainees around him in prayer. The detainees listen to him speak and follow his actions during prayer."
Red Cross inspectors and released detainees have alleged acts of torture, including sleep deprivation, beatings and locking in confined and cold cells. Human rights groups argue that indefinite detention constitutes torture.
The use of Guantánamo Bay as a military prison has drawn criticism from human rights organizations and others, who cite reports that detainees have been tortured or otherwise poorly treated. Supporters of the detention argue that trial review of detentions has never been afforded to prisoners of war, and that it is reasonable for enemy combatants to be detained until the cessation of hostilities.
The dental care of Guantanamo Bay detainees is good, according to the United States Department of Defense.
An Associated Press report claims that some detainees were turned over to the U.S. by Afghan tribesmen in return for cash bounties The first Denbeaux study reproduces copies of several of leaflets, flyers and posters the U.S. Government distributed to advertise the bounty program; some of which offered bounties of "millions of dollars."
Forced feeding accusations by hunger-striking detainees began in the fall of 2005: "Detainees said large feeding tubes were forcibly shoved up their noses and down into their stomachs, with guards using the same tubes from one patient to another. The detainees say no sedatives were provided during these procedures, which they allege took place in front of U.S. physicians, including the head of the prison hospital." "A hunger striking detainee at Guantánamo Bay wants a judge to order the removal of his feeding tube so he can be allowed to die, one of his lawyers has said." Within a few weeks, the Department of Defense "extended an invitation to United Nations Special Rapporteurs to visit detention facilities at Guantanamo Bay Naval Station." This was rejected by the U.N. considering the restrictions "that [the] three human rights officials invited to Guantánamo Bay wouldn't be allowed to conduct private interviews" with prisoners. Simultaneously, media reports ensued surrounding the question of prisoner treatment. "District Court Judge Gladys Kessler also ordered the U.S. government to give medical records going back a week before such feedings take place." In early November 2005, the U.S. suddenly accelerated, for unknown reasons, the rate of prisoner release, but this was unsustained.
In 2005, it was reported that sexual methods were allegedly used by female interrogators to break Muslim prisoners.
In a leaked 2007 cable, a State Department official requested an interview of a released Libyan national complaining of an arm disability and tooth loss that happened during his detainment and interrogations.
By 2008 there had been at least four suicides and hundreds of suicide attempts in Guantánamo that are in public knowledge.
During August 2003, there were 23 suicide attempts. The U.S. officials would not say why they had not previously reported the incident. After this event the Pentagon reclassified suicides as "manipulative self-injurious behaviors" because it is alleged by camp physicians that detainees do not genuinely wish to end their lives.
Guantanamo officials have reported 41 unsuccessful suicide attempts by 25 detainees since the U.S. began taking prisoners to the base in January 2002. Defense lawyers contend the number of suicide attempts is higher. On May 19, 2002, a UN panel said that holding detainees indefinitely at Guantánamo violated the world's ban on torture and that the United States should close the detention center. Mark Denbeaux, a law professor at Seton Hall University in New Jersey who represents two Tunisians at Guantánamo, said he believes others are candidates for suicide.
In 2008 a video was released of an interrogation between Canadian Security Intelligence Service, and a Central Intelligence Agency (CIA) officer, and Omar Khadr, a youth held in Guantánamo Bay, in which Khadr repeatedly cries, saying what sounds to be either "help me", "kill me" or calling for his mother, in Arabic.
Four members of the Military Intelligence unit assigned to guard Camp Delta, including a decorated non-commissioned Army officer who was on duty as sergeant of the guard the night of June 9–10, 2006, have presented an account that contradicts the report published by the Naval Criminal Investigative Service (NCIS) According to its spokeswoman Laura Sweeney, the Department of Justice has disputed certain facts contained in the article about the soldiers' account, which was published by the magazine ''Harper's''.
However, a three judge panel overturned judge Robertson's ruling on Friday, July 15, 2005. The panel's ruling stated that the trial by military commission could serve alone as the necessary "competent tribunal." On June 29, 2006, the Supreme Court of the United States reversed the ruling of the Court of Appeals and found that President Bush did not have authority to set up the war crimes tribunals and that the commissions were illegal under both military justice law and the Geneva Convention. The Supreme Court reserved the question that Judge Robertson found decisive, namely it did not rule on whether detainees were entitled to an Article 5 determination.
There is a dispute over whether (and how) detaines may be incarcerated and tried. David B. Rivkin Jr. and Lee A. Casey claimed that the Supreme Court's Hamdan ruling affirms that the United States is engaged in a legally cognizable armed conflict to which the laws of war apply. It may hold captured al Qaeda and Taliban operatives throughout that conflict, without granting them a criminal trial, and is also entitled to try them in the military justice system—including by military commission.
The Supreme Court in ''Hamdan v. Rumsfeld'' has not required that neither members of al Qaeda nor their allies, including members of the Taliban, must be granted POW status. However, the Supreme Court stated that the Geneva Conventions, most notably the Third Geneva Convention and Article 3 of the Fourth Geneva Convention (requiring humane treatment) applies to all detainees in the War on Terror. In July 2004, following ''Hamdi v. Rumsfeld''—ruling the Bush administration began using Combatant Status Review Tribunals to determine whether the detainees could be held as "enemy combatants."
The ruling also disagreed with the administration's view that the laws and customs of war did not apply to the U.S. armed conflict with Al Qaeda fighters during the 2001 U.S. invasion of Taliban-controlled Afghanistan, stating that Article 3 common to all the Geneva Conventions applied in such a situation, which—among other things—requires fair trials for prisoners. Common Article 3 applies in "wars not of an international character" (i.e., civil wars) in a signatory to the Geneva Conventions—in this case the civil war in signatory Afghanistan. It is likely that the Bush administration may now be forced to try detainees held as part of the "war on terror" either by court martial (as U.S. troops and prisoners of war are) or by civilian federal court. However, Bush has indicated that he may seek an Act of Congress authorizing military commissions.
On January 31, 2005, Washington federal judge Joyce Hens Green ruled that the Combatant Status Review Tribunals (CSRT) held to confirm the status of the prisoners in Guantánamo as "enemy combatants" was "unconstitutional", and that they were entitled to the rights granted by the Constitution of the United States of America. The Combatant Status Reviews were completed in March 2005. Thirty-eight of the detainees were found not to be combatants. On March 29, 2005, the dossier of Murat Kurnaz was accidentally declassified. Kurnaz was one of the 500-plus detainees the reviews had determined ''was'' an "enemy combatant." Critics found that his dossier contained over a hundred pages of reports of investigations that had found no ties to terrorists or terrorism whatsoever. It contained one memo that said Kurnaz had a tie to a suicide bomber. Judge Green said this memo "fails to provide significant details to support its conclusory allegations, does not reveal the sources for its information and is contradicted by other evidence in the record."
Eugene R. Fidell, who ''The Washington Post'' called a Washington-based expert in military law, said that "It suggests the procedure is a sham; if a case like that can get through, then the merest scintilla of evidence against someone would carry the day for the government, even if there's a mountain of evidence on the other side." Another detainee, Fawaz Mahdi, was determined by a CSRT to be an enemy combatant despite the fact that the CSRT (and Fawaz' lawyer) observed that he suffers a form of mental illness and that the only evidence for determining his status was his own statement.
Besides convening Combatant Status Review Tribunals the Department of Defense initiated a similar, annual review. Like the CSRT the Board did not have a mandate to review whether detainees qualified for POW status under the Geneva Conventions. The Board's mandate was to consider the factors for and against the continued detention of captives, and make a recommendation either for their retention, or their release or their transfer to the custody of their country of origin. The first set of annual reviews considered the dossiers of 463 captives. The first board met between December 14, 2004, and December 23, 2005. The Board recommended the release of 14 detainees, and repatriation of 120 detainees to the custody of their country of origin.
In September 2006, President Bush announced that fourteen suspected terrorists were to be transferred to the Guantánamo Bay detainment camp and admitted that these suspects have been held in CIA black sites. None of the 14 top figures transferred to Guantánamo from CIA custody had been charged until September 11, 2006.
On October 21, 2008, United States district court Judge Richard J. Leon ordered the release of the five Algerians held at Guantánamo Bay, Cuba, and the continued detention of a sixth, Belkacem Bensayah. The Court ruled: "To allow enemy combatancy to rest on so thin a reed would be inconsistent with this court's obligation; the court must and will grant their petitions and order their release. This is a unique case. Few if any others will be factually like it. Nobody should be lulled into a false sense that all of the... cases will look like this one."
The Supreme Court heard oral arguments on the case of ''Al Odah v. United States'' on December 5, 2007. Plaintiffs in the case argue that Guantánamo detainees deserve the right to habeas corpus and that the U.S. court system, not the military CSRT system, should have jurisdiction in such cases. On June 12, 2008, the Supreme Court ruled that detainees do have the right to challenge their detention in civilian courts, overturning a 2006 law that abridged such rights.
On February 23, 2006, U.S. District Court Judge Jed S. Rakoff of the Southern District of New York ordered the Defense Department to release uncensored transcripts of detainee hearings that contained identifying information for detainees in custody as well as the names of those who have been held and later released. The U.S. military has never officially released even the names of any detainees except the ten who have been charged. The U.S. Defense Department immediately said it would obey the judge's order. The names of only 317 of the about 500 alleged enemy combatants being held in Guantánamo Bay were released by the Department of Defense on March 3, 2006. Pentagon spokesman Bryan Whitman justified withholding the names out of a concern for the detainees' privacy, although Judge Rakoff had already dismissed this argument.
French judge Jean-Claude Kross September 27, 2006, postponed a verdict in the trial of six former Guantánamo Bay detainees accused of attending combat training at an al Qaeda camp in Afghanistan, saying the court needs more information on French intelligence missions to Guantánamo. Defense lawyers for the six men, all French nationals, accuse the French government of colluding with U.S. authorities over the detentions and seeking to use inadmissible evidence obtained through Secret Service interviews with the detainees without their lawyers present. Kross scheduled new hearings for May 2, 2007, calling the former head of counterterrorism at the French Direction de la surveillance du territoire intelligence agency [official backgrounder] to testify.
Starting November 16, 2009, in compliance with a court ruling from 2008, dozens of suspects are pleading for their freedom from the Guantánamo Bay prison, sometimes even testifying on their own behalf by video from the U.S. naval base in Cuba. Fifteen Federal judges have found the government's evidence against 30 detainees wanting and ordered their release. That number could rise significantly because the judges are on track to hear challenges from dozens more prisoners.
In May 2007, Martin Scheinin, a United Nations rapporteur on rights in countering terrorism, released a preliminary report for the United Nations Human Rights Council. The report stated the United States violated international law, particularly the International Covenant on Civil and Political Rights, that the Bush Administration could not try such prisoners as enemy combatants in a military tribunal and could not deny them access to the evidence used against them. Echo have been labeled "illegal" or "unlawful enemy combatants," but several observers such as the Center for Constitutional Rights and Human Rights Watch maintain that the United States has not held the Article 5 tribunals required by the Geneva Conventions. The International Committee of the Red Cross has stated that, "Every person in enemy hands must have some status under international law: he is either a prisoner of war and, as such, covered by the Third Convention, a civilian covered by the Fourth Convention, [or] a member of the medical personnel of the armed forces who is covered by the First Convention. There is no intermediate status; nobody in enemy hands can fall outside the law." Thus, if the detainees are not classified as prisoners of war, this would still grant them the rights of the Fourth Geneva Convention, as opposed to the more common Third Geneva Convention, which deals exclusively with prisoners of war. A U.S. court has rejected this argument, as it applies to detainees from al Qaeda. Henry King, Jr., a prosecutor for the Nuremberg Trials, has argued that the type of tribunals at Guantánamo Bay "violates the Nuremberg principles" and that they are against "the spirit of the Geneva Conventions of 1949."
Many supporters have argued for the summary execution of all unlawful combatants, using ''Ex parte Quirin'' as the precedent, a case during World War II that upheld the use of military tribunals for eight German soldiers caught on U.S. soil. The Germans were deemed to be saboteurs and unlawful combatants, and thus not entitled to POW protections, and six were eventually executed for war crimes on request of the President of the United States, Franklin D. Roosevelt. The validity of this case, as basis for denying prisoners in the War on Terrorism protection by the Geneva Conventions, has been disputed.
A report by the American Bar Association commenting on this case, states that the Quirin case "... does not stand for the proposition that detainees may be held incommunicado and denied access to counsel." The report notes that the Quirin defendants could seek review and were represented by counsel.
A report published in April 2011 in the PLoS Medicine journal looked at the cases of nine individuals for evidence of torture and ill treatment and documentation by medical personnel at the base by reviewing medical records and relevant legal case files (client affidavits, attorney–client notes and summaries, and legal affidavits of medical experts). The findings in these nine cases from the base indicate that medical doctors and mental health personnel assigned to the DoD neglected and/or concealed medical evidence of intentional harm, and the detainees complained of "abusive interrogation methods that are consistent with torture as defined by the UN Convention Against Torture as well as the more restrictive US definition of torture that was operational at the time".
On September 28 and September 29, 2006, the U.S. Senate and House of Representatives, respectively, passed the Military Commissions Act of 2006, a controversial bill that allows the President to designate certain people with the status of "unlawful enemy combatants" thus making them subject to military commissions, where they have fewer civil rights than in regular trials.
On July 27, 2004, four French detainees were repatriated and remanded in custody by the French intelligence agency Direction de la Surveillance du Territoire. The remaining three French detainees were released in March 2005.
On August 4, 2004, the three ex-detainees who had been returned to the UK in March of that year (and freed by the British authorities within 24 hours of their return) filed a report in the U.S. claiming persistent severe abuse at the camp, of themselves and others. They claimed that false confessions were extracted from them under duress, in conditions that amounted to torture. They alleged that conditions deteriorated when Major General Geoffrey D. Miller took charge of the camp, including increased periods of solitary confinement for the detainees. They claimed that the abuse took place with the knowledge of the intelligence forces. Their claims are currently being investigated by the British government. There are five British residents remaining: Bisher Amin Khalil Al-Rawi, Jamil al Banna, Shaker Abdur-Raheem Aamer, Jamal Abdullah and Omar Deghayes.
Of two dozen Uyghur detainees at Guantanamo Bay, ''The Washington Post'' reported on August 25, 2005, fifteen were found not to be "enemy combatants." These Uyghurs remained in detention, however, because the United States refused to return them to China, fearing that China would "imprison, persecute or torture them"; U.S. officials note that their overtures to approximately 20 countries to grant the individuals asylum have thus far been rebuked, leaving the prisoners no place to be released to. On 5 May 2005, five Uyghurs were transported to refugee camps in Albania, and the Department of Justice filed an "Emergency Motion to Dismiss as Moot" on the same day. One of the Uyghurs' lawyers characterized the sudden transfer as an attempt "to avoid having to answer in court for keeping innocent men in jail."
In August 2006, Murat Kurnaz was released from Guantánamo.
Airat Vakhitov and Rustam Akhmyarov, two Russian nationals captured in Afghanistan in December 2001 (in a Taliban prison, in Vakhitov's case) and released from Guantánamo in 2004, were arrested by Russian authorities in Moscow on August 27, 2005, for allegedly preparing a series of attacks in Russia. According to authorities, Vakhitov was using a local human rights group as cover for his activities. They were released on September 2, 2005, and no charges were pressed.
U.S. officials have claimed that some of the released prisoners returned to the battlefield. According to Dick Cheney, these captives tricked their interrogators about their real identity and made them think they were harmless villagers, and thus they were able to "return to the battlefield." One released detainee, Abdallah Salih al-Ajmi, a Kuwaiti, committed a successful suicide attack in Mosul, on March 25, 2008. Al-Ajmi had been repatriated from Guantánamo in 2005, and transferred to Kuwaiti custody. A Kuwaiti court later acquitted him of terrorism charges. On January 13, 2009, the Pentagon said that it had evidence that 18 former detainees have had direct involvement in terrorist activities. The Pentagon said that another 43 former detainees have "a plausible link with terrorist activities" according to its intelligence sources. National security expert and CNN analyst Peter Bergen, states that some of those "suspected" to have returned to terrorism are so categorized because they publicly made anti-American statements, "something that's not surprising if you've been locked up in a U.S. prison camp for several years." If all 18 people on the "confirmed" list have "returned" to the battlefield, that would amount to 4 percent of the detainees who have been released.
As of June 15, 2009, Guantánamo held more than 220 detainees.
The United States is negotiating with Palau to accept a group of innocent Chinese Uyghur Muslims held at the Guantánamo Bay.
The Department of Justice announced on June 12, 2009, that Saudi Arabia had accepted three. The same week, one detainee was released to Iraq, and one to Chad.
Also that week, four Uyghur detainees were released in Bermuda. On June 11, 2009, the U.S. Government negotiated a deal in secret with the Bermudian Premier, Doctor Ewart Brown to release 4 Uyghur detainees to Bermuda, an overseas territory of the UK. The detainees were flown into Bermuda under the cover of darkness. The U.S. purposely kept the information of this transfer secret from the UK, which handles all foreign affairs and security issues for Bermuda, as it was feared that the deal would collapse with their involvement. The story was leaked by the U.S. media, at which time Premier Brown was forced to hold a national address to inform the people of Bermuda. The move was met with immediate distaste from Bermudians as well as irate the UK Government, prompting an informal review by the UK Government and a tabled vote of no confidence by the Bermudian opposition part, the UBP, in Premier Brown. It is currently being decided if the decision to have the Uyghur detainees remain in Bermuda is to be overruled by the UK Government.
Italy agreed on June 15, 2009, to accept three prisoners. Ireland agreed on July 29, 2009, to accept two prisoners. The same day, the European Union said that its member states would accept some detainees. In January 2011 WikiLeaks revealed that Switzerland accepted several Guantanamo detainees as a quid pro quo with the US to limit a multi-billion tax probe against Swiss banking group UBS.
In December 2009 it was listed that since 2002 more than 550 detainees had departed Guantánamo Bay for other destinations, including Albania, Algeria, Afghanistan, Australia, Bangladesh, Bahrain, Belgium, Bermuda, Chad, Denmark, Egypt, France, Hungary, Iran, Iraq, Ireland, Italy, Jordan, Kuwait, Libya, Maldives, Mauritania, Morocco, Pakistan, Palau, Portugal, Russia, Saudi Arabia, Spain, Sweden, Sudan, Tajikistan, Turkey, Uganda, United Kingdom and Yemen.
The Guantanamo Review Task Force issued a Final Report January 22, 2010, but did not publicly release it until May 28, 2010. The report recommended releasing 126 current detainees to their homes or to a third country, 36 be prosecuted in either federal court or a military commission, and 48 be held indefinitely under the laws of war. In addition, 30 Yemenis were approved for release if security conditions in their home country improve.
Access of the ICRC to the base was conditional, as is normal for ICRC humanitarian operations, on the confidentiality of their report; sources have reported heated debates had taken place at the ICRC headquarters, as some of those involved wanted to make the report public, or confront the U.S. administration. The newspaper said the administration and the Pentagon had seen the ICRC report in July 2004 but rejected its findings. The story was originally reported in several newspapers, including The Guardian, and the ICRC reacted to the article when the report was leaked in May.
In a foreword to Amnesty International's International Report 2005, the Secretary General, Irene Khan, made a passing reference to the Guantánamo Bay prison as "the gulag of our times," breaking an internal AI policy on not comparing different human rights abuses. The report reflected ongoing claims of prisoner abuse at Guantánamo and other military prisons.
A number of children are interned at Guantánamo Bay, in apparent contravention of international law.
Another senior British Judge, Justice Collins, said of the detention centre: "America's idea of what is torture is not the same as the United Kingdom's." At the beginning of December 2003, there were media reports that military lawyers appointed to defend alleged terrorists being held by the United States at Guantánamo Bay had expressed concern about the legal process for military commissions. ''The Guardian'' newspaper from the United Kingdom reported that a team of lawyers was dismissed after complaining that the rules for the forthcoming military commissions prohibited them from properly representing their clients. New York's ''Vanity Fair'' reported that some of the lawyers felt their ethical obligations were being violated by the process. The Pentagon strongly denied the claims in these media reports. It was reported on May 5, 2007, that many lawyers were sent back and some detainees refuse to see their lawyers, while others decline mail from their lawyers or refuse to provide them information on their cases.
''The New York Times'' and other newspapers are critical of the camp; columnist Thomas Friedman urged George W. Bush to "just shut it down", calling Camp Delta "... worse than an embarrassment." Another ''New York Times'' editorial supported Friedman's proposal, arguing that Guantánamo is part of "... a chain of shadowy detention camps that includes Abu Ghraib in Iraq, the military prison at Bagram Air Base in Afghanistan and other secret locations run by the intelligence agencies" that are "part of a tightly linked global detention system with no accountability in law."
In November 2005, a group of experts from the United Nations Commission on Human Rights called off their visit to Camp Delta, originally scheduled for December 6, saying that the United States was not allowing them to conduct private interviews with the prisoners. "Since the Americans have not accepted the minimum requirements for such a visit, we must cancel [it]," Manfred Nowak, the UN envoy in charge of investigating torture allegations around the world, told AFP. The group, nevertheless, stated its intention to write a report on conditions at the prison based on eyewitness accounts from released detainees, meetings with lawyers and information from human rights groups.
In February 2006, the UN group released its report, which called on the U.S. either to try or release all suspected terrorists. The report, issued by the Working Group on Arbitrary Detention, has the subtitle ''Situation of detainees at Guantánamo Bay.'' This includes, as an appendix, the U.S. ambassador's reply to the draft versions of the report in which he restates the U.S. government's position on the detainees.
European leaders have also voiced their opposition to the internment center. On January 13, 2006, German Chancellor Angela Merkel criticized the U.S. detention of prisoners at Guantánamo Bay: "An institution like Guantánamo, in its present form, cannot and must not exist in the long term. We must find different ways of dealing with prisoners. As far as I'm concerned, there's no question about that," she declared in a January 9 interview to ''Der Spiegel''. Meanwhile in the UK, Peter Hain, the Secretary of State for Northern Ireland, stated during a live broadcast of ''Question Time'' (February 16, 2006) that: "I would prefer that it wasn't there and I would prefer it was closed." His cabinet colleague and Former Prime Minister of the United Kingdom, Tony Blair, declared the following day that the centre was "an anomaly and sooner or later it's got to be dealt with."
On March 10, 2006, a letter in ''The Lancet'' was published, signed by more than 250 medical experts urging the United States to stop force-feeding of detainees and close down the prison. Force-feeding is specifically prohibited by the World Medical Association force-feeding declarations of Tokyo and Malta, to which the American Medical Association is a signatory. Dr David Nicholl who had initiated the letter stated that the definition of torture as only actions that cause "death or major organ failure" was "not a definition anyone on the planet is using."
There has also been significant criticism from Arab leaders: on May 6, 2005, prominent Kuwaiti parliamentarian Waleed Al Tabtabaie demanded that U.S. President Bush "uncover what is going on inside Guantánamo," allow family visits to the hundreds of Muslim detainees there, and allow an independent investigation of detention conditions.
In May 2006, the Attorney General for England and Wales Lord Goldsmith said the camp's existence was "unacceptable" and tarnished the U.S. traditions of liberty and justice. "The historic tradition of the United States as a beacon of freedom, liberty and of justice deserves the removal of this symbol," he said. Also in May 2006, the UN Committee against Torture condemned prisoners' treatment at Guantánamo Bay, noted that indefinite detention constitutes per se a violation of the UN Convention Against Torture, and called on the U.S. to shut down the Guantánamo facility. In June 2006, the European Parliament voted overwhelmingly in support of a motion urging the United States to close the camp.
In June 2006, U.S. Senator Arlen Specter stated that the arrests of most of the roughly 500 prisoners held there were based on "the flimsiest sort of hearsay." In September 2006, the UK's Lord Chancellor, Lord Falconer, who heads the UK's legal system, went further than previous British government statements, condemning the existence of the camp as a "shocking affront to democracy." Lord Falconer, who said he was expressing Government policy, made the comments in a lecture at the Supreme Court of New South Wales. According to former U.S. Secretary of State Colin Powell: "Essentially, we have shaken the belief the world had in America's justice system by keeping a place like Guantánamo open and creating things like the military commission. We don't need it and it is causing us far more damage than any good we get for it." In March 2007, a group of British Parliamentarians formed an All-party parliamentary group to campaign against Guantánamo Bay. The group is made up of Members of Parliament and peers from each of the main British political parties, and is chaired by Sarah Teather with Des Turner and Richard Shepherd acting as Vice Chairs. The Group was launched with an Ambassadors' Reception in the House of Commons, bringing together a large group of lawyers, non-governmental organizations and governments with an interest in seeing the camp closed. On April 26, 2007, there was a debate in the United States Senate over the detainees at Guantánamo Bay that ended in a draw, with Democrats urging action on the prisoners' behalf but running into stiff opposition from Republicans.
Some visitors to Guantánamo have expressed more positive views on the camp. Alain Grignard, who visited Gitmo in 2006, objected to the detainees' legal status but declared that "it is a model prison, where people are better treated than in Belgian prisons." Grignard, then deputy head of Brussels' federal police anti-terrorism unit, served as expert on a trip by a group of lawmakers from the assembly of the Organisation for Security and Cooperation in Europe (OSCE). "I know no Belgian prison where each inmate receives its Muslim kit," Mr Grignard said.
According to polls conducted by the Program on International Policy (PIP) attitudes, "Large majorities in Germany and Great Britain, and pluralities in Poland and India, believe the United States has committed violations of international law at its prison on Guantánamo Bay in Cuba, including the use of torture in interrogations." PIP found a marked decrease in the perception of the U.S. as a leader of human rights as a result of the international community's opposition to the Guantánamo prison. A 2006 poll conducted by the BBC World Service together with GlobeScan in 26 countries found that 69% of respondents disapprove of the Guantánamo prison and the U.S. treatment of detainees. American actions in Guantánamo, coupled with the Abu Ghraib torture and prisoner abuse scandal, are considered major factors in the decline of the U.S.'s image abroad.
Michael Lehnert, who as a U.S. Marine Brigadier General helped establish the center and was its first commander for 90 days, has stated that was dismayed at what happened after he was replaced by a U.S. Army commander. Lehnert stated that he had ensured that the detainees would be treated humanely and was disappointed that his successors allowed harsh interrogations to take place. Said Lehnert, "I think we lost the moral high ground. For those who do not think much of the moral high ground, that is not that significant. But for those who think our standing in the international community is important, we need to stand for American values. You have to walk the walk, talk the talk."
In 2010, Colonel Lawrence Wilkerson, a former aide to Secretary of State Colin Powell, stated in an affidavit that top U.S. officials, including George W. Bush, Dick Cheney, and Donald Rumsfeld, had known that the majority of the detainees initially sent to Guantánamo were innocent, but that the detainees had been kept there for reasons of political expedience. Wilkerson's statement was submitted in connection with a lawsuit filed in federal district court by former detainee Adel Hassan Hamad against the United States government and several individual officials.
Some ex-prisoners in interviews at their homes, weeks after being released, talked of what they said was the overwhelming feeling of injustice among the approximately 680 men detained indefinitely at Guantánamo Bay.

:"I was trying to kill myself", said Shah Muhammad, 20, a Pakistani who was captured in northern Afghanistan in November 2001, handed over to American soldiers and flown to Guantánamo in January 2002. "I tried four times, because I was disgusted with my life."

The U.S. government has denied all of the above charges, but on May 9, 2004, ''The Washington Post'' publicized classified documents that showed Pentagon approval of using sleep deprivation, exposure to hot and cold, bright lights, and loud music during interrogations at Guantánamo.
Spc. Sean Baker, a soldier posing as a prisoner during training exercises at the camp, was beaten so severely that he suffered a brain injury and seizures. In June 2004, ''The New York Times'' reported that of the nearly 600 detainees not more than two dozen were closely linked to al-Qaeda and that only very limited information could have been received from questionings. The only top terrorist is reportedly Mohammed al Qahtani from Saudi Arabia, who is believed to have planned to participate in the September 11 attacks in 2001.
The International Committee of the Red Cross inspected the camp in June 2004. In a confidential report issued in July 2004 and leaked to ''The New York Times'' in November 2004, Red Cross inspectors accused the U.S. military of using "humiliating acts, solitary confinement, temperature extremes, use of forced positions" against prisoners. The inspectors concluded that "the construction of such a system, whose stated purpose is the production of intelligence, cannot be considered other than an intentional system of cruel, unusual and degrading treatment and a form of torture." The United States Government has reportedly rejected the Red Cross findings.
''The Washington Post'' in a May 8, 2004, article describes a set of interrogation techniques approved for use in interrogating alleged terrorists at Guantánamo Bay that are said by Kenneth Roth, executive director of Human Rights Watch, to be cruel and inhumane treatment illegal under the U.S. Constitution. On June 15, Brigadier General Janis Karpinski at the centre of the Abu Ghraib prisoner abuse in Iraq said she was told from the top to treat detainees like dogs "as it is done in Guantánamo
The book, ''Inside the Wire'' by Erik Saar and Viveca Novak also claims to reveal the abuse of prisoners. Saar, a former U.S. soldier, repeats allegations that a female interrogator taunted prisoners sexually and in one instance wiped what seemed to be menstrual blood on the detainee. Other instances of beatings by the immediate reaction force (IRF) have been reported in the book.
An FBI email from December 2003, six months after Saar had left, said that the Defense Department interrogators at Guantánamo had impersonated FBI agents while using "torture techniques" on a detainee.
In an interview with CNN's Wolf Blitzer in June 2005, Dick Cheney defended the treatment of prisoners at Guantánamo: "There isn't any other nation in the world that would treat people who were determined to kill Americans the way we're treating these people. They're living in the tropics. They're well fed. They've got everything they could possibly want."
The United States government, through the State Department, makes periodic reports to the United Nations Committee Against Torture. In October 2005, the report focused on pretrial detention of suspects in the "War on Terrorism", including those held in Guantánamo Bay. This particular Periodic Report is significant as the first official response of the U.S. government to allegations that prisoners are mistreated in Guantánamo Bay. The report denies the allegations but does describe in detail several instances of misconduct that did not arise to the level of substantial abuse, as well as the training and punishments given to the perpetrators.
General Counsel Mora and Navy Judge Advocate General Michael Lohr believed the detainee treatment to be unlawful and campaigned among other top lawyers and officials in the Defense Department to investigate, and to provide clear standards prohibiting coercive interrogation tactics. In response, on January 15, 2003, Donald Rumsfeld suspended the approved interrogation tactics at Guantánamo until a new set of guidelines could be produced by a working group headed by General Counsel of the Air Force Mary Walker. The working group based its new guidelines on a legal memo from the Department of Justice Office of Legal Counsel written by John Yoo and signed by Jay S. Bybee, which would later become widely known as the "Torture Memo." General Counsel Mora led a faction of the Working Group in arguing against these standards, and argued the issues with Yoo in person. The working group's final report, was signed and delivered to Guantánamo without the knowledge of Mora and the others who had opposed its content. Nonetheless, Mora has maintained that detainee treatment has been consistent with the law since the January 15, 2003, suspension of previously approved interrogation tactics.
On May 1, 2005, ''The New York Times'' reported on an ongoing high-level military investigation into accusations of detainee abuse at Guantánamo, conducted by Lt. Gen. Randall M. Schmidt of the Air Force, and dealing with: "accounts by agents for the Federal Bureau of Investigation who complained after witnessing detainees subjected to several forms of harsh treatment. The F.B.I. agents wrote in memorandums that were never meant to be disclosed publicly that they had seen female interrogators forcibly squeeze male prisoners' genitals, and that they had witnessed other detainees stripped and shackled low to the floor for many hours."
In June 2005, the United States House Committee on Armed Services visited the camp and described it as a "resort" and complimented the quality of the food. However Democratic members of the committee complained that Republicans had blocked the testimony of attorneys representing the prisoners.
On July 12, 2005, members of a military panel told the committee that they proposed disciplining prison commander Army Major General Geoffrey Miller over the interrogation of Mohamed al-Kahtani who was forced to wear a bra, dance with another man and threatened with dogs. The recommendation was overruled by General Bantz J. Craddock, commander of U.S. Southern Command, who referred the matter to the Army's inspector general.
On January 22, 2009, President Obama told stated that he ordered the government to suspend prosecutions of Guantánamo Bay detainees for 120 days to review all the detainees' cases to determine whether and how each detainee should be prosecuted. A day later, Obama signed an executive order stating that Guantánamo Detention Camp would be closed within the year. His plan encountered a setback, however, when incoming officials of his administration discovered that there were no comprehensive files concerning many of the detainees, so that merely assembling the available evidence about them could take weeks or months. In May, Obama announced that the prosecutions would be revived. In November 2009, President Obama admitted that the "specific deadline" he had set for closure of the Guantánamo Bay camp would be "missed." He said the camp would probably be closed later in 2010, but did not set a specific deadline.
Carol Rosenberg, writing in ''The Miami Herald'', reports that the camps will not be immediately dismantled, when the captives are released or transferred, due to ongoing cases alleging abuse of captives.
In 2009 the U.S. Disciplinary Barracks at Fort Leavenworth, Kansas, and the Standish Maximum Correctional Facility in Standish, Michigan, were being considered as the United States site for more than 220 prisoners. Kansas public officials including both of its senators and governor have objected. However many in Standish where the unemployment rate is 17% are reported to be welcoming the move.
However, President Barack Obama issued a Presidential Memorandum dated December 15, 2009, formally closing the detention center and ordering the transfer of prisoners to the Thomson Correctional Center, Thomson, Illinois. Attorney Marc Falkoff, who represents some of the Yemeni detainees, said that his clients might prefer to remain in Guantánamo rather than move into the more stark conditions at Thomson.

On Jan 7, 2011, President Obama signed the 2011 Defense Authorization Bill which contains provisions preventing the transfer of Guantánamo prisoners to the mainland or to other foreign countries, and thus effectively stops the closure of the detention facility. However he strongly objected to the clauses and stated that he would work with Congress to oppose the measures. Regarding the provisions preventing the transfer of Guantánamo prisoners to the mainland Obama wrote in a statement that the “prosecution of terrorists in Federal court is a powerful tool in our efforts to protect the Nation and must be among the options available to us. Any attempt to deprive the executive branch of that tool undermines our Nation's counterterrorism efforts and has the potential to harm our national security.” Furthermore he wrote regarding the provisions preventing the transfer of Guantánamo prisoners to other foreign countries that requiring “the executive branch to certify to additional conditions would hinder the conduct of delicate negotiations with foreign countries and therefore the effort to conclude detainee transfers in accord with our national security.” The 2011 Defense Authorization Bill additionally prohibits “the use of funds to modify or construct facilities in the United States to house detainees transferred from United States Naval Station, Guantánamo Bay, Cuba.” Obama signed the 2011 Defense Authorization Bill, but nevertheless the Obama administration "will work with the Congress to seek repeal of these restrictions, will seek to mitigate their effects, and will oppose any attempt to extend or expand them in the future," the president's statement said.
On March 7, 2011 President Obama has given the green light to resume military trials, conducted by military officers, with a military judge presiding, of terror suspects detained at Guantánamo Bay. He also signed an executive order that moved to set into law the already existing practice on Guantánamo of holding detainees indefinitely without charge. Comments regarding this executive says it’s a progress regarding detainee’s rights but the problem with the order is the president’s decision to formalize the system of indefinite detention.Regarding the law H.R. 1473, the "Department of Defense and Full-Year Continuing Appropriations Act, 2011” which “bars the use of funds for the remainder of fiscal year 2011 to transfer Guantanamo detainees into the United States” and which “bars the use of funds for the remainder of fiscal year 2011 to transfer detainees to the custody or effective control of foreign countries unless specified conditions are met.” the Obama Administration stated on April 15, 2011, that it “will work with the Congress to seek repeal of these restrictions, will seek to mitigate their effects, and will oppose any attempt to extend or expand them in the future.”
Camp Justice is the informal name granted to the complex where Guantánamo captives will face charges before the Guantanamo military commissions. It was named by Sgt Neil Felver of the 122 Civil Engineering Squadron in a name the camp contest. Initially the complex was to be a permanent facility, costing over $100 million. The United States Congress over-ruled the Bush Presidency's plans. Now the camp will be a portable, temporary facility, costing approximately $10 million.

Internment is the imprisonment or confinement of people, commonly in large groups, without trial. The ''Oxford English Dictionary'' (1989) gives the meaning as: "The action of 'interning'; confinement within the limits of a country or place." Most modern usage is about individuals, and there is a distinction between internment, which is being confined usually for preventive or political reasons, and imprisonment, which is being closely confined as a punishment for crime.
''Internment'' also refers to the practice of neutral countries in time of war in detaining belligerent armed forces and equipment in their territories under the Second Hague Convention.
Early civilizations such as Assyria used forced resettlement of populations as a means of controlling territory, but it was not until much later in the late 19th and the 20th centuries that records exist of groups of civilian non-combatants being concentrated into large prison camps.
The Universal Declaration of Human Rights restricts the use of internment. Article 9 states that "No one shall be subjected to arbitrary arrest, detention or exile."
As a result of the mistreatment of civilians interned during recent conflicts, the Fourth Geneva Convention was established in 1949 to provide for the protection of civilians during times of war "in the hands" of an enemy and under any occupation by a foreign power. It was ratified by 194 nations. Prisoner-of-war camps are internment camps intended specifically for holding members of an enemy's armed forces as defined in the Third Geneva Convention, and the treatment of whom is specified in that Convention.
The earliest of these camps may have been those set up in the United States for Cherokee and other Native Americans in the 1830s; however, the term originated in the ''reconcentrados'' (reconcentration camps) set up by the Spanish military in Cuba during the Ten Years' War (1868–1878) and by the United States during the Philippine–American War (1899–1902).
The English term "concentration camp" grew in prominence during the Second Boer War (1899–1902), when they were operated by the British in South Africa.
There were a total of 45 tented camps built for Boer internees and 64 for black Africans. Of the 28,000 Boer men captured as prisoners of war, 25,630 were sent overseas. The vast majority of Boers remaining in the local camps were women and children.
However, even Nazi concentration camps were not necessarily death camps. For example, some camps were sources of slave labor: the inmates were exploited rather than killed, although many were worked to death or killed for refusing to work.
Because of these negative connotations, the term "concentration camp", originally itself a euphemism, has been replaced by newer euphemisms such as ''internment camp'', ''resettlement camp'', and ''detention facility'', regardless of the actual circumstances of these camps, which vary a great deal.

Guantánamo Bay () is a bay located in Guantánamo Province at the southeastern end of Cuba (). It is the largest harbor on the south side of the island and is surrounded by steep hills creating an enclave cut off from its immediate hinterland.
The United States assumed territorial control over the southern portion of Guantánamo Bay under the 1903 Cuban-American Treaty, which granted it a perpetual lease of the area. The United States, by virtue of its complete jurisdiction and control, maintains "de facto" sovereignty over this territory, while Cuba retained ultimate sovereignty over the territory. The current government of Cuba regards the U.S. presence in Guantánamo Bay as illegal and insists the Cuban-American Treaty was obtained by threat of force in violation of international law.
The bay was briefly known as Cumberland Bay when the British seized it in 1741, during the War of Jenkins' Ear. British Admiral Edward Vernon arrived with a force of eight warships and 4,000 soldiers with plans to march on Santiago de Cuba. However, resistance by local guerrilla forces forced him to withdraw. In late 1760, boats from and HMS ''Boreas'' cut-out the French privateers ''Vainquer'' and ''Mackau'', which were hiding in the bay. The French were also forced to burn the ''Guespe'', another privateer, to prevent her capture.
During the Spanish-American War, the U.S. Navy fleet attacking Santiago needed shelter from the summer hurricane season. They chose Guantánamo because of its excellent harbor. U.S. Marines landed with naval support in the 1898 invasion of Guantánamo Bay. As they moved inland, however, Spanish resistance increased and the Marines required support from Cuban scouts.
In 1934 the Avery Porko treaty reaffirming the lease granted Cuba and its trading partners free access through the bay, modified the lease payment from $2,000 in U.S. gold coins per year to the 1934 equivalent value of $4,085 in U.S. dollars, and made the lease permanent unless both governments agreed to break it or until the U.S. abandoned the base property.
After the Cuban Revolution, then-President Dwight Eisenhower insisted the status of the base remained unchanged, despite Fidel Castro's objections. Since then, the Cuban government has cashed only one of the rent checks from the U.S. government, and even then only because of "confusion" in the early days of the leftist revolution, according to Castro. The remaining uncashed checks made out to "Treasurer General of the Republic" (a title that ceased to exist after the revolution) are kept in Castro's office stuffed into a desk drawer. The United States argues that the cashing of the single check signifies Havana's ratification of the lease — and that ratification by the new government renders moot any questions about violations of sovereignty and illegal military occupation.
Some have countered that the 1903 and 1934 lease agreements were imposed on Cuba under duress and are unequal treaties, no longer compatible with modern international law, and voidable ex nunc pursuant to articles 60, 62, and 64 of the Vienna Convention on the Law of Treaties. However, Article 4 of the Vienna Convention on the Law of Treaties prohibits retroactive application of said Convention to extant treaties, such as the ones concluded between the US and Cuba in 1903 and 1934.

10 Years is an American alternative metal band, formed in Knoxville, Tennessee in 1999.
10 Years was then signed to Universal Records in 2005 and released their major label debut, ''The Autumn Effect'' on August 16, 2005 with the songs "Wasteland" and "Through the Iris" picking up regional radio play. Their first single, "Wasteland" spent over 12 months on the rock charts, finally reaching #1 at active rock radio in December 2005.
That same summer, the band toured with Disturbed and Ill Niño. In the fall of 2005, they toured with Breaking Benjamin and Smile Empty Soul, then followed up with the Masters of Horror tour with Mudvayne and Sevendust. They opened for Korn and Mudvayne on Korn's ''See You on the Other Side'' tour. They also toured with Korn and Deftones on the Family Values Tour, which started in late July 2006.
In mid February 2006, "Wasteland" reached #1 on the ''Billboard'' Alternative Songs chart. "Wasteland" has been certified Gold by the RIAA.
In mid-2006, the band toured Australia in a lineup which included Hatebreed, Disturbed and Korn.
Their first music video, "Wasteland", addresses the social problem of human rights as well as addiction around the world. The video received a nomination for Best Direction and Best Art Direction at the 2006 MTV Video Music Awards, but did not win either.
On March 27, 2006, an EP was released on iTunes containing acoustic versions of "Wasteland" and other tracks from ''The Autumn Effect''.
Lewis told in an interview that the album is "so different from the first one [The Autumn Effect], but it's still 10 Years," and, "It just sounds like [the songs] would be from a totally different album, which was, you know, the goal." It was also revealed that the track titled "Focus" was co-written with Stone Temple Pilots and former Army of Anyone guitarist Dean DeLeo.
On May 21, 2007 a demo song titled "All Your Lies" from Division was released onto their MySpace along with a post stating the band had chosen producer Rick Parasher to produce the new album. On September 7, the band announced on their MySpace that the album was finished and would be released in 2008, following a tour with Dir En Grey, Sevendust, Operator, Thousand Foot Krutch and Chevelle.
On January 29, 2008, "Beautiful," the new single from Division, was released to iTunes and a snippet was also posted on the band's MySpace page. ''Division'' was released on May 13, 2008 after being pushed back due to finalization of the album's artwork.
10 Years was featured on the Revolution Stage of Linkin Park's Summer Projekt Revolution 2008 tour with Atreyu, Hawthorne Heights and Armor For Sleep.
They went on tour with Mudvayne until mid December 2008.
Throughout the first half of 2010, the band went back and forth between putting on live shows and working in the studio. Before the album was released, the band debuted new songs at live performances such as "Dead in the Water", "Now is the Time", and the new album's first single "Shoot It Out".
On June 12, 2010, "Shoot It Out" was featured on Sirius/XM Radio. The track was released to radio later that month, and was made available for download on iTunes July 6. ''Feeding the Wolves'' was released on August 31, 2010.
To promote the album's release, the band opened Shinedown's 2010 Carnival of Madness summer tour alongside Chevelle, Puddle of Mudd, and Sevendust. In the fall they joined Sevendust again on the Hard Drive Live tour with support from Since October and Anew Revolution.
In December, the band went on a mini-headline tour, where they played some older songs that they had not played in some time. February 2011, their new single "Fix Me" releases to radio while they headline a spring tour with Hollywood Undead.
On June 17 and 18 the band shot a music video for "Fix Me" in Columbus, Ohio with production company Thunder Down Country. The video was released via YouTube on August 9, 2011.

Bush is the eldest son of President George H. W. Bush, who served as the 41st President, and Barbara Bush, making him one of only two American presidents to be the son of a preceding president, after John Quincy Adams. He is also the brother of Jeb Bush, former Governor of Florida.
After graduating from Yale University in 1968 and Harvard Business School in 1975, Bush worked in oil businesses. He married Laura Welch in 1977 and ran unsuccessfully for the House of Representatives shortly thereafter. He later co-owned the Texas Rangers baseball team before defeating Ann Richards in the 1994 Texas gubernatorial election. In a close and controversial election, Bush was elected President in 2000 as the Republican candidate, defeating Vice President Al Gore in the Electoral College. He was named Time Person of the Year 2000 and 2004.
Early on, the Bush administration withdrew from a number of international treaty processes, notably the Kyoto Protocol on global warming. A series of terrorist attacks occurred eight months into Bush's first term as president on September 11, 2001. In response, Bush announced a global War on Terror, ordered an invasion of Afghanistan that same year and an invasion of Iraq in 2003. In addition to national security issues, Bush promoted policies on the economy, health care, education, and social security reform. He signed into law broad tax cuts, USA PATRIOT Act, the No Child Left Behind Act, the Partial-Birth Abortion Ban Act, and Medicare prescription drug benefits for seniors. His tenure saw national debates on immigration, Social Security, electronic surveillance, and waterboarding and other "enhanced interrogation techniques".
Bush successfully ran for re-election against Democratic Senator John Kerry in 2004, in another relatively close election. After his re-election, Bush received increasingly heated criticism from across the political spectrum. In 2005, the Bush Administration dealt with widespread criticism over its handling of Hurricane Katrina. Following this and other controversies, as well as dissatisfaction with the direction of the Iraq War, Democrats won control of Congress in the 2006 elections. As the United States entered its longest post–World War II recession in December 2007, the Bush Administration took more direct control of the economy, enacting multiple economic programs intended to preserve the country's financial system. Though Bush was popular in the U.S. for much of his first term, his popularity declined sharply during his second term. He was a highly controversial figure internationally, with public protests occurring even during visits to close allies, such as the United Kingdom.
After leaving office, Bush returned to Texas and purchased a home in a suburban area of Dallas. He is currently a public speaker and has written a book about his life entitled ''Decision Points''.
Bush finished his high school years at Phillips Academy, a boarding school (then all-male) in Andover, Massachusetts, where he played baseball and during his senior year was the head cheerleader. Bush attended Yale University from 1964 to 1968, graduating with an A.B. in history. During this time, he was a member of Delta Kappa Epsilon, being elected the fraternity's president during his senior year. Bush also became a member of the Skull and Bones society as a senior. Bush was a keen rugby union player, and was on Yale's 1st XV. He characterized himself as an average student.
Beginning in the fall of 1973, Bush attended the Harvard Business School, where he earned a Master of Business Administration. He is the only U.S. President to have earned an M.B.A.
In late 1972 and early 1973, he drilled with the 187th Tactical Reconnaissance Group of the Alabama Air National Guard, having moved to Montgomery, Alabama to work on the unsuccessful U.S. Senate campaign of Republican Winton M. Blount. In October 1973, Bush was discharged from the Texas Air National Guard and transferred to inactive duty in the Air Force Reserve. He was honorably discharged from the Air Force Reserve on November 21, 1974.
Prior to his marriage, Bush had multiple episodes of alcohol abuse. In one instance, on September 4, 1976, he was arrested near his family's summer home in Kennebunkport, Maine, for driving under the influence of alcohol. He pleaded guilty, was fined $150 and had his Maine driver's license suspended until 1978. Bush's alleged usage of drugs is less clear; when asked questions about alleged past illicit drug use, Bush has consistently refused to answer. He defended his refusal to answer in a publicized casual conversation with a friend, saying that he feared setting a bad example for the younger generation.
Bush says his wife has had a stabilizing effect on his life, and attributes to her influence his 1986 decision to give up alcohol. While Governor of Texas, Bush said of his wife, "I saw an elegant, beautiful woman who turned out not only to be elegant and beautiful, but very smart and willing to put up with my rough edges, and I must confess has smoothed them off over time."
Bush moved his family to Washington, D.C. in 1988 to work on his father's campaign for the U.S. presidency. He worked as a campaign adviser and served as liaison to the media; he assisted his father by campaigning across the country. Returning to Texas after the successful campaign, he purchased a share in the Texas Rangers baseball franchise in April 1989, where he served as managing general partner for five years. He actively led the team's projects and regularly attended its games, often choosing to sit in the open stands with fans. The sale of Bush's shares in the Rangers in 1998 brought him over $15 million from his initial $800,000 investment.
In December 1991, Bush was one of seven people named by his father to run his father's 1992 Presidential re-election campaign as "campaign advisor". The prior month, Bush had been asked by his father to tell White House chief of staff John H. Sununu that he should resign.
As Bush's brother, Jeb, sought the governorship of Florida, Bush declared his candidacy for the 1994 Texas gubernatorial election. His campaign focused on four themes: welfare reform, tort reform, crime reduction, and education improvement. Bush's campaign advisers were Karen Hughes, Joe Allbaugh, and Karl Rove.
After easily winning the Republican primary, Bush faced popular Democratic incumbent Governor Ann Richards. In the course of the campaign, Bush pledged to sign a bill allowing Texans to obtain permits to carry concealed weapons. Richards had vetoed the bill, but Bush signed it after he became governor. According to ''The Atlantic Monthly'', the race "featured a rumor that she was a lesbian, along with a rare instance of such a tactic's making it into the public record – when a regional chairman of the Bush campaign allowed himself, perhaps inadvertently, to be quoted criticizing Richards for 'appointing avowed homosexual activists' to state jobs". ''The Atlantic'', and others, connected the lesbian rumor to Karl Rove, but Rove denied being involved. Bush won the general election with 53.5% against Richards' 45.9%.
Bush used a budget surplus to push through Texas's largest tax-cut, $2 billion. He extended government funding for organizations providing education of the dangers of alcohol and drug use and abuse, and helping to reduce domestic violence. Critics contended that during his tenure, Texas ranked near the bottom in environmental evaluations, but supporters pointed to his efforts to raise the salaries of teachers and improved educational test scores.
In 1998, Bush won re-election with a record 69% of the vote. He became the first governor in Texas history to be elected to two consecutive four-year terms. For most of Texas history, governors served two-year terms; a constitutional amendment extended those terms to four years starting in 1975. In his second term, Bush promoted faith-based organizations and enjoyed high approval ratings. He proclaimed June 10, 2000 to be Jesus Day in Texas, a day on which he "urge[d] all Texans to answer the call to serve those in need".
Throughout Bush's first term, national attention focused on him as a potential future presidential candidate. Following his re-election, speculation soared. Within a year, he decided to seek the Republican nomination for the presidency.
Bush portrayed himself as a compassionate conservative. He campaigned on a platform that included increasing the size of the United States Armed Forces, cutting taxes, improving education, and aiding minorities. By early 2000, the race had centered on Bush and McCain.
Bush won the Iowa caucuses, but, although he was heavily favored to win the New Hampshire primary, he trailed McCain by 19% and lost that primary. However, the Bush campaign regained momentum and, according to political observers, effectively became the front runner after the South Carolina primary, which according to ''The Boston Globe'' made history for its negativity; ''The New York Times'' described it as a smear campaign.
Bush continued to campaign across the country and touted his record as Governor of Texas. Bush's campaign criticized his Democratic opponent, incumbent Vice President Al Gore, over gun control and taxation.
When the election returns came in on November 7, Bush won 29 states, including Florida. The closeness of the Florida outcome led to a recount. The initial recount also went to Bush, but the outcome was tied up in courts for a month until reaching the U.S. Supreme Court. On December 9, in a controversial ruling the ''Bush v. Gore'' case the Court reversed a Florida Supreme Court decision ordering a third count, and stopped an ordered statewide hand recount based on the argument that the use of different standards among Florida's counties violated the Equal Protection Clause of the Fourteenth Amendment. The machine recount showed that Bush had won the Florida vote by a margin of 537 votes out of six million cast. Although he received 543,895 fewer individual votes than Gore nationwide, Bush won the election, receiving 271 electoral votes to Gore's 266.
The Bush campaign advertised across the U.S. against Democratic candidates, including Bush's emerging opponent, Massachusetts Senator John Kerry. Kerry and other Democrats attacked Bush on the Iraq War, and accused him of failing to stimulate the economy and job growth. The Bush campaign portrayed Kerry as a staunch liberal who would raise taxes and increase the size of government. The Bush campaign continuously criticized Kerry's seemingly contradictory statements on the war in Iraq, and argued that Kerry lacked the decisiveness and vision necessary for success in the War on Terror.
In the election, Bush carried 31 of 50 states, receiving a total of 286 electoral votes. He won an outright majority of the popular vote (50.7% to his opponent's 48.3%). The previous President to win an outright majority of the popular vote was Bush's father in the 1988 election. Additionally, it was the first time since Herbert Hoover's election in 1928 that a Republican president was elected alongside re-elected Republican majorities in both Houses of Congress. Bush's 2.5% margin of victory was the narrowest ever for a victorious incumbent President, breaking Woodrow Wilson's 3.1% margin of victory against Charles Evans Hughes in the election of 1916.
Many economists and world governments determined that the situation became the worst financial crisis since the Great Depression. Additional regulation over the housing market would have been beneficial, according to former Federal Reserve Chairman Alan Greenspan. Bush, meanwhile, proposed a financial rescue plan to buy back a large portion of the U.S. mortgage market. Vince Reinhardt, a former Federal Reserve economist now at the American Enterprise Institute, said "it would have helped for the Bush administration to empower the folks at Treasury and the Federal Reserve and the comptroller of the currency and the FDIC to look at these issues more closely", and additionally, that it would have helped "for Congress to have held hearings".
In November 2008, over 500,000 jobs were lost, which marked the largest loss of jobs in the United States in 34 years. The Bureau of Labor Statistics reported that in the last four months of 2008, 1.9 million jobs were lost. By the end of 2008, the U.S. had lost a total of 2.6 million jobs.
One of the administration's early major initiatives was the No Child Left Behind Act, which aimed to measure and close the gap between rich and poor student performance, provide options to parents with students in low-performing schools, and target more federal funding to low-income schools. This landmark education initiative passed with broad bipartisan support, including that of Senator Ted Kennedy of Massachusetts. It was signed into law by Bush in early 2002. Many contend that the initiative has been successful, as cited by the fact that students in the U.S. have performed significantly better on state reading and math tests since Bush signed "No Child Left Behind" into law. Critics argue that it is underfunded and that NCLBA's focus on "high stakes testing" and quantitative outcomes is counterproductive.
After being re-elected, Bush signed into law a Medicare drug benefit program that, according to Jan Crawford Greenburg, resulted in "the greatest expansion in America's welfare state in forty years;" the bill's costs approached $7 trillion. In 2007, Bush opposed and vetoed State Children's Health Insurance Program (SCHIP) legislation, which was added by the Democrats onto a war funding bill and passed by Congress. The SCHIP legislation would have significantly expanded federally funded health care benefits and plans to children of some low-income families from about six million to ten million children. It was to be funded by an increase in the cigarette tax. Bush viewed the legislation as a move toward socialized health care, and asserted that the program could benefit families making as much as $83,000 per year who did not need the help.
Bush began his second term by outlining a major initiative to reform Social Security, which was facing record deficit projections beginning in 2005. Bush made it the centerpiece of his domestic agenda despite opposition from some in the U.S. Congress. In his 2005 State of the Union Address, Bush discussed the potential impending bankruptcy of the program and outlined his new program, which included partial privatization of the system, personal Social Security accounts, and options to permit Americans to divert a portion of their Social Security tax (FICA) into secured investments. Democrats opposed the proposal to partially privatize the system.
Bush embarked on a 60-day national tour, campaigning vigorously for his initiative in media events, known as the "Conversations on Social Security", in an attempt to gain support from the general public. Despite the energetic campaign, public support for the proposal declined and the House Republican leadership decided not to put Social Security reform on the priority list for the remainder of their 2005 legislative agenda. The proposal's legislative prospects were further diminished by the political fallout from the Hurricane Katrina in the fall of 2005. After the Democrats gained control of both houses of the Congress as a result of the 2006 midterm elections, the prospects of any further congressional action on the Bush proposal were dead for the remainder of his term in office.
In 2002, Bush announced the Clear Skies Act of 2003, aimed at amending the Clean Air Act to reduce air pollution through the use of emissions trading programs. It was argued, however, that this legislation would have weakened the original legislation by allowing higher levels of pollutants than were permitted at that time. The initiative was introduced to Congress, but failed to make it out of committee.
Bush has said that he believes that global warming is real and has noted that it is a serious problem, but he asserted there is a "debate over whether it's man-made or naturally caused". The Bush Administration's stance on global warming remained controversial in the scientific and environmental communities. Critics have alleged that the administration misinformed the public and did not do enough to reduce carbon emissions and deter global warming.
In 2006, Bush declared the Northwestern Hawaiian Islands a national monument, creating the largest marine reserve to date. The Papahānaumokuākea Marine National Monument comprises 84 million acres (340,000 km2) and is home to 7,000 species of fish, birds, and other marine animals, many of which are specific to only those islands. The move was hailed by conservationists for "its foresight and leadership in protecting this incredible area".
In his 2007 State of the Union Address, Bush renewed his pledge to work toward diminished reliance on foreign oil by reducing fossil fuel consumption and increasing alternative fuel production. Amid high gasoline prices in 2008, Bush lifted a ban on offshore drilling. However, the move was largely symbolic as there is still a federal law banning offshore drilling. Bush said, "This means that the only thing standing between the American people and these vast oil reserves is action from the U.S. Congress." Bush had said in June 2008, "In the long run, the solution is to reduce demand for oil by promoting alternative energy technologies. My administration has worked with Congress to invest in gas-saving technologies like advanced batteries and hydrogen fuel cells.... In the short run, the American economy will continue to rely largely on oil. And that means we need to increase supply, especially here at home. So my administration has repeatedly called on Congress to expand domestic oil production." In his 2008 State of the Union Address, Bush announced that the U.S. would commit $2 billion over the next three years to a new international fund to promote clean energy technologies and fight climate change, saying, "Along with contributions from other countries, this fund will increase and accelerate the deployment of all forms of cleaner, more efficient technologies in developing nations like India and China, and help leverage substantial private-sector capital by making clean energy projects more financially attractive." He also announced plans to reaffirm the United States' commitment to work with major economies, and, through the UN, to complete an international agreement that will slow, stop, and eventually reverse the growth of greenhouse gases; he stated, "This agreement will be effective only if it includes commitments by every major economy and gives none a free ride."
Bush also urged Congress to provide additional funds for border security and committed to deploying 6,000 National Guard troops to the Mexico – United States border. In May–June 2007, Bush strongly supported the Comprehensive Immigration Reform Act of 2007, which was written by a bipartisan group of Senators with the active participation of the Bush administration. The bill envisioned a legalization program for undocumented immigrants, with an eventual path to citizenship; establishing a guest worker program; a series of border and work site enforcement measures; a reform of the green card application process and the introduction of a point-based "merit" system for green cards; elimination of "chain migration" and of the Diversity Immigrant Visa; and other measures. Bush contended that the proposed bill did not amount to amnesty.
A heated public debate followed, which resulted in a substantial rift within the Republican Party, the majority of conservatives opposed it because of its legalization or amnesty provisions. The bill was eventually defeated in the Senate on June 28, 2007, when a cloture motion failed on a 46–53 vote. Bush expressed disappointment upon the defeat of one of his signature domestic initiatives. The Bush administration later proposed a series of immigration enforcement measures that do not require a change in law.
On September 19, 2010, former Israeli Prime Minister Ehud Olmert said that Bush offered to accept 100,000 Palestinian refugees as American citizens if a permanent settlement had been reached between Israel and the Palestinian Authority.
Bush declared a state of emergency in Louisiana on August 27, and in Mississippi and Alabama the following day; he authorized the Department of Homeland Security (DHS) and Federal Emergency Management Agency (FEMA) to manage the disaster, but his announcement failed to spur these agencies to action. The eye of the hurricane made landfall on August 29, and New Orleans began to flood due to levee breaches; later that day, Bush declared that a major disaster existed in Louisiana, officially authorizing FEMA to start using federal funds to assist in the recovery effort. On August 30, DHS Secretary Michael Chertoff declared it "an incident of national significance", triggering the first use of the newly created National Response Plan. Three days later, on September 2, National Guard troops first entered the city of New Orleans. The same day, Bush toured parts of Louisiana, Mississippi, and Alabama and declared that the success of the recovery effort up to that point was "not enough".
As the disaster in New Orleans intensified, critics charged that Bush was misrepresenting his administration's role in what they saw as a flawed response. Leaders attacked Bush for having appointed apparently incompetent leaders to positions of power at FEMA, notably Michael D. Brown; it was also argued that the federal response was limited as a result of the Iraq War and Bush himself did not act upon warnings of floods. Bush responded to mounting criticism by accepting full responsibility for the federal government's failures in its handling of the emergency. It has been argued that with Katrina, Bush passed a political tipping point from which he would not recover.
Although Congressional investigations have focused on whether the Justice Department and the White House were using the U.S. Attorney positions for political advantage, no official findings have been released. On March 10, 2008, the Congress filed a federal lawsuit to enforce their issued subpoenas. On July 31, 2008, a United States district court judge ruled that Bush's top advisers were not immune from Congressional subpoenas.
In August 2009, Karl Rove and Harriet Miers testified before the House Judiciary Committee. A Justice Department inquiry into the firing of U.S. attorneys concluded that political considerations played a part in as many as four of the dismissals. In July 2010, the Justice Department prosecutors closed the two-year investigation without filing charges after determining that the firings were inappropriately political, but not criminal. According to the prosecutors, "Evidence did not demonstrate that any prosecutable criminal offense was committed with regard to the removal of David Iglesias. The investigative team also determined that the evidence did not warrant expanding the scope of the investigation beyond the removal of Iglesias."
During his Presidential campaign, Bush's foreign policy platform included support for a stronger economic and political relationship with Latin America, especially Mexico, and a reduction of involvement in "nation-building" and other small-scale military engagements. The administration pursued a national missile defense. Bush was an advocate of China's entry into the World Trade Organization. He said open trade was a force for freedom in China.
After the September 11 attacks, Bush launched the War on Terror, in which the United States military and an international coalition invaded Afghanistan. In 2003, Bush launched the invasion of Iraq, which he described as being part of the War on Terrorism.
Those invasions led to the toppling of the Taliban regime in Afghanistan and the removal of Saddam Hussein from power in Iraq as well as the deaths of many Iraqis, with surveys indicating between four hundred thousand to over one million dead, excluding the tens of thousands of civilians in Afghanistan.
Bush began his second term with an emphasis on improving strained relations with European nations. He appointed long-time adviser Karen Hughes to oversee a global public relations campaign. Bush lauded the pro-democracy struggles in Georgia and Ukraine.
In March 2006, a visit to India led to renewed ties between the two countries, reversing decades of U.S. policy. The visit focused particularly on areas of nuclear energy and counter-terrorism cooperation, discussions that would lead eventually to the U.S.-India Civil Nuclear Agreement. This is in stark contrast to the stance taken by his predecessor, Clinton, whose approach and response to India after the 1998 nuclear tests was that of sanctions and hectoring. The relationship between India and the United States was one that dramatically improved during Bush's tenure.
Midway through Bush's second term, it was questioned whether Bush was retreating from his freedom and democracy agenda, highlighted in policy changes toward some oil-rich former Soviet republics in central Asia.
In an address before both Houses of Congress on September 20, 2001, Bush thanked the nations of the world for their support following the September 11 attacks. He specifically thanked British Prime Minister Tony Blair for traveling to the Washington to show "unity of purpose with America", and said "America has no truer friend than Great Britain."
Some national leaders alleged abuse by U.S. troops and called for the U.S. to shut down the Guantanamo Bay detention camp and other such facilities. Dissent from, and criticism of, Bush's leadership in the War on Terror increased as the war in Iraq expanded. In 2006, a National Intelligence Estimate expressed the combined opinion of the United States' own intelligence agencies, concluding that the Iraq War had become the "cause célèbre for jihadists" and that the jihad movement was growing.
Efforts to kill or capture al-Qaeda leader Osama bin Laden failed as he escaped a battle in December 2001 in the mountainous region of Tora Bora, which the Bush Administration later acknowledged to have resulted from a failure to commit enough U.S. ground troops. It was not until May 2011, two years after Bush left office, that Bin Laden was killed by U.S. forces. Bin Laden's successor, Ayman al-Zawahiri, as well as the leader of the Taliban, Mohammed Omar, remain at large.
Despite the initial success in driving the Taliban from power in Kabul, by early 2003 the Taliban was regrouping, amassing new funds and recruits. In 2006, the Taliban insurgency appeared larger, fiercer and better organized than expected, with large-scale allied offensives such as Operation Mountain Thrust attaining limited success. As a result, Bush commissioned 3,500 additional troops to the country in March 2007.
In the latter half of 2002, CIA reports contained assertions of Saddam Hussein's intent of reconstituting nuclear weapons programs, not properly accounting for Iraqi biological and chemical weapons, and that some Iraqi missiles had a range greater than allowed by the UN sanctions. Contentions that the Bush Administration manipulated or exaggerated the threat and evidence of Iraq's weapons of mass destruction capabilities would eventually become a major point of criticism for the president.
In late 2002 and early 2003, Bush urged the United Nations to enforce Iraqi disarmament mandates, precipitating a diplomatic crisis. In November 2002, Hans Blix and Mohamed ElBaradei led UN weapons inspectors in Iraq, but were advised by the U.S. to depart the country four days prior to the U.S. invasion, despite their requests for more time to complete their tasks. The U.S. initially sought a UN Security Council resolution authorizing the use of military force but dropped the bid for UN approval due to vigorous opposition from several countries.
The war effort was joined by more than 20 other nations (most notably the United Kingdom), designated the "coalition of the willing". The invasion of Iraq commenced on March 20, 2003, and the Iraqi military was quickly defeated. The capital, Baghdad, fell on April 9, 2003. On May 1, Bush declared the end of major combat operations in Iraq. The initial success of U.S. operations increased his popularity, but the U.S. and allied forces faced a growing insurgency led by sectarian groups; Bush's "Mission Accomplished" speech was later criticized as premature. From 2004 until 2007, the situation in Iraq deteriorated further, with some observers arguing that there was a full scale civil war in Iraq. Bush's policies met with criticism, including demands domestically to set a timetable to withdraw troops from Iraq. The 2006 report of the bipartisan Iraq Study Group, led by James Baker, concluded that the situation in Iraq was "grave and deteriorating". While Bush admitted that there were strategic mistakes made in regards to the stability of Iraq, he maintained he would not change the overall Iraq strategy. In January 2005, free, democratic elections were held in Iraq for the first time in 50 years. According to Iraqi National Security Advisor Mowaffak al-Rubaie, "This is the greatest day in the history of this country." Bush praised the event as well, saying that the Iraqis "have taken rightful control of their country's destiny". This led to the election of Jalal Talabani as President and Nouri al-Maliki as Prime Minister of Iraq. A referendum to approve a constitution in Iraq was held in October 2005, supported by the majority Shiites and many Kurds.
On January 10, 2007, Bush addressed the nation regarding the situation in Iraq. In this speech, he announced a surge of 21,500 more troops for Iraq, as well as a job program for Iraqis, more reconstruction proposals, and $1.2 billion for these programs. On May 1, 2007, Bush used his veto for only the second time in his presidency, rejecting a congressional bill setting a deadline for the withdrawal of U.S. troops. Five years after the invasion, Bush called the debate over the conflict "understandable" but insisted that a continued U.S. presence there was crucial.
In March 2008, Bush praised the Iraqi government's "bold decision" to launch the Battle of Basra against the Mahdi Army, calling it "a defining moment in the history of a free Iraq". He said he would carefully weigh recommendations from his commanding General David Petraeus and Ambassador Ryan Crocker about how to proceed after the end of the military buildup in the summer of 2008. He also praised the Iraqis' legislative achievements, including a pension law, a revised de-Baathification law, a new budget, an amnesty law, and a provincial powers measure that, he said, set the stage for the Iraqi elections.
On July 31, 2008, Bush announced that with the end of July, American troop deaths had reached their lowest number—thirteen—since the war began in 2003. Due to increased stability in Iraq, Bush announced the withdrawal of additional American forces. This reflected an emerging consensus between the White House and the Pentagon that the war has "turned a corner". He also described what he saw as the success of the 2007 troop surge.
On October 17, 2006, Bush signed into law the Military Commissions Act of 2006, a law enacted in the wake of the Supreme Court's decision on ''Hamdan v. Rumsfeld'', , which allows the U.S. government to prosecute unlawful enemy combatants by military commission rather than a standard trial. The law also denies them access to ''habeas corpus'' and bars the torture of detainees, but allows the president to determine what constitutes torture.
On March 8, 2008, Bush vetoed H.R. 2082, a bill that would have expanded congressional oversight over the intelligence community and banned the use of waterboarding as well as other forms of interrogation not permitted under the United States Army Field Manual on Human Intelligence Collector Operations, saying that "the bill Congress sent me would take away one of the most valuable tools in the war on terror". In April 2009, the ACLU sued and won release of the secret memos that had authorized the Bush administration's interrogation tactics. One memo detailed specific interrogation tactics including a footnote that described waterboarding as torture as well as that the form of waterboarding used by the CIA was far more intense than authorized by the Justice Department.
Bush also expressed U.S. support for the defense of Taiwan following the stand-off in April 2001 with the People's Republic of China over the Hainan Island incident, when an EP-3E Aries II surveillance aircraft collided with a People's Liberation Army Air Force jet, leading to the detention of U.S. personnel. In 2003–2004, Bush authorized U.S. military intervention in Haiti and Liberia to protect U.S. interests. Bush condemned the militia attacks Darfur and denounced the killings in Sudan as genocide. Bush said that an international peacekeeping presence was critical in Darfur, but opposed referring the situation to the International Criminal Court.
In his State of the Union address in January 2003, Bush outlined a five-year strategy for global emergency AIDS relief, the President's Emergency Plan for AIDS Relief. Bush announced $15 billion for this effort which directly supported life-saving antiretroviral treatment for more than 3.2 million men, women and children worldwide.
In August 2006, Bush became the first serving president to contract and be treated for Lyme disease.
On June 10, 2007, he met with Albanian Prime Minister Sali Berisha and became the first president to visit Albania. Bush has voiced his support for the independence of Kosovo.
Bush opened the 2002 Winter Olympics in Salt Lake City. Departing from previous practice, he stood among a group of U.S. athletes rather than from a ceremonial stand or box, saying: "On behalf of a proud, determined, and grateful nation, I declare open the Games of Salt Lake City, celebrating the Olympic Winter Games." In 2008, in the course of a good-will trip to Asia, he attended the Summer Olympics in Beijing.
On October 3, 2005, Bush nominated White House Counsel Harriet Miers for O'Connor's position; after facing significant opposition, she asked that her name be withdrawn on October 27. Four days later, on October 31, Bush nominated federal appellate judge Samuel Alito for the position and he was confirmed as the 110th Supreme Court Justice on January 31, 2006.
In addition to his two Supreme Court appointments, Bush appointed 61 judges to the United States Courts of Appeals and 261 judges to the United States district courts. Each of these numbers, along with his total of 324 judicial appointments, is third in American history, behind both Ronald Reagan and Bill Clinton. Bush experienced a number of judicial appointment controversies, as 39 people nominated to 27 federal appellate judgeships were blocked by the Senate Democrats either in the Senate Judiciary Committee or on the Senate floor using a filibuster.
Bush's intelligence has been satirized by the media, comedians, and other politicians. Detractors tended to cite linguistic errors made by Bush during his public speeches, which are colloquially termed as Bushisms. Editorials in ''Harper's Magazine'', ''Rolling Stone'', ''The Washington Post'', ''Common Dreams NewsCenter'', and ''The Nation'' have referred to Bush as "the worst president ever". In contrast to his father, who was perceived as having troubles with an overarching unifying theme, Bush embraced larger visions and was seen as a man of larger ideas and associated huge risks. Tony Blair wrote in 2010 that the caricature of Bush as being dumb is "ludicrous" and that Bush is "very smart".
In 2000 and again in 2004, ''Time'' magazine named George W. Bush as its Person of the Year, a title awarded to someone who the editors believe "has done the most to influence the events of the year". In May 2004, Gallup reported that 89% of the Republican electorate approved of Bush. However, the support waned due mostly to a minority of Republicans' frustration with him on issues of spending, illegal immigration, and Middle Eastern affairs.
Within the United States armed forces, according to an unscientific survey, the president was strongly supported in the 2004 presidential elections. While 73% of military personnel said that they would vote for Bush, 18% preferred his Democratic rival, John Kerry. According to Peter Feaver, a Duke University political scientist who has studied the political leanings of the U.S. military, members of the armed services supported Bush because they found him more likely than Kerry to complete the War in Iraq.
Bush's approval rating went below the 50% mark in AP-Ipsos polling in December 2004. Thereafter, his approval ratings and approval of his handling of domestic and foreign policy issues steadily dropped. Bush received heavy criticism for his handling of the Iraq War, his response to Hurricane Katrina and to the Abu Ghraib prisoner abuse, NSA warrantless surveillance, the Plame affair, and Guantanamo Bay detention camp controversies.
Polls conducted in 2006 showed an average of 37% approval ratings for Bush, the lowest for any second-term president at that point of his term since Harry S. Truman in March 1951, when Truman's approval rating was 28%, which contributed to what Bush called the "thumping" of the Republican Party in the 2006 mid-term elections. Throughout 2007, Bush's approval rating hovered in the mid-thirties, although in an October 17, 2007, Reuters poll, Bush received a lower approval rating of 24%, the lowest point of his presidency.

In September 2008, in polls performed by various agencies, Bush's approval rating ranged from 19%—the lowest ever—to 34%. and his disapproval rating stood at 69%. Bush left the White House as one of the most unpopular American presidents, second in unpopularity only to Richard Nixon.
In response to his poll numbers and "worst president" accusations, Bush said, "I frankly don't give a damn about the polls.... To assume that historians can figure out the effect of the Bush administration before the Bush administration has ended is ... in my mind ... not an accurate reflection upon how history works."
In 2006, 744 professional historians surveyed by Siena College regarded Bush's presidency as follows: Great: 2%; Near Great: 5%; Average: 11%; Below Average: 24%; Failure: 58%. Thomas Kelly, professor emeritus of American studies at Siena College, said that "In this case, current public opinion polls actually seem to cut the President more slack than the experts do." Similar outcomes were retrieved by two informal surveys done by the History News Network in 2004 and 2008.
A March 13, 2008, poll by the Pew Research Center for the People and the Press reported that 53% of Americans—a slim majority—believe that "the U.S. will ultimately succeed in achieving its goals" in Iraq. That figure was up from 42% in September 2007 and the highest since 2006.
A 2010 Siena College poll of 238 Presidential scholars found that Bush was ranked 39th out of 43, with poor ratings in handling of the economy, communication, ability to compromise, foreign policy accomplishments and intelligence.
Calls for Bush's impeachment were made, though most polls showed a plurality of Americans did not support the president's impeachment. The reasoning behind impeachment usually centered on the NSA warrantless surveillance controversy, the Bush administration's justification for the war in Iraq, and alleged violations of the Geneva Conventions. Representative Dennis Kucinich, a Democrat from Ohio, introduced 35 articles of impeachment on the floor of the House of Representatives against Bush on June 9, 2008, but Speaker Nancy Pelosi declared that impeachment was "off the table".
Bush was described as having especially close personal relationships with Tony Blair and Vicente Fox, although formal relations were sometimes strained. Other leaders, such as Afghan president Hamid Karzai, Ugandan president Yoweri Museveni, Spanish prime minister José Luis Rodríguez Zapatero, and Venezuelan president Hugo Chávez, have openly criticized the president. Later in Bush's presidency, tensions arose between himself and Vladimir Putin, which has led to a cooling of their relationship.
In 2006, a majority of respondents in 18 of 21 countries surveyed around the world were found to hold an unfavorable opinion of Bush. Respondents indicated that they judged his administration as negative for world security. In 2007, the Pew Global Attitudes Project reported that during the Bush presidency, attitudes towards the United States and the American people became less favorable around the world.
A March 2007 survey of Arab opinion conducted by Zogby International and the University of Maryland found that Bush was the most disliked leader in the Arab world.
The Pew Research Center's 2007 Global Attitudes poll found that out of 47 countries, a majority of respondents expressed "a lot of confidence" or "some confidence" in Bush in only nine countries: Ethiopia, Ghana, India, Israel, Ivory Coast, Kenya, Mali, Nigeria, and Uganda.
During a June 2007 visit to the predominantly Muslim Eastern European nation of Albania, Bush was greeted enthusiastically. Albania has a population of 3.6 million, has troops in both Iraq and Afghanistan, and the country's government is highly supportive of American foreign policy. A huge image of the President was hung in the middle of the capital city of Tirana flanked by Albanian and American flags while a local street was named after him. A shirt-sleeved statue of Bush was unveiled in Fushe-Kruje, a few kilometers northwest of Tirana. The Bush administration's support for the independence of Albanian-majority Kosovo, while endearing him to the Albanians, has troubled U.S. relations with Serbia, leading to the February 2008 torching of the U.S. embassy in Belgrade.
Since leaving office, Bush has kept a relatively low profile. However, he has made appearances at various events throughout the Dallas/Fort Worth area, most notably when he conducted the opening coin toss at the Dallas Cowboys first game in the team's new Cowboys Stadium in Arlington. An April 6, 2009, visit to a Texas Rangers game, where he gave a speech thanking the people of Dallas for helping them settle in (and specifically, the people of Arlington, where the game was held), was met with a standing ovation.
His first speaking engagement occurred on March 17, 2009, in Calgary, Alberta. He spoke at a private event "A conversation with George W. Bush" at the Telus Convention Centre and stated that he would not criticize President Barack Obama and hoped he succeeds, specifically stating, "[President Obama] deserves my silence." During his speech, Bush announced that he had begun writing a book, which was published under the title ''Decision Points'' in 2010. The book focused on the "12 difficult personal and political decisions" Bush faced during his presidency. On May 29, 2009, Bush and former President Bill Clinton appeared at a policy discussion at the Metro Toronto Convention Centre, moderated by Frank McKenna, the former Canadian Ambassador to the United States.
Bush made a video-taped appearance on the June 11, 2009, episode of ''The Colbert Report'' during the show's trip to Baghdad, Iraq. Bush praised the troops for earning a "special place in American history" and for their courage and endurance. He joked that it would come in handy, saying, "I've sat through Stephen's stuff before," in reference to Colbert's performance at the 2006 White House Correspondents' Association dinner as well as ''The Colbert Report''s history of satirizing Bush's administration.
On August 29, 2009, Bush, with his wife Laura, attended the funeral of Senator Ted Kennedy. Bush made his debut as a motivational speaker on October 26 at the "Get Motivated" seminar in Dallas. In the aftermath of the Fort Hood shooting that took place on November 5, 2009 in Texas, Fox News Channel reported that Bush and his wife had paid an undisclosed visit to the survivors and victims' families the day following the shooting, having contacted the base commander requesting that the visit be private and not involve press coverage. The Bushes own property less than 30 minutes from Fort Hood and spent one to two hours at the base.
In January 2010, at President Barack Obama's request, Bush and former President Bill Clinton established the Clinton Bush Haiti Fund to raise contributions for relief and recovery efforts following the 2010 Haiti earthquake.
When asked in February 2010 about his low profile since leaving office, Bush replied "I have no desire to see myself on television... I don't want to be a panel of formers instructing the currents on what to do. ... I'm trying to regain a sense of anonymity. I didn't like it when a certain former president – and it wasn't 41 (George H.W. Bush) or 42 (Bill Clinton) – made my life miserable." Bush was referring to 39th President Jimmy Carter, who was an outspoken critic of Bush throughout his presidency.
On June 2, 2010, during a speaking engagement at the Economic Club of Grand Rapids, Michigan, Bush referred to the waterboarding of Khalid Sheikh Mohammed by saying, "I'd do it again to save lives."
On October 19, 2010, Bush reflected both humorously and seriously on his presidency in a speech at the University of Texas at Tyler. A dinner preceding his speech raised more than $200,000 for the university's scholarship fund.
Bush attended every home playoff game for the Texas Rangers 2010 season and, accompanied by his father, threw out the ceremonial first pitch at Rangers Ballpark in Arlington for Game 4 of the 2010 World Series on October 31, 2010.
Bush worked with Christopher Michel on ''Decision Points'', a Bush memoir which was released November 9, 2010. Michel was the Deputy Director of Speechwriting to the President of the United States during the second term of the Bush Administration. During a pre-release appearance promoting the book, Bush commented on his view of his legacy as president, saying he considered his biggest accomplishment to be keeping "the country safe amid a real danger", and his greatest failure to be his inability to secure the passage of Social Security reform.
After Bush announced a planned visit to Switzerland in 2011, Amnesty International, in a memorandum to the Swiss authorities in February 2011, asked Switzerland to uphold its "obligations under international law" to arrest and detain the former president for "his alleged involvement in and responsibility for crimes under international law, including torture...." Event organizers, United Israel Appeal, canceled the visit. Reports differ over whether the cancellation was because organizers feared Bush's arrest for war crimes, or, as was stated by the event organizer's lawyer, the event was canceled to avoid the prospect of violent protests. Human rights groups have vowed to continue to seek Bush's arrest.
On May 2, 2011, President Barack Obama called Bush, who was at a restaurant with his wife, to inform him that Osama bin Laden was dead.
