Christina Aguilera's 25-year-old boyfriend Matthew Rutler has just been released from the pokey following his DUI arrest early this morning ... and he couldn't have looked any sadder.
Rutler -- still wearing the sportcoat he rocked last night -- was totally silent as he was escorted out of the West Hollywood Sheriff's Department.
He was whisked away by a waiting SUV ... probably to Christina's house ... where the two will have plenty to talk about.

Christina Aguilera's fingers appeared as she arrived home after spending time in a jail cell this AM.
TMZ broke the story ... Christina was popped for public intoxication and her BF Matt Rutler was arrested for DUI.
Aguilera will not be prosecuted for the incident ... but she'll probably be hung over.

Charlie Sheen has yet another problem ... he's going to be sued for allegedly derailing an attempt to replace Charlie with his estranged uncle on "Two and a Half Men."
The suit claims Charlie and his dad, Martin Sheen, along with his mom, Janet, conspired to "interfere and restrain" Chuck Lorre from replacing Charlie with Joe Estevez -- Charlie's estranged uncle.
The suit claims the plan was either to have Joe replace Charlie or appear in a spin-off of the sitcom, titled "Uncle Joe."
And the suit claims, Charlie, Martin and Janet also conspired to kill a proposed reality show titled "About the Sheens."
The plaintiff in the case is attorney Ed Meyer, who worked as Joe's manager -- Joe is not a named plaintiff. Meyer tells TMZ he was Joe's business partner in the reality show. Meyer says he's now estranged from Joe.
The suit seeks at least $20 million in damages.

Christina Aguilera's been released from custody and will not be prosecuted ... according to L.A. County Sheriff's spokesman Steve Whitmore.
As we first reported, Christina was arrested for public intoxication at 2:45 AM this morning in West Hollywood -- and her boyfriend Matt Rutler was busted for DUI.
Law enforcement officials had said Christina was "not involved in any criminal activity" and would be released once she could "safely take care of herself."
Rutler is still in custody.
UPDATE 9:10 AM PT: Whitmore confirms Christina was arrested, booked, fingerprinted, put in a cell, and then monitored. But ... Whitmore insisted they have "no desire" to prosecute her.

Christina Aguilera was arrested early this morning along with her boyfriend in West Hollywood, TMZ has learned. Christina was popped for public intoxication and her boyfriend was arrested for driving under the influence.
Cops say ... Aguilera was a passenger in a car driven by Matthew Rutler when officers noticed he was driving erratically around 2:45 AM ... so they pulled the vehicle over.
Officers determined Rutler was drunk and arrested him for misdemeanor DUI.
Cops say the deputies determined Aguilera was also "extremely intoxicated" ... and since she was unable to
care for herself,
Aguilera was taken into custody.
Aguilera was booked for public intoxication -- and according to the booking sheet, she was listed at 5'2" and 100 lbs.
According to the L.A. County Sheriff's Department, Rutler's bail was set at $5,000.
However, the source adds, "If the driver had NOT been arrested for DUI, [Christina] would have never been in trouble."
Sources close to Xtina tell us they have been trying to get the singer into a rehab program for weeks.

A new photo has surfaced that reportedly shows a lip injury Chris Brown suffered the night he beat up Rihanna -- and the damage is so minute ... you can hardly tell he was hurt at all.
According to MediaTakeOut.com -- the website that posted the pic -- the photo was taken shortly after the night of the 2009 incident.
Brown had told investigators Rihanna had hit him first that night ... and scratched up his face.
Ultimately, it didn't matter -- and Brown plead guilty to assault.

Charlie Sheen claims he doesn't hate Chuck Lorre because of his "Jewishness" ... he hates him for other reasons ... and now Sheen is lashing out at a Jewish org. for insinuating he's an anti-Semite.
Sheen is still FURIOUS with the Anti-Defamation League for saying the actor exhibited "borderline anti-Semitism" when he referred to the "Two and a Half Men" creator by his Hebrew name Chaim Levine.
Now, Sheen's lawyer -- legal pitbull Marty Singer -- has fired off a letter to the ADL demanding a retraction ... because Sheen's only intention was to "address the man rather than his television persona."
In the letter, Singer points out that Chuck has referred to himself by the name Chaim on a vanity card back in February ... a vanity card in which Charlie claims Chuck writes about "a lifetime of distancing himself from Judaism."
In fact, Team Charlie insinuates the ADL should denounce Lorre for acknowledging his "disdain for the Jewish religion."
Calls to the ADL have not been returned.

Lindsay Lohan was in no hurry to leave Kamofie & Company the day she allegedly stole a $2,500 necklace -- in fact, she yakked with the owner for several minutes before leaving the store.
According to sources who have reviewed the tape, Lindsay wore the necklace almost the entire time she was in the store. We're told the surveillance video clearly shows Lindsay trying on the necklace, checking herself out in the mirror, and appearing to ask her friend and the store owner for their opinion (there is no audio on the tape).
We're told Lindsay took off her own necklace to try on the store's necklace.
Lindsay never took the necklace off, according to our sources, and she wore it in plain view for the next 45 minutes while she tried on several rings.
According to our sources, before walking out of the store, Lindsay put her own necklace back on, but it in no way obstructed the store's necklace.
Even better for Lindsay, with the store's necklace in plain view, Lindsay is seen talking to the owner for several minutes before strolling out.
Doesn't sound like the actions of someone that tried to steal a necklace, does it?

Charlie Sheen's lawyer tells TMZ ... Warner Bros. is two-faced about "Two and a Half Men" and he's getting ready to pursue legal action.
TMZ broke the story ... legal pit bull Marty Singer fired off a demand letter to Warner Bros. and CBS, demanding that Charlie be paid for the remaining episodes that were canceled this season ... or else.
Singer claims it's ridiculous to think Warner Bros. axed the episodes because of Charlie's behavior. Singer says, "Warner Bros. had no problem last year when it looked like Charlie might plead guilty to a felony," referring to the domestic violence case in Aspen involving Brooke Mueller.
Singer adds, "Warner Bros. made it clear they wanted Charlie back for two more years, even with the prospect that he could go to jail. They made a deal with him while the charges were pending."
Singer goes on, "But now that Charlie made some disparaging comments about the show runner who had refused to work ... they made a decision not to proceed with the show this year. It's outrageous."
Singer believes Warner Bros. is cow-towing to Lorre because he produces lots of shows for them.
And Singer says, If Warner Bros. doesn't pay Charlie, "we're going to pursue all legal options."
Warner Bros. had no comment.

Chuck Lorre just posted an existential statement on his website with a vanity card from tonight's episode of "Mike and Molly" -- and if we're reading it correctly, it sounds like "Two and a Half Men" is over and out.
The statement is long and rambling -- it seems he's mocking Charlie's recent ramblings. Lorre says, "I believe that consciousness creates the illusion of individualism, the false feeling of being separate." Translation: Charlie may think he's blazing his own path but he's still on the well-traveled trail of life.
Lorre goes on: "I further believe that this existential misunderstanding is the prime motivating force for the neurotic compulsion to blot out consciousness." Translation: Charlie is living in a dream world.
There are other gems, but Lorre ends by writing, "The Fall from Grace is, in fact, a Sprint from Grace. Or perhaps more accurately, Screw Grace, I am so outta here!"
As for writing, "I am so outta here!" could be Lorre talking or it could be what Lorre thinks Charlie is saying.
The more we think about it, it seems he's referring to Charlie, but either way, what really seems "outta here" is "Two and a Half Men."

It's in their blood ... and now Prince & Paris Jackson want to show the world they belong in show business ... by trying out for their school play -- a mash-up of classic "Brothers Grimm" fairy tales.
Paris expressed interest in auditioning for the show recently on "Good Morning America" -- and now TMZ has learned, Prince wants in on the action too ... because they BOTH officially tried out last week.
The show's called "The Brothers Grimm Spectaculathon" ... and it crams 209 classic fairy tales -- like "Snow White" and "Cinderella" -- into a single jam-packed play.
So far, no word on who got what role -- if any -- but the odds are in their favor ... because the play has nearly 50 characters in it.

Christian Bale single-handedly crashed Dicky Eklund's website Sunday night during the Oscars -- after the "Fighter" star gave the famous boxing trainer a shoutout during the awards ceremony.
Dicky's daughter and publicist Kerry Eklund tells TMZ, Bale's promo during his acceptance speech for "Best Supporting Actor" drove a ridiculous amount of traffic to Dicky's website ... and the servers just couldn't handle the load.
Sources on the technical side tell us, the site experienced nearly 20 times its normal daily traffic -- jumping from around 500 hits to nearly 10,000.
The site is up and running again -- and Kerry tells us, Dicky's ready to kick his training schedule into high gear.
