Stepping back from the legal case to be made—I’m neither qualified to comment on nor terribly interested in that aspect—I think what the recent controversy shows is that there was something philosophically wrong with the famous example in Schenck v. United States.

Will the Internet Free Us From State-Controlled Currency?

Setting aside the issue of whether it ought to be legal, the pirating of copyrighted material has thrived using the kind of peer-to-peer model advocated by proponents of electronic alternative currencies, despite numerous run-ins with law enforcement. The Pirate Bay survived a police raid in May 2006, and is likely to survive the raid that took place today. A digital currency could not readily withstand similar disruptions.
