ACLU of Texas Files Lawsuit Over Restrictions on Protesters Outside President’s Ranch

Plaintiffs include Cindy Sheehan, Daniel Ellsberg, and Ann Wright. The ACLU of Texas today asked a district judge to block McLennan County officials from enforcing orders aimed at restricting anti-war protesters outside President Bush’s ranch in Crawford, saying the orders violate free speech rights and exceed the officials’ authority. “This suit is not about the president or politics. It is not even about the war,” said Will Harrell, Executive Director of the ACLU of Texas. “It is about the County Commissioners’ decision to overstep their own authority in an effort to unlawfully restrict the protected activities of a group of protesters and the media by limiting their access to space, restroom facilities, and shelter from the elements.”

Earlier today, BuzzFlash suggested that the Bush Administration's claim of foiling an attempt to destroy the Sears Tower was propaganda exaggerated to distract and mislead us. While we have not denied there were indeed rumors and boasts of committing acts of terror, a careful examination of the facts makes it clear that the Miami group was not as serious a threat as portrayed in the media. They had no operational ability beyond their mouths.

Last Sunday, Murtha was the guest speaker at a town hall meeting on the Iraq War organized by U.S. Rep. Kendrick B. Meek, D-Miami, at Florida International University's Biscayne Bay Campus. The South Florida Sun-Sentinel reported that Rep. John Murtha said he believed the “American presence in Iraq is more dangerous to world peace than nuclear threats from North Korea or Iran.” The report was quickly seized on by conservative media — including Brit Hume, Bill O’Reilly, Joe Scarborough and Tucker Carlson — to attack Murtha. Newt Gingrich, on Fox News, 6/26 said, "For an American congressman to say that is beyond any acceptable behavior, and I would hope the Congress would move to censure him."

Critics are voicing concern about the FBI’s use of informants, methodology, and alleged pattern of entrapment in relation to the arrests last week of seven Miami men for having allegedly plotted to blow up the Sears Tower in Chicago and federal buildings in other cities, RAW STORY has learned. The Liberty Seven case, named after the Miami area in which they were arrested, shows a striking resemblance to the California McDavid case, in which an independent “confidential informant” was also used – a woman by the name of Anna.

I woke up at 1:45 am, to the sound of "booms" from Israeli tanks. I live 20 minutes from the Gaza Strip, in Israel. Less than a year ago, we disengaged from Gaza. I watched the entire disengage-ment on Israeli TV - where it was broadcasted around the clock. On the roads near my kibbutz, I saw how, in less than a week, the Israeli Army dismantled all of the settlements and sent the 8,000 settlers and a few more thousand of their supporters back into Israel's pre 1967 borders. It was done with amazing calm and non-violence. Now, 10 months later, we are back in there, in that poverty-stricken and so much demolished strip of land that is just about as close to Hell as one can get on this earth.

Norma Becker, teacher, civil rights activist, and towering figure of the peace movement during the Vietnam War, died of lung cancer in her New York City home June 17. She was 76. A founder of the Fifth Avenue Vietnam Peace Parade Committee, which drew tens of thousands to protest the Vietnam War, and a founder of the Mobilization for Survival coalition, she was crucial to the antiwar movement. She served as chair of the pacifist War Resisters League from 1977 to 1983.

It appears the entire case rests on conversations between the group's supposed ringleader and an FBI informant posed as representative of Al-Qaida. The Liberty City raid seems to suggest that Black "wannabes" are more valuable targets than actual terrorists who are white. This operation must not be the pretext for more aggressive police presence and tactics in the Black community, as invoking the notion of "terrorism" is not a blank check for the abuse of individuals, entire communities or the rights of either one. Further, the raids cannot be used to justify the continued discriminatory policies directed against Haitian refugees and immigrants.

U.S. Army First Lieutenant Ehren K. Watada reported to duty at 2:00 a.m. early this morning and refused orders to move to the adjacent McChord Air Force Base to prepare to fly to Iraq. Lt. Watada believes that the war and occupation in Iraq are illegal, and thus participation in the war is also illegal. At this time he has been restricted to base and has been ordered to have no communication with non-military personnel.

Almost four months after going on strike, the University of Miami janitors finally got their union last week. The story that began March 1 is almost over now, and the only ones left out of the happy ending are the 18 students who pushed the limits of the accepted in their support for the workers. Even as the janitors celebrated, UM continued to persecute the students for their nonviolent protests on behalf of the strikers.

Last April, the Nicaragua Network, a Washington-based solidarity group, “condemned” the intervention of U.S. Ambassador Paul Trivelli in Nicaragua’s election process. Arnold Matlin, of Nicanet’s board of directors, asserted that “what the U.S. government is doing in Nicaragua would be illegal if a foreign government tried to do it in the U.S.” The April 1961 Vienna Convention on Diplomatic Relations supports Matlin’s assertion, providing that representatives or diplomats “have a duty not to interfere in the internal affairs of that state” to which they may be assigned. But regardless of international law, the U.S. has rarely felt constrained over intervening in the internal affairs of many countries, and for 150 years Nicaragua has borne the brunt of more interventions than almost any other country in this hemisphere. However, it is far from being alone.

The American Civil Liberties Union (ACLU) of Florida, Greater Miami Chapter today filed a lawsuit against the Miami-Dade County School Board challenging the removal and banning of a series of children’s books, including the hotly debated Vamos a Cuba (A Visit to Cuba), from the public school’s library system. “I understand that the images and words contained in Vamos a Cuba are hurtful to many who lost their homeland. But the lawful response as the U.S. Supreme Court has said time and time again is to add more information with different viewpoints, not enforce censorship,” said Howard Simon, Executive Director of the ACLU of Florida. “Censorship is a cure worse than the disease.”

During early summer of 1942, Alex Schmorell and Hans Scholl wrote four leaflets, copied them on a typewriter with as many copies as could be made. These leaflets were left in telephone books in public phone booths, mailed to professors and students, and taken by courier to other universities for distribution. Kurt Huber contributed to the fifth leaflet and solely drafted the sixth (and final) leaflet, while Hans was apprehended with a rough-draft of a seventh leaflet written by Christoph Probst. Compared to four years ago, the Green Party looks like a party in decline rather than an emerging political force. Four years ago it was a major political party because Ralph Nader had garnered more than 5 percent of the popular vote in Minnesota in his bid for President as a Green Party candidate. The Green Party State Convention in St. Cloud attracted hundreds. There were over 80 candidates for local office as well as a complete slate of candidates for state constitutional offices. This year it is not a major party since no candidate running statewide received more than 5 percent of the vote in the last four years.

According to activists from Des Moines, Philadelphia, Miami, Sacramento, and other locations, a young woman named "Anna" allegedly infiltrated peace and justice rallies and anarchist meetings, and even attempted to join protests against the Democratic National Committee (DNC) ahead of the DNC's national convention last year as a paid FBI confidential "informant." Watada had planned to be at his press conference during his lunch break, but was prohibited to leave Fort Lewis by his superior officers.

Scott Silverman, Chairman of the Board of VeriChip Corporation, has proposed implanting the company's RFID tracking tags in immigrant and guest workers. He made the statement on national television on May 16th. Silverman was being interviewed on "Fox & Friends." A report released earlier this month details what experts are saying are the most serious electronic voting machine flaws ever documented. The author of the report is Harri Hursti. He is a Finnish security expert who analyzed Diebold voting machines for an organization called Black Box Voting. Hursti wrote in the report that the defects in the machines could "cast a serious question over the integrity of the vote” and that “someone could attack the system to selectively disenfranchise groups of voters through denial of service.”

US Marines could face the death penalty after one of their number took horrific photographs of a massacre in Iraq on his mobile phone. The photographs, seized by the US Naval Criminal Investigative Service (NCIS), show many victims shot at close range in the head and chest, execution-style, according to sources who have seen them. One image shows a mother and young child bent over on the floor as if in prayer. Both have been shot dead. Present estimates are that around 300,000 Iraqi civilians have been murdered. They did not have the fortune to get publicized in the mainstream media, and hence their murderers - US soldiers - will not be sentenced. But, there are hundreds or thousands of US soldiers that should be sentenced for their crimes against the Iraqi people. And the non-soldiers in the White House need to be sentenced to life imprisonment for starting the war and perpetrating the mass murder of the people of Iraq.

That he can trample the Constitution and amass detailed data on more than 200 million Americans who aren't suspected of any crime. And that he can claim he's just doing it to fight the terrorists, while he leaves the ports unguarded - and that we will believe him. Such hubris!

Stone-throwing Iranian students fought police and Islamic vigilantes on Wednesday in protest against restrictions imposed by the government of President Mahmoud Ahmadinejad, witnesses said. Senior student leader Abdollah Momeni said up to 2,000 students had gathered for the protest over the expulsion of some students and the way authorities had been handling critics. He added 20 had been seized by Islamic vigilantes who broke into the dormitories. Police spokesman Mohammad Tourang told the ISNA students news agency, five policemen had been injured in the clashes and that the police made an unspecified number of arrests.

The White Rose (German: die Weiße Rose) was a World War II resistance group in Germany famous for a leaflet campaign in which they called for active opposition to the Nazi regime. The group initially consisted of five students, all in their early twenties at Munich University. Between June 1942 to February 1943 they prepared and distributed six leaflets, in which they called for an end to Nazi crimes and tyranny through active opposition of the German people. Hans Scholl and his sister Sophie led the rest of the group, including Christoph Probst, Alexander Schmorell and Willi Graf. They were joined by a professor, Kurt Huber, who drafted the final two leaflets. All six members of this group were arrested, tried, convicted and executed by beheading. A seventh leaflet was found in possession of the students at the time of their arrest by the Gestapo.

DELAND -- A funny thing happened when Volusia County elections officials fired up their new touch-screen voting machines -- they discovered the equipment wasn't certified by the state. Rawstory has reported that two US aircraft carriers are steaming toward the Persian Gulf to join the one already there. The American civil Liberties Union sueing the City of Miami over FTAA civil rights violations. The ACLU, Greater Miami Chapter, filed a lawsuit today on behalf of freelance journalist David Lippman. Today, May 1, 2006, UNICCO Service Company and the Service Employees International Union (SEIU) Local 11 entered into a Settlement Agreement in connection with the ongoing labor dispute at the University of Miami. Under the terms of the Settlement Agreement, the parties agreed to conduct an impartial process to verify the majority of employees' interest in collective bargaining representation by the SEIU. This verification process will be conducted by a neutral third party, the American Arbitration Association (AAA) and completed no later than August 1, 2006.

The company was cited by the Occupational Safety and Health Administration (OSHA) for repeated violations after a frightening eighth job-related employee fatality since 1999. The independent study, being released today by the National Council on Occupational Safety and Health (COSH), is the first of its kind citing poor records in health and safety protections that result in death, serious injury, and illnesses. The 12 companies were selected due to repeated and reckless health and safety violations.

Ed Asner (actor and activist) was at Freedom Village this morning. He made a strong statement to all of us, which was caught by Ch.7. He was interviewed by Ch. 7, and then spoke with each of the workers and hunger strikers. He then went over to the students in front of Ashe where he placed calls to Shalala and Colson. As soon as Shalala’s office learned he was here, the water was turned off. When he left, it was turned back on. Shalala’s office said she wasn’t here (naturally), so he dictated an email to Jake to send to her. I think he reached Colson’s voice mail.

Reverend Charles Steele, the president of the Southern Christian Leadership Conference, came straight from the airport to the Ashe Building at the University of Miami today. He was given permission to enter the building to negotiate with Donna Shalala [a group of female students had occupied the building, put tape over their mouths, and were humming "We Shall Overcome"]. Rev. James Bush joined him. The students were allowed to leave the building and are camped out on the lawn in front of the Ashe Building (in their tents). Rev. Steele made it very clear that if they are arrested, he will be arrested with them.

Today at 8:30 a.m. Pablo Rodriguez, 31, awoke feeling weak. He then began to shake. His blood pressure dropped to dangerous levels. An ambulance was called and he was taken to Doctors Hospital. Then hunger striking student Tanya Aquino was urged to go to hospital, owing to high blood pressure and low pulse. She refused to go until she was able to speak to an administrator. As she approached the Ashe, being pushed in a wheelchair, the building was locked down yet again. The workers heard from former Congressman David Bonior who heads American Rights at Work, a nonprofit workers' rights advocacy group and who had begun a letter to Donna Shalala yesterday which already has three congressional signatures asking her to recognize the union through the most democratic method possible, card check. He actually gave me new hope as well as he spoke about the seriously flawed NLRB election process and why the Employee Free Choice Act (which would recognize card check without the employer needing to specifically agree to card check) is currently pending in both Congress and the Senate.

Day 7 – How much longer can it go on? I woke up with such a feeling of dread today. It's Day 7 for the workers. I know the students will join them tomorrow but that will already be Day 8. I would like to believe that contacting University of Miami administration would be enough but I simply don't know anymore. If you are inclined to and haven't yet contacted your various elected officials, media and others, please do so as soon as possible. I spoke to the hunger striking workers again yesterday (surrounded by a circle of striking workers) and they requested that when I spoke to people about them, people that were trying to understand the situation, that I ask people to ask themselves the following questions:

At a rally at the UM University Center Patio seven students will announce on Wednesday April 12th at a 1:30 PM rally at the UM University Center Patio, an All-Out Hunger Strike for civil rights. After phasing certain food groups out and eating raw vegetables for the last few days, seven students will announce a water-only diet until civil rights violations at UM cease and workers are allowed a fair process to unionize. When asked why they were going on a hunger strike, a student response was, “To protect workers rights and ensure ethical contracting policies for the University of Miami.”

Nine UNICCO janitors and six students began a fast on April 4th to protest UNICCO’s civil rights abuses. The fasters hope that University of Miami President and former Clinton Administration official Donna Shalala will make good on her public statements and force UNICCO to obey the law and stop violating the civil rights of their employees on campus. Dean Colson (who is the chair of the board of trustees) and UM president Donna Shalala's handling of the situation has escalated out of control, to the point where workers and students feel that the only recourse to justice that they have is through risking their livelihoods in a hunger strike. The law provides two ways for workers to unionize. One is by an election run by the National Labor Relations Board. The other is by a card check process, in which workers sign cards, counted by a third party, saying that they want a union. Unlike NLRB elections, however, card check requires the employer to agree. UNICCO refuses to agree. Why? UNICCO now sports the slogan "Let ‘em vote," signifying its preference for an election over card check.

According to a press release by the US Southern Command on Monday, March 27: "A U.S. Navy Carrier Strike Group will deploy from the U.S. east coast to the Caribbean Sea to conduct Operation Partnership of the Americas from early April through late May 2006." The strike group will be composed of "aircraft carrier USS George Washington with embarked air wing, Cruiser USS Monterey, Destroyer USS Stout, and Frigate USS Underwood". The Coalition of Immokalee Workers, along with the Student Farmworker Alliance and other supporters, launched their first protest in the nation at Wayne State, calling for more humane working conditions for tomato pickers. “It’s modern slavery,” said Sean Sellers, national coordinator of the alliance. “These workers are forced to work long hours, for little to no pay and no benefits, with the threat of violence.” Immokalee farm workers and many allies left Florida on March 26 to embark on a 10-day, 17-city Real Rights Tour to inform students about the exploitation workers face and discuss their goals to establish decent labor rights and higher wages.

At 12 noon a group of local clergy accompanied by faculty, workers and others marches from the Strike Sanctuary to the intersection of Granada and US1 where they joined a large group of striking workers. Altogether we were about 300 people. The traffic was blocked in both directions on US1 and a group of clergy and workers sat down in the middle of the road and... were promptly arrested. As planned.

On March 28th at 12 PM, please join the Coalition of UM Students, Faculty, Unicco Workers, Interfaith Clergy, and Community Leaders for an all-out rally in support of UM striking janitors at the UM Episcopal Church on Stanford Drive. Workers struggle for a fair process toward unionization yet UNICCO's threats & firings go unchallenged by the UM administration. UNICCO stands accused by the gov't of spying, interrogating, threatening (workers) with reprisals. While UM maintains its "neutrality", UNICCO's anti-union campaign has fired a worker for her union support. A one-time raise - still not a living wage - during a union drive is no substitute for a "place at the table" where workers can ensure that this is not a tempory handout. The strike will continue until workers' efforts to organize without fear of threats and reprisals are addressed by UNICCO and the UM administration.

Dear STAND (Students Toward A New Democracy), I apologize for the belatedness of this letter. It has been several days since President Shalala announced a wage increase for the University's contract workers, and promised some form of health insurance as well. We genuinely appreciate these actions, and congratulate the University and President Shalala for finally acknowledging that, "Universities should always lead the way, and providing fair wages and health insurance is a necessity," as President Shalala wrote in her March 19th statement. However, $8.00 per hour, the new minimum starting wage for UM's contract employees according to that statement, remains well below even the Miami-Dade County's living wage for people with full benefits (almost $10/hr) - which is itself a conservative estimate of the cost of living a minimally decent life in Miami. On January 14th, the SOUTH FLORIDA ACTIVIST CONFERENCE was held at the Miami Workers Center. The conference was organized by the Impact Collective. The conference brought together the activist community to strategize, plan projects and upcoming events, and generally work towards building a stronger, more cohesive movement in the area. There were workshops and discussions on planning for a March 20th demonstration marking the 3rd anniversary of the war in Iraq, Counter-military recruitment in schools, How to Access your FBI File, The Struggle for Freedom in Haiti, Instant Runoff Voting, The International Bolivarian Movement, Earth First! and the Radical Ecology Movement.

January 3, 2006 We have some bad news to report on Fr. Gerard Jean-Juste, the Haitian priest who has been imprisoned in Haiti since his illegal arrest on July 21. Dr. Paul Farmer of Harvard Medical School, who has run a clinic in Haiti for 20 years, examined him on Christmas Eve and ran some tests. The tests came back last week, and show that Fr. Gerry has chronic lymphocytic leukemia. Dr. Farmer could not say exactly how advanced Fr. Gerry’s leukemia is- those tests need to be done in the U.S.- but the symptoms are progressing rapidly, and could advance quickly into a fatal stage, or compromise Fr. Gerry’s immune system enough that the diseases of a Haitian prison would kill him.

On March 28th at 12 PM, please join the Coalition of UM Students, Faculty, Unicco Workers, Interfaith Clergy, and Community Leaders for an all-out rally in support of UM striking janitors at the UM Episcopal Church on Stanford Drive. Workers struggle for a fair process toward unionization yet UNICCO's threats & firings go unchallenged by the UM administration. UNICCO stands accused by the gov't of spying, interrogating, threatening (workers) with reprisals. While UM maintains its "newtrality", UNICCO's anti-union campaign has fired a worker for her union support. A one-time raise - still not a living wage - during a union drive is no substitute for a "place at the table" where workers can ensure that this is not a tempory handout. The strike will continue until workers' efforts to organize without fear of threats and reprisals are addressed by UNICCO and the UM administration.

Sir! No Sir! is the first film to retell the tale of resistance to the Vietnam war within the military. Like the Vietnam War itself, the GI antiwar movement started small and within a few years had exploded into a force that altered history. Like the times from which it grew, the movement involved organized actions and spontaneous resistance, political groups and cultural upheaval. Today, at a time when American troops are again fighting a protracted, questionable war, this military insurgency is all but eliminated from collective memory. SIR! NO SIR! includes archival news footage that features Vietnam veterans hurling their medals onto the Capitol steps; refusal by troops to engage in combat at Firebase Pace; and never-before-seen Super-8 and 16mm film footage of events in the GI movement shot by GIs and civilian activists.
