At 7:30 am on on Friday, 27 November [2009], we penetrated into the sacred zone surrounding 84 rue de Villiers in Levallois-Perret, the offices of the French CIA.[2] Ever since they started taking all of our friends there, one could legitimately wonder what this mysterious place would be like. In truth, it completely resembles a four-star hotel for American seminarians, with its glass hall and its disgusting prefabricated outbuildings (which, one notes in passing, are the rooms that they have precisely reserved for our friends). This time, it was Christophe[3] who paid the price of the armed despair of Judge Fragnoli, once more lacking [new] developments [in the case]. Christophe is, it seems, accused of being too close to some of those who were indicted, in particular, his wife Manon, who he regularly sees, according to sources close to the case. We decided to throw him a little party.

On Friday the 27th, at the break of day, and when his lawyer was first able to see him (the 72d hour of his detention having come), twenty people wearing sunglasses and carrying umbrellas congregated around a mini-van parked just opposite the aforementioned prefabricated elements. From the vehicle came a hoarse and wild music, to which the cries of the small bizarre and dancing crowd responded. Looking more carefully, it seemed that, ensconced in the glove compartment below the vehicle's ceiling, two suspect individuals were busying themselves with a drum and a howling synthesizer. The sound managed to penetrate the sound-proofed depths and the incipient deafness of our comrade, who -- his lawyer assures us -- heard something.

Such an unusual crowd troubled the agents of the SDAT, who no doubt did not feel like making arrests, armed and masked, for "early-morning disturbance of the peace on a public road in furtherance of a terrorist enterprise." Disconcerted by this thorny case, they finally appealed for help from the police of the normal people, who in turn were quite annoyed. The four poor agents desperately sought someone in charge and identification papers, but only obtained gurgling sounds in Italian and a sincere interpretation of [the old naval song] "It is a little ship." Everyone left without fanfare and at first were mechanically followed by the men in blue, who quickly gave up following something that they could not name.

About the Book:

It's sometime around 7:00 a.m., on December 4, 1969, and attorney Jeff Haas is in
the Monroe Street police lockup in Chicago, interviewing Fred Hampton's fianc?e.
Only four hours earlier, she was lying in bed next to Hampton when the police burst
into their apartment. She is still in her nightgown, describing how the police
pulled her from the room as Fred lay unconscious on their bed. She heard one officer
say, "He's still alive." She then heard two shots. A second officer said, "He's good
and dead now." She looks at Jeff and asks, "What can you do?"

The Assassination of Fred Hampton is attorney Jeff Haas's personal account of the
eighteen-month trial in which he and People's Law Office partner Flint Taylor
pursued Hampton's assassins, ultimately prevailing over FBI stonewalling and
unlimited government resources bent on hiding the conspiracy that led to Hampton's
death. The book not only tells the story of justice delivered but also puts Hampton
in a new light as a dynamic community leader whose dedication to his people and to
truth telling inspired the young lawyers of the People's Law Office, solidifying
their lifelong commitment to fighting injustice.

Jeff Haas has spent his career working for justice. In 1969 he and three other
lawyers set up the People's Law Office, whose clients included the Black Panthers,
SDS, and other political activists. Haas went on to handle cases involving
prisoners' rights, police torture, and the wrongfully accused. He lives in Santa Fe,
New Mexico, with his wife and children and continues to represent victims of police
brutality.

Anarchist, New Afrikan political prisoner Ojore Lutalo was recently
released from prison. He served 26 years, most of it in isolation, or
"the hole," all in the service of revolutionary struggle. The NYC
branch of the Anarchist Black Cross Federation has set up a gift
registry to insure that of the challenges of shifting from prisoner
to civilian, having basic apartment furnishings is not among them.
New Afrikan Anarchist Political Prisoner, Ojore N. Lutalo, is out
after 26 years of imprisonment!

Ojore Lutalo was locked down in Trenton, New Jersey, for actions
carried out in the fight for Black Liberation. In Ojore's own words,
he is, "serving a parole violation sentence (we received 14 to 17
years) stemming from a 1977 conviction for expropriating monies from
a capitalist state bank (in order to finance our activities) and
engaging the police in a gun battle in December 1975 in order to
effect our departure from the bank, and to ensure success of the
military operation..." "After my parole violation sentence terminated
in December 1987, I started serving a forty year sentence with a
twenty year parole ineligibility (I was paroled in 1980, and I have
been back in captivity since April 20, 1982) that I have received in
1982 for having a gun-fight with a drug dealer. The overall strategy
of assaulting a drug dealer is to secure monies to finance one's
activities, and to rid the oppressed communities of drug dealers."

Ojore was originally arrested with New Afrikan prisoner of war Kojo
Bomani Sababu, and was struggling with comrade Andaliwa Clark.
Andaliwa was killed in action within the confines of New Jersey's
infamous Trenton State Prison after he shot two of the prison's
security guards in the repressive Management Control Unit (M.C.U.) on
January 19th, 1976 when they tried to stop him from escaping from
captivity. Ojore was a comrade of the late Kuwasi Balagoon, a New
Afrikan
anarchist prisoner of war, and states, "I've been involved in the
struggle, the war against the fascist state since 1970. I've been an
anarchist since 1975 without any regrets. Prior to my involvement in
the struggle, I was just another apolitical lumpen (bandit) here in
Amerika." "I was... influenced and highly motivated by the Black
Liberation Army (B.L.A.) here in Amerika.

Carrie Feldman is still being held on civil contempt and needs our support
and solidarity. She’ll remain in custody over the long weekend as state
officials enjoy time with their families. We can’t let them go back to an
easy work day come Monday while they continue to hold our friend in civil
contempt for taking a principled stand against state repression!

THIS MONDAY, November 30, CALL IN to Cronk’s boss, US Attorney Nicholas
Klinefeldt, from 9am to 4pm to demand that they dismiss Carrie’s subpoena
and release her immediately.

In the hearings so far, Cronk has attempted to use our statements of
support against Carrie and Scott by twisting our words and arguing that
using our right to free speech and to petition the government for a
redress of grievances is a reflection of their bad moral character.
Ridiculous, we know. While his arguments haven’t met with much success
yet, we don’t need to give him anything with which to hurt our friends.

When you call in to demand Carrie’s release, please follow the sample
script below and don’t allow them to trick you into saying something that
they can twist around to hurt her:

detention of Carrie Feldman for her refusal to testify to a grand jury in
Davenport initiated by your Assistant US Attorney, Cliff Cronk. This grand
jury is being used to investigate political activity, and by extension her

refuse to answer questions regardless of her detention, so her
incarceration for civil contempt becomes a punitive action. I urge you to

Federal Prosecutor Tries to Keep Minneapolis Activists Jailed for Their
Political Beliefs
Federal court hearing expected today for Scott DeMuth charged under the
Animal Enterprise Terrorism Act

Davenport, IA -- Using sensational and inflammatory language, the federal
government accused recently indicted activist Scott DeMuth last Wednesday
of being a “domestic terrorist” in an effort to keep him imprisoned until
trial. DeMuth, a Dakota activist from Minneapolis who has worked for many
years to support political prisoners, was indicted November 18th for
conspiracy to “commit animal enterprise terrorism and cause economic
damage to the animal enterprise in an amount exceeding $10,000.” The
indictment is related to an Animal Liberation Front (ALF) action at the
University of Iowa in 2004, in which research equipment was damaged and
hundreds of animals were set free. The indictment came a day before the
statute of limitations on the 2004 action was to expire. DeMuth will be
tried under the Animal Enterprise Terrorism Act, widely criticized by
groups such as the Center for Constitutional Rights as unconstitutional.

Prosecutor Cliff Cronk argued that DeMuth's association with anarchist
movements makes him a domestic terrorist, illuminating the larger issue of
"terrorism" being redefined in order to suppress dissent. Anarchism is a
political ideology whose adherents believe in cooperation rather than
coercion.

“Political beliefs are not a legitimate reason to detain a defendant
awaiting trial,” said Thomas Addo of Earth Warriors are OK! “By
sensationalizing DeMuth’s political work and beliefs, the federal
government attempts to divert attention from the fact that they have
little to no evidence with which to prosecute him,” continued Addo. “As a
graduate student in the Sociology Department, as well as a Dakota language
student at the University of Minnesota, DeMuth is well integrated in the
Minneapolis community and should be released in order to continue his
studies.”

DeMuth was jailed on November 17th along with Carrie Feldman, another
activist from the Twin Cities, after both of them refused to cooperate
with what they called a politically motivated grand jury. Feldman, who was
found to be in civil contempt, may be forced to remain in jail for the
life of the grand jury, up to 11 more months. In a statement made to the
grand jury before she was found in contempt, Feldman denounced the use of
grand juries as a coercive “tool of the prosecution,” and asserted that
they are used to “investigate and intimidate those who would express
dissent.” Supporters have organized a call-in campaign on Monday to demand
that U.S. Attorney Nicholas Klinefeldt dismiss the subpoena issued for
Feldman and secure her release.

After a psychological evaluation concluded that DeMuth was emotionally
healthy and at no risk of flight, U.S. Magistrate Judge Thomas J. Shields
ruled that DeMuth did not have to remain in jail until trial, and on
Tuesday issued an order for his release. Federal prosecutor Cliff Cronk
responded by filing a motion to keep him in custody on Wednesday, claiming
DeMuth is a danger to the community and a flight risk. So far, the only
evidence Cronk has supplied has been a journal of DeMuth’s children’s
stories and a lock-picking device found in the common foyer of his home.
Both items were seized by police four years after the incident in a raid
prior to the 2008 Republican National Convention that targeted activists.

Supporters claim that DeMuth has become yet another target of the “Green
Scare,” a term used to refer to the Federal government's campaign to
intimidate animal and earth liberation activists. The Green Scare is just
one campaign among many that the Federal government uses to repress social
movements. Other recent targets of grand juries have included the San
Francisco 8 case against former Black Panthers, and the Puerto Rican
Independence movement following the FBI assassination of movement leader
Filiberto Ojeda Rios in 2005.

PROTEST THE DAY OF THE RE-SENTENCING OF THE CUBAN 5!
On June 15th, The U.S. Supreme Court refused to review the case of Gerardo, Ramón,
Antonio, Fernando and René, known as the Cuban 5. Yet another insult on the part of
Made in USA-justice. Despite the worldwide clamor in favor of the freedom of the
five Cuban anti-terrorist fighters, this country’s highest judicial body turned a
“deaf ear” and thus the Cuban 5 remain U.S. held Political Prisoners! Last year, a
federal appeals court ordered new sentences for Fernando Gonzalez, Ramon Labañino,
and Antonio Guerrero. Labañino and Guerrero had been serving life terms, and
Gonzalez was sentenced to 19 years.

U.S. District Judge Lenard, who unjustly sentenced them before, will be
re-sentencing Gonzalez and Labañino on Dec. 8th! Guerrero was already re-sentenced
on Oct. 13th to 21 years and 10 months in jail!

These brothers should not be re-sentenced they should be freed! There was no
evidence provided to convict the Cuban 5 of conspiracy to commit espionage! They are
not spies! Their only crime was fighting against terrorism in Cuba and the U.S.A.!

Francisco Torres has a court date scheduled Thursday, 12/3 at 9am,

It is expected that a date will be set to hear the motion to dismiss
charges against Cisco Torres as well as a date for the preliminary hearing.

Cisco may or may not be present, but it is important that we be a
presence for every court date to show that we are watching and that

Once upon a time, a bird made friends with a
prisoner. Both were incarcerated in the United
States and both were unjustly imprisoned for
defending Cuba from terrorist activity.

This is how the story began. On June 4, 2009,
the same day as his birthday, Gerardo Hernandez
heard about this creature. He found out about it
through a prisoner whose last name was Lira, who
worked in the prison factory. Lira and a guard
were cleaning the roof with a pressure hose and
without meaning to or perhaps without knowing,
they destroyed a nest that contained three
chicks. Two of them died instantly but one
remained alive. They were so tiny that they
didn't even have any feathers. It's possible
that they had just barely hatched.

The guard was visibly moved, and feeling
responsible, allowed Lira to bring the chick
secretly inside the prison to try to save
it. The prisoner arrived with the chick in the
palm of his hand and not knowing what to do with
it, began to ask the other prisoners what to
do. Someone suggested: Ask Cuba [the nickname
the prisoners had given Gerardo]; he likes
animals and surely he will know what to
do." That's how Gerardo came to be summoned, and
he came to the cell where they kept the bird.

Gerardo's first reaction was to whistle,
imitating what he imagined the chick's mother
would have done. He moved his fingers as though
they were little wings. Miraculously, the little
bird opened its beak. Gerardo began to give it
breadcrumbs and later, dipped his fingers in
water and let the drops fall softly into the little bird's beak.

Gerardo didn't want to take the bird to his cell,
but every day he went to feed it. The problem
was that at the beginning, the bird didn't want
to take food from anyone except Gerardo. One day
it occurred to Gerardo to offer the chick a few
slivers of fish, and afterwards the rascal didn't
want breadcrumbs any more. His feathers began to
grow and so Gerardo taught it to eat on its
own. He put the bits of food in the palm of his
hand and the little bird came fearlessly.

However, the prisoners were worried. If an
inspection were to happen, the little bird would
be a problem. Since he was already quite a bit
bigger, they let him loose in the patio so that
he might fly free. The bird flew a little while
and then returned to Gerardo's shoulder. Every
time he tried to fly with the other birds, they
rejected him with little pecks. Little by little he gained confidence.

Gerardo went alone to the wing where his cell
was, but when he returned to the patio, the bird also returned to see him.

Once there were many prisoners in the
patio. Someone told Gerardo that the bird was
perched on the concertina wire surrounding the
prison. Gerardo whistled, and in front of all
the prisoners, the little bird appeared out of
nowhere and landed on his
shoulder. Incredible. Everyone talked about
it.The little bird was named Cardinal, because
Gerardo had painted its tail feathers with a red
marker to distinguish him from all the rest. The
ink affected the bird a bit. It lost its tail
feathers but only for a little while. Later they
grew back, in their natural color. However, the name remained: Cardinal.

On a different occasion another prisoner found
the little bird in the patio with its beak
stretched open. It was very hot, and the bird
was thirsty. Gerardo gave it water. He hid the
bird under his hat in order to go inside without
the bird being seen. Of course the guards
realized he had something odd on his head.
"What's under the hat?" they asked, and Gerardo
answered, "Nothing." Cardinal answered as well,
whistling like crazy. "Don't tell me you're
training him to take messages to Fidel," said one of the guards, laughing.

The story didn't end there. Gerardo brought the
bird to his cell and made a nest for him to stay
there with him. He played with him, letting him
rest on his shoulder, or on his head. When
Gerardo was writing, the bird came to play and
Gerardo would pet him gently, to calm him. So
Cardinal would run along his back, where he'd be
out of reach. Sometimes he curled up inside
Gerardo's collar and slept there. Or he pecked
at his friend's ear and when Gerardo moved his head, he'd go for the other
ear.

Once when Gerardo had let Cardinal go, he flew
toward the cafeteria and landed on the plate of a
very large, tough prisoner who was eating a piece
of chicken. The prisoner caught the bird in his
hands, meaning to strangle him and someone
shouted, "Don"t kill him! He belongs to
Cuba." The outcry took the prisoner by
surprise. He let Cardinal go and asked, surprised, "And who the hell is
Cuba?"

Gerardo was actually very worried. A certain
guard was not showing any mercy toward the little
bird. During an inspection, the guard had forced
Gerardo to let Cardinal go, and closed the door
behind him. The little bird returned later,
completely exhausted. Gerardo let him rest for a
few days inside his cell. And then came the
lockdown (solitary confinement as punishment for
all prisoners), and whenever there's a lockdown, there are inspections.

When Gerardo heard that they were checking all
the space between the floor and the door, he
pushed Cardinal outside. Cardinal flew, within
the wing where Gerardo's cell was located. When
the guard arrived, he saw the box where Cardinal
lived. Gerardo said that this was where his
friend lived, of his own free will: "The problem
is that I take him outside and he returns; it's not my fault."

"Look," said the guard, gesturing as though to
say he thought Gerardo was nuts, "if you think
I'm going to believe that bird is going to return…"

Gerardo whistled from his cell and the guard
froze in his tracks as he watched the bird return.

Cardinal had no problem picking out the cell
belonging to his friend, among the huge array of
cells on two floors that looked exactly alike.

Cardinal arrived at Gerardo's cell. He looked at
him through the bars but couldn't enter (since
this was lockdown). He waited there nervously,
until Gerardo couldn't stand it any more and
opened the slot where food was delivered, and
Cardinal came in. A few days later there was
another inspection. When the guards arrived at
Gerardo's cell, he told them that he had a small
bird, so they wouldn't be scared if the bird
should happen to fly overhead. He was told that
he had to release it, but since none of them
could catch the bird, they brought Gerardo to the
entrance for the entire wing so that he could let it go himself.

Since they were in lockdown, Gerardo and the
little bird walked down the passageway, escorted
by the guards. All the other prisoners saw them
through the bars of their cells and began to
shout: "They're taking Cuba and the bird to the
hole!" as they banged their doors in protest.

The guard shouted, "Calm down! He's not going to
the hole; we're just going to free the bird!"

That was the last time that Gerardo saw
Cardinal. The lockdown lasted a month while the
wing was completely shut down. Gerardo couldn't
leave and Cardinal couldn't enter. The little
bird had been inside this rough high-security
prison since Gerardo's birthday, from June 4th,
and he remained there until July 16th, one day
after the wedding anniversary of Gerardo and his wife, Adriana.

And that's the end of this (true) story.

Alicia Jrapko wrote this story from memory, two
hours after hearing it from Gerardo during a
visit to the maximum security prison in
Victorville, California. Gerardo later revised
and corrected the text, which Alicia plans to
present to Casa Editora Abril so that it can be
published as a children's story. Gerardo is
incarcerated under a double life sentence plus 15
years, for unproven charges made against him in a
highly prejudiced trial in Miami.

Gerardo Hernandez Nordelo was born in Havana on
June 4, 1965; the third child of Gerardo
Hernandez Marta­ and Carmen Nordelo Tejera, both
deceased. He is a graduate of the Raul Roa
Garcia Foreign Services Institute (ISRI). One
year before graduating, he and his wife Adriana
Perez O'Connor were married. He is a cartoonist
and graphic artist who has worked in both Cuba
and the United States. In the mid-1990s, he
served missions in the United States, designed to
protect Cuba from the terrorist actions planned
and executed by counter-revolutionary
organizations located in Miami. On September 12,
1998, he was arrested along with four other men
and subjected to a trial plagued with
irregularities and prejudice, in Miami. He was
convicted, without any evidence whatsoever, and
sentenced to two life terms plus 15 years, which
he is serving in a high security prison in Victorville, California.

Solidarity march in Salonica for imprisoned anarchist on trail

In the run-up to the trial of Ilias Nikolaou, the anarchist arrested last January in relation to an attack against the municipal police in Evosmos, a working class suburb of Salonica, a solidarity march took to the streets of Greece's second city.

On Friday 27 November a thousand strong solidarity demo took to the streets of Salonica, in nothern Greece, in support of Ilias Nikolaou, a local anarchist who was arrested on Jaunary 13 2009 in relation to an attack with an arson mechanism against the headquarters of the municipal police in Evosmos, a working class suburb of the city. Nikolaou who is being held in the prison of Amfissa is denying the accusations against him as well as police claims that he was caught immediately after the attack. The anarchist is one of the 3 comrades that had gone underground in 2006-2007 when the state had ordered their arrest in relation to an arson attack against a french car expo for which another anarchist Vagelis Botzatzis had been also arrested. The 3 had appeared in the central police station of Salonica a day after a mass march in solidarity to their cause, and after being led to the court in police cars besieged by hundreds of protesters were released. Botzatzis had been released after several months in prison due to lack of evidence a few weeks earlier indicating a collapse of the case against them. The subsequent arrest of Nikolaou is believed to be a revenge for the inability of the forces of repression to frame the above for the case, despite it being publicized as a cutting-edge success of the police. Ilias Nikolaou will be tried on December the 2nd, just days before the first anniversary of the December Uprising kicks in. In his owns words, from a letter published from prison last June, «The point for us in not if they are many, if they are organised,, if they have the means to hit us; the point is to give ourselves to the struggle. To the struggle not for some pacifist idea, for a beautiful world or some vague utopia, but to the struggle of dignity, of freedom, of the destruction of power". During the last weeks many attacks against state targets around the country have occurred as acts of solidarity to the accused anarchist.

At the same time, his co-workers have published a communique condemning the police state and demanding the liberation of Nikolaou. We are reproducing the letter here as an example of proletarian solidarity:

HANDS OFF OUR CO-WORKER ILIAS NIKOLAOU

On 13/1 our co-worker Ilias Nikolaou is arrested by Salonica's police, accused of an arson attack against the municipal police of Evosmos. He is badly beaten by the plain clothed cops resulting in two breaks on his arm, but not a single wound on a policeman. The police will claim "resistance upon arrest" (As if there was any chance of them to speak the truth...). AS workers we have ears and eyes. We refuse to enter the bog of stupidity and of course we will not believe the truth of the police. For the truth of the police says that flower-pots raise and beat students, and that Korkoneas shot [Alaxandros Grigoropoulos] as a warning. Our co-worker was led with minimal procedures to the prison of Amfissa, and the police realised its desire to jail Nikolaou. In the last year we have seen cinematic tranfers-abductions every time Ilias has demanded his release. As far as we are concerned, we must say we are on his side.

The day after his arrest another wonder-plan of the police unfolded. Plain-clothed police invaded Nikolaou's house and the findings were restricted (of course) to NOTHING. The scattered and mutilated books on the floor prove the deep love and respect of the police to written discourse...A few hours later they invaded the place where we work and forced us to prove in paper who each was, before starting to search everything. As they found no AK-47 in the rice, no bomb in the custard, no corpse in the cellar, their findings were (of course) restricted to NOTHING. To their insistent questions regarding the reason of their search we were informed that a very serious crime had been committed. If a broken window in the municipal police is a "serious crime", we can imagine if the situation was more serious: they would hang us from trees or parade us with placards on our necks. Amongst all the ridiculous things they did was check the papers of the customers whose crime was to have chosen to eat soup...And when we protested "gentlemen you have checked the cupboard thrice" the answer was inspired by the very democratic principles of Korkoneas: "if I feel like it I will search it 15 times over" (It is fortunate that Nikolaou did not work in the National Telecom in which case they would have to check the papers of 1000 workers and search the building for a couple of days...)

Simultaneously with the invasion of Nikolaou's workplace, 30 policemen invaded his granny's place in a village out of Kozani, upsetting and terrorising her. There too the findings were restricted (of course) to NOTHING. We wonder which dark mind sent 30 policemen to an elderly woman's house. We wonder if a single one of them was ashamed, if a single one of them refused to perform the horrible search. OF COURSE NONE! One question remains unsolved: what were the policemen really searching? Probably the slightest thing, so that "the story stands", this repeatedly badly manufactured police story...the old craft holds strong. In a time that the police is trying to mend up for Korkoneas types' atrocities it should be expected that they will target not only Nikolaou but also his friendly, family, work, and comrade environment. Just as they have done.

We are publicly denouncing the totally cowardly invasion of the Kozani police in Nikolaous parents and granny's houses.
We are publicly denouncing the effort of terrorising us and the police invasion in our workplace.
We are denouncing the effort to upgrade a broken window into a "serious crime" just so that the police can show off its productivity.
We are calling on anyone who is really thinking freely and whoever is sick of seeing policemen in this city behaving like serifs in the wild west, to come and support our co-worker Ilias Nikolaou at the court on 12-12-09.
We will be on his side.

sitting here thinking and wanted to share...

my dad goes before the parole board december 2nd. thinking about my
family and the families of other political prisoners and freedom
fighters around the world. thinking about you especially, kamel. i am
SO truly blessed to come from the family i do. the hearn clan. the shakur
clan.

it's a different way of life in many ways, being children of
revolutionaries. our parents fought, were imprisoned, were exiled,
and died fighting for basic human equality; and all the while growing
us in the discipline and knowledge, love and respect for not only our
people, but for all people. we think differently; we see the world
differently.

i was thinking about the last time i saw mutulu. it's a harsh
reminder to me when i think about the fact that i've never known my
dad in any other context outside of prison, even back to my first
memory. his every entrance into my life since i can remember has
always been the same...coming from behind those steel bars, he stops
so the officer can take of the chains. i've never seen him for more
than 4-5 hours at a time. you only get so many hours of visitation.
i've never seen him standing in the sunlight, never seen him standing
in grass; i've never seen him in anything other than a prison uniform.

we've never had a phone conversation that wasn't recorded, written
letters that weren't read before it reached his hands, or given hugs
that weren't closely watched. i've shared every intimate moment with
him, with someone else. he's never been able to see all of his
children together at once, and now that pac has passed away he'll
never be able too.

now mutulu is in florence, colorado. the #1 maximum security prison
in the united states. "also known as the ADMAX, Supermax, or The
Alcatraz of the Rockies, ADX houses the prisoners who are deemed the
most dangerous and in need of the tightest control. it is the highest
level security federal prison in the united states, and generally
considered the most secure prison in the world. individuals are kept
for at least 23 hours each day in solitary confinement." that means
he gets 1 hour, by himself, outside his cell in a heavily guarded
area. all of our visits are behind glass and he often handcuffed.

these things come to mind as his parole hearing draws near. they have
and continue to do everything the possibly can to keep him in prison.
long and short: after denying him his first parole hearing in 1996
with no just cause (as stated by a court) the parole board ignored
the recommendation to give him due process and waited 6 years to
convene. in 2002 the parole board finally convened, denied him parole
and stated that they would not allow him to come before the parole
board for another 15 years. because his first parole hearing was
legal set for 1996, a 15 year hit would mean he was able to come
before the parole board again in 2011, but as the parole board
refused to acknowledge the 6 year false delay (again, as stated by
the court), he will not be able to come before the parole board until
2017. his upcoming parole hearing is a fight for due process and his
right to come before the parole board and fight for his freedom in 2011.

as "thanksgiving" draws near, i am humbled by those who, like mutulu,
saw their difficult path before them and even still chose to stand
and fight, rather than lay down and continue to be enslaved. freedom
fighters ALL OVER THE WORLD. many of them will not be able to sit
down and have dinner with their families, will not be able to tuck
their children in at night, and will not be able to hold the ones
they love as they fall asleep.

yet they are fighting for our right to do so.

this thanksgiving, i give thanks for the people who fought and are
still fighting for freedom and equality.
i give honor to the indigenous people of this country who are still
fighting for their basic rights on their own land.
i give remembrance to who i am and where i come from. a people who's
blood runs deep in the earth of this country.

...and i pray, so very hard, that we continue to move forward as a
GLOBAL community, in love.

Welcome to the December 2009 edition of Spirit of Freedom. A few months ago
ELP reported the arrest of the American, Justin Solondz in China. As people
will be aware Justin is wanted for questioning in connection to an FBI
investigation into the ELF that led to the Oregon and Washington Trials.

When ELP first heard of the arrest we wrongly believed, like many others,
that Justin would be extradited to America where he would be remanded to
stand trial for his alleged ELF activity. However, a couple of days ago ELP
learnt that rather than extraditing him, the Chinese decided to put Justin
on trial accused of drugs related activity. Justin was duly found Guilty
and sentenced to three years imprisonment followed by deportation. This is
of course very bad news for Justin and if anyone has any contact details for
Justin (or knows what prison he is held in, in China, please contact ELP as
soon as possible).

Besides Justin's imprisonment, sadly over the past few weeks ELP has learnt
about the imprisonments of a number of people across Europe and North
America accused of a variety of activity, this includes the imprisonment of
former Italian ALF prisoner Sergio Stefani who has been accused of stealing
a car and charged with "subversive conspiracy" and placed in a jail
specifically designed for political activists! ELP encourages everyone to
write urgent letter of support to all of the new prisoners on our list and
remind them we are behind them. But also please don't forget our existing
prisoners. All of the prisoners listed below welcome letters of support.
So please, regardless of what languages you speak and regardless of where
you live in the world, your letters of support really do make the world of
difference to the prisoners. So please support the eco-prisoners and no
compromise in defence of Mother Earth!

Marco Camenisch, Postfach 3143, CH-8105 Regensdorf, Switzerland. Serving 18
years. 1) Ten years for using explosives to destroy electricity pylons
leading from nuclear power stations. 2) Eight years for the murder of a
Swiss Boarder Guard whilst on the run. In '02 Marco completed a 12-year
sentence in Italy for destroying electricity pylons in Italy. (Marco is a
meat eater who encourages organic living).

Niall Harnett, Castlerea Prison, Harristown, Castlerea, Co. Roscommon,
Republic of Ireland. Severing 4 months for non-payment of a fine. The fine
was issued following Maura's involvement in an anti-Shell petrol company
protest. (Diet unknown).

Maura Harringon, Dochas Centre, Mountjoy Gaol, North Circular Road, Dublin
7, Republic of Ireland. Severing 8 months for non-payment of a fine. The
fine was issued following Maura's involvement in an anti-Shell petrol
company protest. (Diet unknown).

Leonardo Landi, Carcere Sanremo, Via Armea, 144, 18038 Sanremo (IM), Italy.
Il Silvestre activist awaiting trial accused of robbery. (Leonardo is a
vegetarian).

Jeffrey Luers, # 13797671, CRCI, 9111 NE Sunderland Ave, Portland, OR
97211-1708, USA. Serving 10 years for arson on a SUV dealership & the
attempted arson of an oil truck. The original sentence was 22 years & 8
months, but was reduced on appeal. (Diet unknown).

Marie Jeanette Mason, #04672-061, FCI Waseca, Federal Correctional
Institution, PO Box 1731, Waseca, MN 56093, USA. Serving 21 years and 10
months for her involvement in an ELF arson against a University building
carrying out Genetically Modified crop tests. Marie also pleaded guilty to
conspiring to carry out ELF actions and admitted involvement in 12 other ELF
actions. (Marie is a vegan).

Eric McDavid, 16209-097, FCI Victorville, Medium II, Federal Correctional
Institution, PO Box 5300, Adelanto, CA 92301, USA. Serving 19 years & 7
months for planning to destroy the property of the U.S. Forestry Service,
mobile phone masts and power plants. At the point of his arrest no criminal
damage has actually occurred. (Eric is a vegan).

Daniel McGowan, 63794-053, USP Marion, US Penitentiary, PO Box 1000, Marion,
IL 62959, USA. Serving 7 years for an ELF arson against a Poplar Tree Farm
and an ELF arson against an old growth logging corporation. Also admitted
his role in an ELF/ALF conspiracy. (Daniel is a vegetarian).

Steve Murphy #39013177 (for his most current prison address check out the
website http://supportsteve.org/ ). On remand accused of attempted arson
and criminal damage at a town house construction site in 2006. The FBI
claim the action was done under the banner of the ELF. (Steve is a vegan).

Jonathan Paul - See details in Animal Liberation Prisoners List.

Justin Solondz (Address Unknown - China). American Green Scare defendant
accused of direct action activity in America. Serving 3 years in China for
drugs related offences then due to be deported back to America. His exact
prison location is currently unknown. (Diet unknown).

Jonatan Strandberg, Box 248, 59323, Västervik, Sweden. Serving 15 months
imprisonment after admitting damaging a communication tower used by the
Department of Defence, cutting the cables on a crane used in creating urban
sprawl, and damaging a vehicle used in the logging industry. (Jonatan is a
diabetic and follows a paleo diet, demanding locally sourced food).

The Lecce Defendants have been charged with "subversive association" accused
of damaging Esso petrol pumps to oppose the War on Iraq; sabotaging the cash
machines of a bank which funds an immigration centre; and targeting the
multinational company Benetton in support of Mapuche land rights activists
in Chile. All of the defendants are currently either under house arrest or
released on bail.

Call for an international day of action for the release of animal rights activists
imprisoned in the Netherlands - Wednesday, 02.12.2009

Since 29 October 2009 Rieke S., an activist from Germany accused of releasing mink
from a mink farm in Gelderse/Barchem, is imprisoned on remand in Breda, Netherlands.
On November 17th, 2009, another activist, this time from the Netherlands, was
arrested and imprisoned on remand. According to the media, 5000 mink were released
and several cages destroyed in the course of the liberation they are accused of.
Unfortunately, the minks couldn't escape from the area, seemingly because the police
interrupted the action before the fences could be opened and removed.

The first accused activist was allegedly arrested already during the liberation
action, supposedly as a direct result of over two years of continous observation and
surveillance of the Dutch animal rights movement. Three apartments were raided by
the police. The pre-trial detention was already prolonged several times in both
cases, therefore a soon release seems unlikely.

The imprisoned activists are isolated from the outside world, so far they weren´t
allowed to receive visits from their friends or relatives. Even the receiving of
letters was averted for the first weeks. This violates EU-directives: According to
the European Court for Human Rights pre-trial detention in EU-countries is only
allowed to be imposed for securing a criminal case, and mustn't be of punitive
character because the trial itself has not yet been completed. Contact to the family
must be allowed, the amount of postal letters may not be limited or stopped totally.

The German Animal Rights group "die tierbefreier e.V." and other animal rights
groups are therefore calling for an international day of action on December 2nd, to
demand the immediate release of both activists and to end their isolation. The
activists must be able to receive visits and mail at regular intervals!

To create maximum pressure on the Dutch authorities, protests at Dutch embassies and
consulates should take place on this day (but are of course also welcome before or
afterwards!). It is also possible to express one's protest by contacting the Dutch
representatives by phone, fax or e-mail. Please inform us beforehand at
holland@die-tierbefreier.de whether you can organise a demo so that we know it for a
press release. Reports and/or photographs to this mailaddress are also appreciated.
Please also continue to write supportive letters for both prisoners. For Rieke it is
best to use the above mailaddress for the dutch activist you can use
dbf-sg@riseup.net. The e-mails are printed out and forwarded to the prison.

Man wanted in UW horticulture building fire sentenced in China on drug making charges

BEIJING — A man wanted in the U.S. for his alleged role in the fire that destroyed the horticulture center at the University of Washington in 2001 has been sentenced in China for making illegal drugs, a court official said today.

Justin Franchi Solondz was given three years in prison Friday, according to the official at the intermediate court in Dali city, Yunnan province. He gave his family name as Zhao.

It was unclear what drugs Solondz was found guilty of producing.

The FBI office in Seattle lists Solondz among its "most wanted." Its Web site says the 2006 charges are related to his alleged role in 2001 with the Earth Liberation Front, a loose collections of radical environmentalists.

Along with being linked to the UW fire, Solondz also is accused of having a role in the destruction of several buildings in Oregon, according to federal officials.

It was not clear whether Solondz, 30, will be deported to face the those charges.

A spokesman with the U.S. Embassy in Beijing said today he was not able to confirm his deportation.

Calls to the FBI in Seattle and Washington were not immediately returned.

*Films, Panels and Reunion*

The Maysles Institute will be hosting a series of films that will
explore the roles played by two vital, revolutionary civil-rights groups, The
Black Panthers and The Young Lords.

The series is entitled "Panthers & Lords: In Unity & Struggle."
Screenings will be followed by lively and provocative panel discussions by many of
the films' various participants.

The series marks the 40th anniversary of several important historical
events: the "New York Panther 21" case, themurder of Fred Hampton, the
founding of the Young Lords Political Party, and its subsequent take
over of the "peoples church." The series explores the interlocking vision of
the Panthers and the Lords. They were not only connected by their
similar visions, but also by the fact that the Young Lords' founder Jose "Cha
Cha" Jimenez met Fred Hampton in prison and from that meeting grew Jimenez's
determination to form The Young Lords. It, thus, became inevitable that
the Panthers and Lords would jointly cooperate on many endeavors.

Anarchist Prisoners of War held in the US. We, the movement
community, are the only support they have.

Anarchist, New Afrikan political prisoner Ojore Lutalo was recently
released from prison. He served 26 years, most of it in isolation, or
"the hole," all in the service of revolutionary struggle. The NYC
branch of the Anarchist Black Cross Federation has set up a gift
registry to insure that of the challenges of shifting from prisoner
to civilian, having basic apartment furnishings is not among them.
New Afrikan Anarchist Political Prisoner, Ojore N. Lutalo, is out
after 26 years of imprisonment!

Ojore Lutalo was locked down in Trenton, New Jersey, for actions
carried out in the fight for Black Liberation. In Ojore's own words,
he is, "serving a parole violation sentence (we received 14 to 17
years) stemming from a 1977 conviction for expropriating monies from
a capitalist state bank (in order to finance our activities) and
engaging the police in a gun battle in December 1975 in order to
effect our departure from the bank, and to ensure success of the
military operation..." "After my parole violation sentence terminated
in December 1987, I started serving a forty year sentence with a
twenty year parole ineligibility (I was paroled in 1980, and I have
been back in captivity since April 20, 1982) that I have received in
1982 for having a gun-fight with a drug dealer. The overall strategy
of assaulting a drug dealer is to secure monies to finance one's
activities, and to rid the oppressed communities of drug dealers."

Ojore was originally arrested with New Afrikan prisoner of war Kojo
Bomani Sababu, and was struggling with comrade Andaliwa Clark.
Andaliwa was killed in action within the confines of New Jersey's
infamous Trenton State Prison after he shot two of the prison's
security guards in the repressive Management Control Unit (M.C.U.) on
January 19th, 1976 when they tried to stop him from escaping from
captivity. Ojore was a comrade of the late Kuwasi Balagoon, a New
Afrikan Anarchist former prisoner of war who passed way in captivity.

The following is Oso Blanco's account of what happened:

On Nov/07/09 at Hour of 11:00am myself and my cellmate were assaulted by
Lt. Galletta and Lt. Sassaman and many staff. We were shot, gassed
with a Rapid Fire pepper-ball gun – same as a paint ball gun but with
pepper agent powder inside not paint. Then we were sprayed with oc agent
a lot. I cuffed up and was being shot and gassed anyway. My
cellie coyote hardly had time to cuff up and they started shooting us
in the cell. Its very painful then they stopped shooting so my cellie
came to the door and cuffed up. They put us in a freezing cold cell
and they then cam and rushed in(goon squad) the cell and took us to a
mop closet where they forced my head back as the guard was digging his
fingers under my side jaw bone, pulling my head back, and 7 or 8 were
holding my arms, legs – they squirted hot water on my face and up my
nose. I let out a native war cry scream and yelled to all the men here
to stay strong! This was all on camera. They then took me on camera to
the four point cell where its very cold and stripped me naked and put
very, very, very tight restraints on me. Locking the belly chain and
black box cuffs down to the bone. I told Lt. Sassamen what, “What
you're doing to me is a violation of the U.S. Constitution, a
violation of my human rights! It's wrong and evil what you are doing
to me!” All on Camera. Sovereign Cherokee Nation citizen have the full
protection of the U.S. Constitution and Bill of Rights. Then they held
me down on the cement table and PA Potter cut off 4 inches of my
ponytail braid. This is and illegal act and crime committed against an
enrolled Native American! To cut off part of my ponytail. And a great
insult!

We were left in separate freezing cold cells in tight restraints
cutting into our wrists for 9 hours. After the 4th hour a dark Lt. a
Spanish Lt. came and told my cellie across the hall we were being
charged with assaulting Lt. Galletta, that he was in the hospital and
the FBI would be coming to see us. And he gave me a false charge –
writeup for a weapon.

The sun went down and the cold cell had its large window 2 feet by 3
feet wide open and its Nov in PA. I was laying on the floor with these
cuffs and belly chain and shackles cutting into me . So I prayed in
Cherokee – “CREATOR why is this happening? I have done nothing! Why
are you letting my oppressor hurt me with out cause and torture me?" A
few min later they came and let me out of restraints, and told me I
was going back to the cell. It was full of about 50 pepper call rounds
and OC Agent. One young guard said in a low voice, “They messed up
doing this to you guys.” He said he is tired of this place and he is
going to quit his job. The next shift staff who took our cuffs and
restraints off 9 hours later looked at my hands ballooned up and
looked at each other – with a shake of the head and one said, “Who did
Chubbuck piss off?” asking the other guard. The guard just looked away
shaking his head. I have at least 20 witnesses. It was unprovoked
100 percent. I have statements.

For Immediate Release: Wednesday, November 25, 2009

The New York City Chapter of the National Lawyers Guild condemns
the actions of the Israeli government for its unlawful and racially
motivated detention of two African-American political activists.

On November 23, 2009, Dhoruba Bin Wahad, a former U.S. political
prisoner and leader of the Black Panther Party, and Naji Mujahid, a
student-activist from Washington D.C. were on a tourist bus enroute from
Amman, Jordan to the West Bank of occupied Palestine. Both had been
invited to attend a conference on political detention in Jericho that was
sponsored by the Palestinian Authority. As the bus crossed the King Hussein Bridge
that connects Jordan with the Israeli-occupied West Bank, it stopped
for a border inspection by Israeli officers. Of the numerous individuals on
the bus, only Dhoruba and Naji were ordered to disembark. Significantly,
both were the only Black people on the bus. Within a short time, the border
officials searched under Dhoruba’s name on the internet. They discovered
that he is Muslim, a former Black Panther leader and someone who
spent 19 years in prison for a crime he did not commit. (Dhoruba, a target of
COINTELPRO, was arrested in 1971 and sentenced to life in prison. His
conviction was overturned in 1990). Both Dhoruba and Naji were
interrogated, strip searched and their property confiscated and
searched. Despite their cooperation and offer to return into Jordan, their
detention continued for over 12 hours. They were ultimately released but denied
permission to enter occupied Palestine and returned to Jordan.

The treatment accorded Dhoruba and Naji would be outrageous if it
occurred to anyone. And as Naji Mujahid himself stated shortly after
returning to Amman, “the humiliation and frustration that we endured
was a small taste of what we can be sure the Palestinians go through on a
daily basis.” But the incident is rendered even more shameful because its
genesis appears to have been racial profiling. Dhoruba and Naji were ordered off
the bus before Israeli border officials had any idea of their country of
origin or personal histories. They only knew that they were Black.
Moreover, the incident occurred only days after it was reported that the
South African government deported an Israeli official following
allegations that a member of Shin Bet, the Israeli secret police, had infiltrated
the airport in Johannesburg in an effort to get information on South African
citizens, particularly Black and Muslim travelers (Reuters, November 22,
2009).

The New York City Chapter of the National Lawyers Guild calls
upon the United States State Department to lodge a formal protest
over the treatment of Dhoruba Bin Wahad and Naji Mujahid. We further call upon
the Israeli government to end its racist and unjust detention and
interrogation policies.
